RESOLUTION NO. 13 -18
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA, ADOPTING A NEGATIVE DECLARATION
FOR CODE AMENDMENT 13 -001 TO AMEND ARTICLE 4 AND
ARTICLE 9 OF THE TUSTIN CITY CODE TO INCORPORATE
MINOR TEXT AMENDMENTS TO THE ZONING CODE
The City Council of the City of Tustin does hereby resolve as follows:
The City Council finds and determines as follows:
A. That proposed Code Amendment 13 -001 is considered a "project" subject to
the terms of the California Environmental Quality Act ( "CEQA ") (Public
Resources Code §21000 et. seq.);
B. That an Initial Study was prepared to evaluate the potential environmental
impacts associated with Code Amendment 13 -001 and concluded that
potential impacts are at a level of insignificance and a Draft Negative
Declaration was prepared;
C. That a Notice of Intent to Adopt a Negative Declaration was filed with the Clerk
for the County of Orange for posting, and provided to members of the public
using a method permitted under CEQA Guidelines Section 15072(b). The Initial
Study and Draft Negative Declaration were made available for a 20 -day public
review and comment period from February 20, 2013, through March 12, 2013,
in compliance with Sections 15072 and 15105 of the State CEQA Guidelines.
The City received written comments at the March 12, 2013, Planning
Commission Public Hearing. It was noted by the City Attorney that the
comments were received after the public review period for the Initial Study;
additional written comments were submitted on April 9, 2013, prior to the
continued public hearing.
D. That the Planning Commission conducted a duly- noticed public hearing on
March 12, and April 9, 2013, to consider the Initial Study, proposed Negative
Declaration, and Ordinance No. 1429 (Code Amendment 2013 -001), at which
hearing, members of the public were afforded an opportunity to comment upon
the project. At the conclusion of the public hearing, the Planning Commission
adopted Resolution No. 4210 recommending that the City Council adopt a
Negative Declaration for Code Amendment 13 -001;
E. That the City Council conducted a duly noticed public hearing on May 7, 2013,
to consider Resolution No. 13 -18 for the Negative Declaration prepared for CA
13 -001 at which hearing, members of the public were afforded an opportunity
to comment upon the project and to introduce and have a first reading of
Ordinance No. 1429 (Code Amendment 13 -001) to amend Article 4 and Article

9 of the Tustin City Code and set a second reading on May 21, 2013, to adopt
Ordinance No. 1429 (CA 13 -001) and;
F. That the City Council considered the Initial Study and the Negative Declaration
(Exhibit 1) and finds it to be adequate for Ordinance No. 1429 (Code
Amendment 13 -001).
II. The City Council hereby adopts the Negative Declaration attached hereto as
Exhibit 1 for Code Amendment 13 -001 to amend Article 4 and 9 of the Tustin City
Code.
PASSED and ADOPTED at a regular meeting of the City Council of the City of
Tustin held on May 7, 2013.
