STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: APPROVE PLANS AND SPECIFICATIONS AND AUTHORIZE NEGOTIATION OF A CONTRACT CHANGE ORDER WITH R. J. NOBLE COMPANY FOR A TRAFFIC SIGNAL ON NEWPORT AVENUE SUMMARY The plans and specifications for a new traffic signal on Newport Avenue at the main entry to the R.D. Olson hotel project are being prepared for immediate construction subject to final approval by the City Engineer. RECOMMENDATION It is recommended that the City Council: 1. Adopt Resolution No. 13-21 approving the plans and specifications subject to final engineering approval by the City Engineer; 2. Amend the adopted Capital Improvement Program for Fiscal Year 2012-2013 to include the Newport Avenue Signal at this location; 3. Authorize the City Engineer to negotiate a contract change order with R.J. Noble Company for the Newport Avenue Signal installation, based upon bid pricing for similar work under contract and mobilized for the Tustin Ranch Road Phase 2 Roadway Improvements, subject to final approval by the City Manager; and 4. Appropriate $250,000 from unencumbered land sale proceeds in Fund 189 and authorize the City Manager to expend said funds in an amount not-to-exceed $250,000 for signal design, installation, construction engineering, and inspection. FISCAL IMPACT The engineer's estimate for the traffic signal design, installation, construction engineering and inspection is $250,000. Ultimately, the total actual cost for the signal installation will be proportionately shared by the adjoining developable parcels of Pacific Center East. Accordingly, R.D. Olson has agreed to a one-third proportionate share of actual costs. Funding is available from land sale proceeds in Fund 189 and the developer's proportionate share will be deposited back to the fund based on actual expenditure. Future developer proportional share will be included within any associated land sale transaction of adjoining parcels. DISCUSSION AND BACKGROUND A traffic signal on Newport Avenue at the entrance to the R.D. Olson hotel project is warranted in conjunction with the additional retail uses on the site. R.J. Noble is currently completing the Tustin Newport Avenue Signal Project April 2, 2013 Page 2 Ranch Road Phase 2 Roadway Improvements, including several traffic signalized intersection installations. The negotiated price of this signal is expected to be competitive with current signal contract prices. The construction of the traffic signal can best be accomplished prior to the majority of hotel and retail occupancy occurring in August-September to minimize disruption to the increased traffic anticipated. Proceeding in this fashion will advance the signal installation by approximately 4.5 months. Typical lead time for signal poles is approximately 16 weeks once engineering shop drawings are approved and the order is placed for fabrication and delivery. Do,Juqas'S. Stack, P.E. as '1S. Olson Project Development currently under construction, and WHEREAS, the traffic signal on Newport Avenue at the Main Hotel Entry is warranted in conjunction with the additional retail uses proposed by said development and in a manner that is proportionately cost shared with future adjoining developable parcels within the Pacific Center East; and WHEREAS, the construction of the said traffic signal can best be accomplished prior to the majority of hotel and retail occupancy proposed for August/September 2013, and WHEREAS, the City Engineer is currently preparing the final plans and specifications for the immediate construction of said work; and WHEREAS, the City of Tustin subject project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA); Class 1, Section 15301: Existing Facilities; and NOW, THEREFORE, BE IT RESOLVED that the plans and specifications are approved subject to the final approval by the City Engineer of the City of Tustin for: A New Traffic Signal on Newport Avenue at the Main Hotel Entry, -625 feet s/o Edinger Avenue PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held on the 2nd day of April 2013.
