AFFIRMATION OF THE PAC ELECTION RESULTS AND TRANSMITTAL
TO CITY COUNCIL OF RESOLUTION NO 99-47 FINDING THAT THE PAC
PROCEDURES FOR THE PROPOSED 1999 AMENDMENT TO THE SOUTH
CENTRAL REDEVELOPMENT PLAN WERE FOLLOWED IN THE
ELEC¥iON OF THE ?AC.
SUMMARY: Agency is requested to affirm the reSults. for the election of the Project Area
Committee for the proposed 1999 Amendment to the SOuth central RedevelOpment Plan and
transmit t° the City CounCil the finding that the procedUres for the formation and were followed
in the election of the PAC and determining the validity of any Challenges to the electiOn.
RECOMMENDATION
Affirm the election of the Project Area Committee ("PAC") and transmit Resolution No. 99-47
finding that the procedUres for the formation and election of the for the proposed 1999
Amendment to the South Central Redevelopment Plan ("1999 Amendment") were followed in
the election of the PAC and determining the validity of any challenges to the election.
FISCAL IMPACT
None at this time.
BACKGROUND
On April 5,1999, the City Council adopted a resolution that established the procedUres for the
formation and election of a PAC for the proposed 1999 Amendment to the South Central
Redevelopment Plan pUrsuant to the requirements of the California Community Redevelopment
Law, Section 33000, et. seq. ("CRL"). The 1999 Amendment proposes to re-establish the
Agency's eminent domain authority in the South Central Redevelopment Project Area for a time
period not to exceed 12 years.
PUrsuant to the PAC Procedures, Redevelopment Agency staff held a public meeting on May 20,
1999, to explain the establishment'of, functions of, and oppommity to serve on the PAC and on
June 2, 1999, Redevelopment Agency staff and the Agency's consultant held the PAC election.
As identified in Exhibit A to Resolution 99-47, of the nine open seats available, 8 persons were
elected to the PAC in the four categories, leaving one vacant seat in the Residential Owner
Occupant category. The PAC ProcedUres provide that the seated PAC may elect to appoint a
candidate for a vacant seat after, or during, the first PAC meeting. The first PAC meeting is
expected to be held in early July 1999.

The procedures for the formation and election of the PAC for the proposed 1999 Amendment
were followed in accordance with the adopted PAC Procedures. No challenges to the PAC
election or the electoral process were received during the challenge period, which expired on
June 18, 1999. Section 33385(d)(2) of the CRL provides that the City Council shall adopt a
finding that the procedures for the formation and election of the PAC for the proposed
Amendment were followed in the election of the PAC and determine the validity .of .all
challenges within 30 days following the PAC election.
The next steps in this process is to hold the first PAC meeting and for the Redevelopment
Agency to distribute copies of the preliminary draft Amendment to the South Central
Redevelopment Plan for the PAC's review.
