ADOPTION OF RESOLUTION NO. 02-98 ESTABLISHING PRIMA FACIE
SPEED LIMITS ON EDINGER AVENUE BETWEEN 1400 FEET EAST OF
RED HILL AVENUE AND JAMBOREE ROAD
SUMMARY
Adoption of Resolution 02-98 will establish a speed limit on the recently widened portion of
Edinger Avenue between 1400 feet east of Red Hill Avenue and Jamboree Road, based upon an
Engineering and Traffic Survey Report.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 02-98 establishing a speed limit of
60 MPH on Edinger Avenue between 1400 feet east of Red Hill Avenue and Jamboree Road.
FISCAL IMPACT
The recommended action will necessitate the modification of four (4) speed limit signs on Edinger
Avenue. Funding for the sign modifications is available in the FY 2002/03 Public Works
Department/Engineering Division Sign Budget (402-6625).
BACKGROUND
Pursuant to the California Vehicle Code (CVC), the City has the authority to establish prima facie
speed limits on City streets on the basis of Engineering and Traffic Surveys. CVC Section 627
requires that Engineering and Traffic Surveys be conducted in accordance with methods
determined by the California Department of Transportation and shall include, among other
requirements, consideration of the following:
.
Prevailing speeds as determined by traffic engineering measurements.
Accident records.
Highway, traffic, and roadside conditions not readily apparent to the driver.
The CVC requires justification of speed limits on City streets by Engineering and Traffic Surveys
conducted within five-year periods for police enforcement involving the use of radar or other
electronic devices, which measure the speed of moving objects.
DISCUSSION
In August 2002, the City completed the Edinger Avenue Widening Project (CIP No. 7132) between
1400 feet east of Red Hill Avenue and 2400 feet west of Jamboree Road. The project widened
this section of Edinger Avenue to Major Arterial Highway Standards (6-lane facility with bike
lanes). The project also included rehabilitation of the existing pavement, the installation of a storm
drain and inlets, curb and gutter and sidewalk and street light installation. Since the condition of

Edinger Avenue had dramatically changed, it was necessary to re-evaluate the roadway for
appropriate vehicle speeds.
The previous speed limit on Edinger Avenue within the recently reconstructed area was 55 MPH
based upon an Engineering and Traffic Survey Report adopted by the City Council on January 19,
1999. An Engineering and Traffic Survey was conducted in September 2002 to re-evaluate the
post-construction roadway conditions and to reflect the current capacity improvements on Edinger
Avenue. Based upon the results of the September 2002 Survey, it is recommended that the
speed limit on Edinger Avenue between 1400 feet east of Red Hill Avenue and Jamboree Road
be increased from 55 MPH to 60 MPH.
Adoption of Resolution No. 02-98 establishing a speed limit of 60 MPH on Edinger Avenue will
allow for continued enforcement of the posted speed limit by the Tustin Police Department with
the use of radar.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ESTABLISHING A PRIMA FACIE SPEED LIMIT ON EDINGER
AVENUE BETWEEN 1400 FEET EAST OF RED HILL AVENUE AND
JAMBOREE ROAD
WHEREAS, California Vehicle Code Section 22352 established certain default
prima facie speed limits for certain types of streets and highways; and
WHEREAS, California Vehicle Code Sections 22357 and 22358 provide that
local entities may make a determination, upon the basis of an engineering and traffic
survey, that a different speed limit would facilitate the orderly movement of vehicular
traffic and would be reasonable, and safe; and
WHEREAS, California Vehicle Code Section 627(b) defines engineering and
traffic surveys to include a consideration of all of the following:
1. Prevailing speeds as determined by traffic engineering measurements;
2. Accident Records;
3. Highway, traffic and roadside conditions not readily apparent to the driver;
and
WHEREAS, the California Department of Transportation has established
methods of conducting engineering and traffic surveys as required by the California
Vehicle Code; and
WHEREAS, the City of Tustin has completed an engineering and traffic survey in
accordance with the requirements of Vehicle Code Section 627 and pursuant to
Vehicle Code Section 22357 and 22358;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin
as follows;
Section 1' Based upon the above referenced engineering and traffic survey
the following speed limit is established.

Section 2: The speed limits established in Section 1 shall be effective when
appropriate signs giving notice thereof are erected upon the street.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 21st day of October 2002.
