The City may, at its sole cost and expense, elect to participate in defense of any such action under this condition. If the use is not operated in accordance with conditions of approval included in Exhibit A of Manning Commission Resolution No. 4213, or is found to be a nuisance or negative impacts are affecting the surrounding tenants or neighborhood, the Community Development Director may impose additional conditions to eliminate the nuisance or negative impacts, or may initiate proceedings to revoke the Conditional Use Permit. Should additional parking spaces be provided for the gyre use, the number of persons may be increased based on one (1) parking space for each three (3) persons subject to review and approval by the Community Development Director. Any change in number of staff or clients requires approval of revised parking summary by the Community Development Department x `202 The hours of services and business operation shall be to 5:00 AM to 3 :00 PM Monday through Friday, and 3:00 AM to 10:00 AM Saturday and Sunday. The Community Development Director may approve a request to modify the hours of operation if they are deemed to be compatible with the surrounding area. Modifications to the hours of operation may be approved by the Director of Community Development if it is determined that no impacts to surrounding tenants or properties will occur. (1) ` 3 if in the future the City determines that a parking, traffic, or noise problem exists on the site or in the vicinity as a result of the proposed project, the Community Development Director may require the applicant to prepare a parking demand analysis, traffic study, or noise analysis and the appHcant shall bear all associated costs. if said study indicates that there is inadequate parking or a traffic or noise problem, the app'licart shall be required to provide mitigation measures to be reviewed and approved by the Community Development Department and /or Public Works Department. Said mitigation may include, but are not limited to, the following: a. EstabHsh alternative hours of operation. b. Reduce the number of persons allowed in the facility at any given time. C. Major modifications to the floor area, services, and /or operation of the business may require consideration of a new conditional use permit by the Planning Commission. BUILDING (`Il) 3.1 At the time of building permit application, the plans shall comply with the current edition of the codes (2010 California Building Standards Code, and 2011 Green Building Code), City Ordinances, State, Federal laws, and other regulations as adopted by the City Council of the City of Tustin.
