HUSTON, CITY MANAGER COMMUNITY DEVELOPMENT DEPARTMENT NEWSRACK PERMIT FEE Summary: The City's fee schedule does not include a fee for issuing a newsrackpermit. City Council approval is required to establish a newsrack permit fee. RECOMMENDATION That the City Council adopt Resolution No. 99-53 approving a newsrack permit fee. FISCAL IMPACT This is a city-initiated project. Imposition of a newsrack permit fee will provide a minor increase in General Fund revenues to offset staff costs for processing newsrack permits. BACKGROUND AND DISCUSSION The City Council had second reading of Ordinance No. 1218 on July 6, 1999. Ordinance No. 1218 amends Tustin City Code Section 7212 pertaining to the approval and enforcement of newsracks. Tustin City Code Section 7212c(4) requires that applicants pay fees provided by resolution of the City Council. The City's fee schedule does not include a fee for issuing a newsrack permit; therefore, adoption of Resolution No. 99-53 would amend the Schedule of Planning Fees and Service Charges to provide for a fee to cover the staff costs to process newsrack permits. Processing the permit will include verifying appropriate location, size and securing mechanism for the newsrack and liability insurance certifications. The California Government Code authorizes the collection of fees provided the fee amount does not exceed the cost of providing a service. Based on the staff and research time estimated to be necessary to process a newsrack permit, staff recommends a $125 fee per application. If more than three permit applications are processed concurrently by a company or individual, a deposit of $500 will be required. The $125 per permit fee is based on three (3) hours of staff time, plus administrative costs, to verify that the newsrack will comply with all established standards and inspect the newsrack after installation. The fee reflects the reasonable and equitable cost recovery for these services. Elizabeth A. Binsack Community Development Director Exhibit A- Resolution 99-53 B- Revised Schedule of Planning Fees and Service Charges RESOLUTION NO. 99-53 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING A REVISED SCHEDULE FOR PLANNING FEES AND SERVICE CHARGES WITHIN THE PLANNING DIVISION OF THE COMMUNITY DEVELOPMENT DEPARTMENT. The City Council of the City of Tustin does hereby resolve as follows: I. The City Council finds and determines as follows: Ao The Community Development Department is responsible for processing newsrack permits which result in the Department incurring certain processing, administrative and production costs. Bo California Government Code allows the City to charge applicants reasonable fees not to exceed the amount reasonably necessary to provide the service required for processing of certain development and planning and permit applications. II. The City Council hereby establishes a revised fee schedule for Community Development Department, as shown in the attached Exhibit A, incorporated herein by reference. Said fee schedule shall supercede previously established Planning Division fees adopted by City Council Resolution 94-42 and shall be applied uniformly except where, in the discretion of the City Manager, reduced fees are justified by special circumstances. Substantial additional fees may be required by the County Clerk when the City files the Notice of Determination, in (5) (6) (7) (8) accordance with AB 3158 as ~stablished by the Department of Fish and Game. If additional fees are required, the applicant will be required to provide the City with a cashiers check for the additional fees, payable to the ORANGE COUNTY CLERK within 48 hours of project approval.
