It has now been completed to the satisfaction of the Public Works Department m~d is ready for acceptance by the City Council. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 99-62 accepting said work as complete and authorizing the recordation of the Notice of Completion and direct the City Clerk to: 1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion; and Release the Faithful Performance Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion; and Assuming no claims or stop notices are filed, it is further recommended that 35 days after the date of recordation of the Notice of Completion, that the Council authorize payment of the final 10% retention in the amount of $3*-, 100.95. This amount together with previous payments, of $288,908.57· represents 100% of the final contract amount. FISCAL IMPACT The final cost of the construction Contract was $321.009.52, which included two Contract Change Orders. Contract Change Order No. 1 was for removal and treatment of contaminated soil. Change Order No. 2 was to run new wiring for the outside emergency fuel shut off switch in case of an after hour emergency. The Tustin Unified 'School District was invoiced for their share of the Underground Storage Tank Removal and Replacement Project. The City has received $128,000 as the Tustin Unified School District' s share of the project. BACKGROUND The Underground Storage Tank Removal and Replacement Project was mandated by the State of California and Federal upgrade requirements. The improvements were necessary to be in compliance with both State and Federal laws in order to dispense fuel and receive a Certificate of Compliance allowing the City of Tustin to buy bulk fuel for the City and Tustin Unified School Districts Fleet. The City fuel island is now in full operation. The contractor was Miller Brooks Environmental, Inc. This work has been completed to the satisfaction of the Public Works Department. The final contract amount of $321,009.52 represents a decrease of 1.6 percent from the original contract amount of $326,286.30. The decrease was due to deletion of the tree and curb and gutter removal and replacement bid items that the contractor was able to protect in place and also due to liquidated damages withheld from the final contract amount. Therefore, it is recommended that the City Council adopt Resolution No. 99-62 accepting the project as complete and authorize the recordation of the Notice of Completion. Tim D. Serlet Director of Public Works/City Engineer TDS:WA:ccg:Fiaal Acceptance USTI Reso199-62.doc Atachrnent ~ Wisam Altowaiji Field Services Manager RESOLUTION NO. 99-62 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING RECORDATION OF A NOTICE OF COMPLETION FOR THE UNDERGROUND STORAGE TANK REMOVAL AND REPLACEMENT PROJECT, (CIP 100033) WHEREAS, Miller Brooks Environmental, Inc. having a contract with the City of Tustin to construct the hereinafter described public works and improvements; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvements, hereinafter mentioned, in a manner satisfactory to the City Council of the City of Tustin; and !0 11 12 15 i6 17 18 19 20 21 WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public works and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public works and improvement is found to be complete, and the same is hereby accepted. Said public works and improvement is more particularly described as follows: Underground Storage Tank Removal and Replacement Project, (CIP 100033) AND BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin be, and is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works and improvement described herein as required by law.
