APPROVAL OF MINUTES – MAY 14, 2013, PLANNING COMMISSION RECOMMENDATION: That the Planning Commission approve the minutes of the May 14, 2013, meeting as provided. Motion: It was moved by Thompson, seconded by Lumbard, to move the Consent Calendar as amended. Motion carried 5-0. None PUBLIC HEARINGS REGULAR BUSINESS: Received and set for 2. PROPOSED AMENDMENT OF THE TUSTIN SUBDIVISION public hearing on ORDINANCE (ARTICLE 9, CHAPTER 3 OF THE TUSTIN June 11, 2013 CITY CODE) - TRANSMITTAL. Originally established in 1952, the City’s Subdivision Ordinance has been updated on numerous occasions. The last comprehensive revision of the City’s Subdivision Ordinance occurred in 1981, with the last specific update occurring on February 18, 1997. Staff has prepared draft Code Amendment 2013-002 (Ordinance No. 1430) as a comprehensive update of the Subdivision Code. In general, land cannot be divided in California without local government approval. Dividing land for sale, lease or financing is regulated by the California Subdivision Map Act (commencing with Government Code Section 66410) and local ordinances that are consistent with the Act. The Subdivision Code establishes regulations concerning the design of the subdivision, the size of its lots, and the types of improvements (street construction, sewer lines, drainage facilities, etc.), and the form and content of all required maps in Tustin, and is based upon the Subdivision Map Act. RECOMMENDATION: That the Planning Commission receive the Community Development Department’s draft update of the Tustin Subdivision Ordinance and set the item for public hearing on June 11, 2013. The Director gave a presentation of the transmittal to the Planning Commission. It was requested that the Commission submit any comments regarding the Subdivision Ordinance to staff before the public hearing date, so the comments could be collectively addressed in a presentation at the meeting of June 11, 2013. Motion: It was moved by Altowaiji, seconded by Lumbard, to receive the draft update of the Tustin Subdivision Ordinance and set the public hearing for June 11, 2013. Motion carried 5-0. Minutes – Planning Commission May 28, 2013 – Page 2 of 5 Approved 3. COMMENDATION NOMINATION – 2013 SECOND QUARTER. City’s Commendation Program recognizes an Old Town property of outstanding merit as often as every calendar quarter. A decorative sign is displayed at the property, and the owner is provided with a City-paid plaque and recognized at a City Council meeting. The most recent nomination was approved in May of 2010. Tustin resident Lucy Burch recently submitted a nomination for the residence at 138 North B Street. The owners, Kevin and Sarah McGee, purchased the property in 2011 and entered into a Mills Act contract with the City in December of 2011. RECOMMENDATION: That the Planning Commission approve the nomination of 138 North B Street to the City’s Commendation Program and Historic Register Plaque Program and select “Primrose House” and “1922” as the most appropriate historical name and date of construction of the property, respectively, pending concurrence from the Tustin Area Historical Society and/or Tustin Preservation Conservancy. Reekstin Gave a presentation of the proposed commendation nomination. General Planning Commission questions included: the typical procedure for nominations, and input from the Historical Society and Preservation Conservancy. Thompson Stated he walked the site and believes the home is well-deserving of a nomination. Kozak Stated he walked past the property as well and that the property owners are doing a wonderful job of maintaining the home. Would be happy to recommend the property. Motion: It was moved by Altowaiji, seconded by Thompson, to approve the nomination pending concurrence from the Tustin Area Historical Society and/or the Tustin Preservation Conservancy. Motion carried 5-0. Received and filed 4. FOLLOW-UP DISCUSSION: TOUR OF PROJECTS CITYWIDE. The May 28, 2013, tour of projects citywide will include the Rawlings Reservoir, the Marriott hotels and retail project, Fire Minutes – Planning Commission May 28, 2013 – Page 3 of 5 Station #37, Tustin Ranch Road construction, and Coventry Court at Columbus Square. The tour will focus on community master planning, architectural styles, new construction, senior housing, public facilities and infrastructure, and other community development matters. The primary purpose of the follow-up discussion is to provide a forum for the Commission to generally discuss the tour and to make recommendations for future tours. RECOMMENDATION: That the Planning Commission receive and file the report. Thanked staff for the tour. Stated it was great to see the projects first- Smith hand. Inquired if there are any sites which were not successful that the Commission could learn from. Suggested a walking-tour of Old Town Tustin for the future. Thanked staff for the informative tour. Stated it is exciting to see the Lumbard City being built-up and developed. Commended staff for their hard work. Thanked staff for coordinating the Citywide tour. Appreciated the Altowaiji information provided to the Commission. Is looking forward to the progression of the hotel site. Appreciated the tour and thanked staff for providing the opportunity to Thompson visit the project sites. Added his thanks to staff for the tour and thanked Mayor Pro Tem Kozak Puckett and Josh Stewart from the OC Register for accompanying them. Thanked Ken Nishikawa for meeting staff on site at the Tustin Ranch Road overpass. Requested an update on former RDA project areas. Motion: The Planning Commission received and filed the discussion item. No vote was necessary. STAFF CONCERNS: The Director reported as follows:  Stated that next time the Commission tours the City they will hopefully be able to tour more private development, including St. Anton, the Irvine Company, and Standard Pacific’s projects. COMMISSION CONCERNS: Smith  Had no additional comments to report this evening. Stated a third workshop is upcoming in June. Encouraged everyone to attend. Altowaiji  Thanked staff for the tour. Thompson  Stated the Chili-Cookoff is upcoming; th  Added that he will be absent from the June 25 Planning Commission meeting. Kozak  Is looking forward to the Chili-Cookoff; th  June 15 is the Annual Open House for the Tustin Police Department; th  June 26 is the first of the “Concerts in the Park” series;  Stated he recently attended his son’s graduation from law school at Hofstra University in New York.
