STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: APPROVE PLANS AND SPECIFICATIONS AND AUTHORIZE A CONTRACT CHANGE ORDER WITH R. J. NOBLE COMPANY AND PARSONS TRANSPORTATION GROUP FOR SEWER WORK IN TUSTIN RANCH ROAD AND BARRANCA PARKWAY AND FOR BARRANCA CHANNEL AND STREET IMPROVEMENT WORK (CIP 70205) SUMMARY The plans and specifications for the new 20" permanent sewer in Tustin Ranch Road and Barranca Parkway as well as the Barranca Channel and street improvement work are being prepared for immediate construction subject to final approval by the City Engineer. RECOMMENDATION It is recommended that the City Council: 1. Adopt Resolution No. 13-52 approving the plans and specifications subject to final engineering approval by the City Engineer; 2. Authorize a contract change order in the amount of $15,127,429 with the R.J. Noble Company for construction and in the amount of $996,071 with the Parsons Transportation Group for construction management for the sewer, channel, and roadway improvements based upon bid pricing for similar work under contract and mobilized for the Tustin Ranch Road Phase 2 Roadway Improvements; and 3. Appropriate $15,518,124 from unencumbered Tustin Legacy Backbone Infrastructure Obligation Program proceeds in Fund 187 and remainder from Land Proceeds Fund 189 and appropriate $605,376 from Irvine Ranch Water District (IRWD) Reimbursement Fund 200 and authorize the City Manager to expend said funds in an amount not-to-exceed $16,123,500 for construction installation, construction engineering, management and inspection. FISCAL IMPACT The estimate for the construction installation, construction engineering, management and inspection is $16,123,500 less $605,376 as a refundable obligation from IRWD for installation of their capital domestic and reclaimed water facilities during this construction effort. Funding is available from Tustin Legacy Backbone Infrastructure Obligation Program proceeds in Fund 187 and Land Proceeds Fund 189 in addition to the IRWD Reimbursement Fund 200. DISCUSSION AND BACKGROUND In March of this year during negotiations for the sale of Disposition Areas 2C & 8, it became apparent that the installation of the permanent sewer within Tustin Ranch Road and Barranca Sewer Work in TRR/Barranca and Barranca Channel and Barranca Parkway Project June 18, 2013 Page 2 Parkway was necessary to remove the existing temporary sewer line within Disposition Area 2C to complete the grading of these areas. Because of the depth and location of the future permanent sewer running adjacent to the existing Barranca Channel, it is more cost efficient to construct the Barranca Channel improvements at the same time as this permanent sewer. The requirement to construct the Barranca Channel improvements as well as the Barranca Parkway widening improvements were originally associated with the Disposition Area 2A transaction but were deleted at the June 4 City Council meeting as a requirement in return for upfront payment of the Backbone Infrastructure Obligation by The Irvine Company for that area which in turn can now be used to fund the majority of these improvements. Attached is a plan and cross-section showing the permanent sewer line in relationship to Tustin Ranch Road and the existing Barranca Channel. R.J. Noble is currently completing the Tustin Ranch Road Phase 2 Roadway Improvements, including sewer installations as well as storm drain box, laterals, and catch basin connections. The estimates for this work are competitive with current contract prices. Two estimates for the Barranca channel improvements were obtained from subcontractors currently working for R.J. Noble and these were compared to the costs of the just-completed channel improvements by the City of Irvine between Red Hill Avenue and just east of Aston Street. In addition, R.J. Noble's estimate for the sewer work is $500,000 below the estimated cost for this work as provided by The Irvine Company when they were approached to build this facility as part of the Disposition Area 2A transaction requirements. It is estimated also that constructing the sewer with the Barranca Channel improvements would save approximately $685,000 compared to constructing each facility separately. The construction of the sewer can also best be accomplished prior to the opening of the Tustin Ranch Road Extension at the end of this year to minimize disruption to the increased traffic anticipated. Additionally, construction of the Barranca Channel improvements can best be accomplished by starting now during the summer dry season months. Proceeding in this fashion will also advance the entire construction operation by approximately 4.5 months and avoid simultaneous disruptions along Barranca Parkway when Vestar begins their portion of the Barranca Channel improvement project. Barranca Cross-Section S:\City Council ltems\2013 Council Items\Approval of Contract Change Order with R J Noble Co and Parsons Transportation Group.docx A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIR, CALIFORNIA APPROVING PLANS AND SPECIFICATIONS FOR THE SEWER WITHIN TUSTIN RANCH ROAD AND BARRANCA PARKWAY AND THE BARRANCA CHANNEL AND BARRANCA PARKWAY IMPROVEMENTS (CIP NO. 70205) WHEREAS, it is the intention of the City Council of the City of Tustin, California to contract for the construction of sewer work within a portion of Tustin Ranch Road and Barranca Parkway, and for the Barranca Channel and Barranca Parkway improvement work from east of Aston Street to just west of Tustin Ranch Road (CIP No. 70205), and WHEREAS, the construction of the said work can best be accomplished prior to the opening of Tustin Ranch Road Extension at the end of this year to minimize disruption to the increased traffic anticipated, and WHEREAS, construction of the Barranca Channel improvements can best be accomplished by starting now during the summer dry season months, advancing the entire construction operation by approximately 4.5 months and avoid simultaneous disruptions along Barranca Parkway; and WHEREAS, R.J. Noble is the pre-qualified responsive/responsible bidder currently completing the Tustin Ranch Road Phase 2 Roadway Improvements, including sewer installations as well as storm drain box, laterals, and catch basin connections and the estimates for this work are competitive with current contract prices. WHEREAS, the City Engineer is currently preparing the final plans and specifications for the immediate construction of said work; and WHEREAS, that on January 16, 2001, the City of Tustin certified the Program Final Environmental Impact Statement/Environmental Impact Report (FEIS/EIR) for the reuse and disposal of MCAS Tustin. On December 6, 2004, the City Council adopted Resolution No. 04-76 approving a Supplement to the FEIS/EIR for the extension of Tustin Ranch Road between Walnut Avenue and the future alignment of Valencia North Loop Road. On April 3, 2006, the City Council adopted Resolution No. 06-43 approving an Addendum to the FEIS/EIR. On May 13, 2013, the City Council adopted Resolution No. 13-32 approving the 2nd Addendum to the FEIS/EIR. The FEIS/EIR along with its Addendums and Supplement is a program EIR under the California Environmental Quality Act (CEQA). The FEIS/EIR, Addendum and Supplement considered the potential environmental impacts associated with development on the former Marine Corps Air Station, Tustin; and NOW, THEREFORE, BE IT RESOLVED that the plans and specifications are approved subject to the final approval by the City Engineer of the City of Tustin for: Sewer within Tustin Ranch Road and Barranca Parkway, and the Barranca Channel and Barranca Parkway Improvements (CIP No. 70205) PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held on the 18th day of June, 2013.
