ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE
NOTICE OF COMPLETION FOR ANNUAL SIDEWALK AND CURB AND GUITER
REPAIR PROJECT, FY 1998-99 (PROJECT NO. 4020-6235)
SI3IMARY
Construction of the City's Annual Sidewalk and Curb and Gutter Repair Project for correcting tripping hazards,
drainage problems, and ADA deficiencies has been completed and the project is ready for City Council acceptance.
RECOMMENDATION
It is recommended that the City Council adopt ResOlution No. 99-57 accepting said work as complete and
authorize the recordation of the Notice of Completion, and direct the City Clerk to:
1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation of
the Notice of Completion, and
2. Release 'the Faithful Performance Bond not sooner than one year after the date of recordation of the Notice
of Completion, and
Assuming no claims or Stop Notices are filed, it is further recommended that 35 days after the date of recordation
of the Notice of Completion the City Council authorize payment of the final 10% retention in the amount of
$27.369.90 to Kovac, Inc. This amount together with the previous payments of $246,329.10 represents 100% of
the final contract amount.
FISCAL IMPACT
The final cost of construction for this project is $273,699.00, which includes one contract change order. Funding
for this project will be provided through the 1998-99 FY Public Works Department/Engineering Division
Operating Budget (account #010-400-4020-6235)and the 1998-99 FY Public Works Department/Field Services
Division Operating Budget (account #010-400-4030-6245).This project is part of the City's on-going Maintenance
of Effort requirements for compliance with Measure "M".
BACKGROUND
This project consisted of the removal and replacement of concrete sidewalk, curb and gutter and drive aprons to
co~ect tripping hazards at approximately 300 locations throughout the City. Problem areas where roots from
parkway trees repeatedly damage and lift the adjacent sidewalk, creating these tripping hazards, have been
addressed in this year's project. Sixty-four parkway trees were removed and fifty-four of the trees were replaced
with tree species that have a less invasive root system.

This project also provided a means to address improvements throughout the City to comply with the Federal
Americans with Disabilities Act (ADA). These locations were requested by citizens or were identified by City
staff to provide curb access ramps as well as completion of missing segments of sidewalk to improve
disabled/pedestrian access. ADA related improvements during this year's project included twelve curb ramps at
various locations, as well as construction of three segments of concrete sidewalk along the westerly side of Red
Hill Avenue between Warner Avenue and Industrial Drive. This area previously had limited stretches of sidewalk,
and construction of these missing segments has eliminated the need for pedestrians to traverse these zones on the
side of the road adjacent to vehicular travel lanes.
This work has been completed by Kovac, Inc. to the satisfaction of the Engineering Division.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CALIFORNIA ACCEPTING THE WORKS OF
IMPROVEMENT AND AUTHORIZING RECORDATION OF
NOTICE OF COMPLETION FOR ANNUAL SIDEWALK AND CURB
AND GUTTER REPAIR PROJECT, FY 1998-99 (PROJECT NO. 4020-
6235)
WHEREAS, Kovac, Inc., having a contract with the City of Tustin to construct the
hereinafter described public works and improvements; and
WHEREAS, the City Engineer has duly certified to the construction and completion
of said public improvements hereinafter mentioned in a manner satisfactory to the City
Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions of
the contract documents and the Notice of Completion, and acceptance of said public work
and improvement should be filed and payment of the balance due said contract authorized in
accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Tustin that said public work and improvement is found to be complete, and the same is
hereby accepted. Said public work and improvement is more particularly described as
follows:

AND BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin
be, and is hereby authorized to execute and file a Notice of Completion for the acceptance of
said public works and improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 19th day of July 1999.
