THAT THE PAC PROCEDURES FOR THE PROPOSED 1999 AMENDMENT TO THE SOUTH CENTRAL REDEVELOPMENT PLAN WERE FOLLOWED IN THE ELECTION OF THE PAC SUMMARY: The City Council is requested to make a finding that the procedures for the formation and election of the Project Area Committee for the proposed 1999 Amendment to the South Central Redevelopment Plan were followed in the election of the Project Area Committee and in determining the validity of any challenges to the election. RECOMMENDATION Approve the attached Resolution No. 99-47 finding that the procedures for the formation and election of the Project Area Committee ("PAC") for the proposed 1999 Amendment to the South Central Redevelopment Plan ("1999 Amendment") were followed in the election of the PAC and in determining the validity of any challenges to the election. FISCAL IMPACT None at this time. BACKGROUND On April 5,1999, the City Council adopted a resolution that established the procedures for the formation and election of a PAC for the proposed 1999 Amendment to the South Central Redevelopment Plan pursuant to the requirements of the California Community Redevelopment Law, Section 33000, et. seq. ("CRL"). The purpose of the Project Area Committee is to allow for maximum citizen participation in the preparation of the 1999 Amendment, as Redevelopment Agency staff will consult with, and obtain the advice of, the PAC on the proposed Amendment, housing and other issues. As the City Council will recall, the 1999 Amendment proposes to re- establish the Agency's eminent domain authority in the South Central Redevelopment Project Area for a time period not to exceed 12 years. As required by the PAC Procedures and the CRL, a public meeting was held on May 20, 1999, to explain the establishment of, functions of, and oppommity to serve on the PAC. Approximately 25 people were in attendance, and Redevelopment Agency staff and the Agency's consultant, Kathy Rosenow, provided presentations regarding the PAC. William A. Houston June 21, 1999 Page 2 On June 2, 1999, Redevelopment Agency staff and the Agency's consultant held the PAC election. Approximately 25 people were in attendance, including five of the PAC candidates. Of the nine open seats available,' eight persons were elected to the PAC in the four categories, leaving one vacant seat in the Residential Owner Occupant category. One of the attendees at the PAC election submitted an application for the vacant seat immediately following the election. Pursuant to the PAC Procedures, the seated PAC may elect to appoint this candidate after, or during, the first PAC meeting, which is expected to be held in early July 1999. The procedures for the formation and election of the PAC for the proposed 1999 Amendment were followed in accordance with the adopted PAC Procedures. No challenges to the PAC election or the electoral process were received during the challenge period, which expired on June 18, 1999. Section 33385(d)(2) of the CRL provides that the City Council shall adopt a finding that the procedures for the formation and election of the PAC for the proposed Amendment were followed in the election of the PAC and determine the validity of all challenges within 30 days following the PAC election. The next step in this process is to hold the first PAC meeting and distribute copies of the preliminfiry draft Amendment to the South Central Redevelopment Plan for the PAC's review. Christine A. Draughon Senior Project Manager \\COMM_DEVWOLI ~SHARED\CDD-RDAXRDA~IIM~OUTH CENTRAL PROJECTMune 21 PAC Election Staff Repomds 2 RESOLUTION NO. 99-47 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN FINDING THAT THE ADOPTED PROCEDURE FOR FORMATION AND ELECTION OF THE PROJECT AREA COMMITTEE FOR THE PROPOSED 1999 AMENDMENT TO THE REDEVELOPMENT PLAN FOR THE SOUTH CENTRAL REDEVELOPMENT PROJECT AREA WAS FOLLOWED IN THE ELECTION OF THE PROJECT AREA COMMITTEE WHEREAS, the City Council of the City of Tustin, adopted Resolution No. 99-27 on April 5, 1999, adopting the Procedure for Formation and Election of the Project Area Committee ("PAC") for the Proposed 1999 Amendment to the Redevelopment Plan for the South Central Area Redevelopment Project CPAC Procedures"); and WHEREAS, the PAC election was held, pursuant to the PAC Procedures, on June 2, 1999; and WHEREAS, Section 202 of said Procedure and Section 33385(d)(2) of the California Community Redevelopment Law, Health and Safety Code Section 33000, et. seq., require the Redevelopment Agency of the City of Tustin to present the results 'of the PAC election to the City Council, wherein, the Council must adopt findings that all relevant portions of the Procedure regarding the election were followed and to determine the validity of any properly filed challenges to the PAC election; and WItEREAS, no challenges were filed with respect to the PAC election. NOW, TI:i-EREFORE, THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. The City Council hereby receives the Redevelopment Agency's results of the PAC election accompanying this Resolution as "Exhibit A". SECTION 2. The City Council hereby f'mds that all relevant portions of the PAC Procedures regarding the PAC election were followed and that no challenges to the PAC election were received prior to the close of the challenge period. Passed, approved and adopted this 21 st day of June, 1999.
