ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO
FILE THE NOTICE OF COMPLETION FOR THE WALNUT AVENUE
REHABILITATION FROM BROWNING AVENUE TO MYFORD ROAD
(CIP NO. 7125)
SUMMARY
Construction of the Walnut Avenue Rehabilitation from Browning Avenue to Myford Road (CIP No.
7125) has been completed to the satisfaction of the City Engineer and is now ready for City
Council acceptance.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 02-86 accepting the construction of
the Walnut Avenue Rehabilitation from Browning Avenue to Myford Road (CIP No. 7125), and
authorizing the recordation of the Notice of Completion, and direct the City Clerk to:
1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the
date of recordation of the Notice of Completion; and
2. Release the Faithful Performance Bond not sooner than one-year after the date of
recordation of the Notice of Completion; and
Assuming no claims or stop payment notices are filed, it is further recommended that thirty-five
(35) days after the date of recordation of the Notice of Completion the City Council authorize
payment of the final 10% retention in the amount of $56,305.95 to R. J. Noble Company.
FISCAL IMPACT
The final construction contract cost for the Walnut Avenue Rehabilitation from Browning Avenue to
Myford Road is $563,059.53 and is funded by the City's Capital Improvement Program and
Orange County Transportation Authority's (OCTA) Combined Transportation Funding Program
(CTFP) under the Arterial Highway Rehabilitation Program (AHRP). For this project, the AHRP will
provide up to a maximum of $325,280.00 for eligible construction items through the Federal Local
Surface Transportation Program (LSTP), which is administered by the State of California
Department of Transportation (Caltrans). This project assists the City in meeting its ongoing
Maintenance of Effort (MOE) requirements established by Measure M.

BACKGROUND AND DISCUSSION
The construction of the Walnut Avenue Rehabilitation from Browning Avenue to Myford Road
Project was substantially complete on July 10, 2002. However, due to concerns with surface ride
quality, the contractor was requested to further evaluate the asphalt concrete surface material and
placement procedures for applicable industry standards. In response to the City's request, the
contractor completed a thorough investigation, which included meetings with representatives from
the materials company who flew to California from Texas to evaluate this matter. After review of
the surface conditions, the asphalt concrete mix design, and the machinery and procedures used
to place the asphalt concrete, it was concluded by the representative that the material and the
application were per industry standards. The contractor then proceeded with re-rolling the entire
project with a pneumatic-tire-roller on a high temperature day, which appears to have produced a
smoother, more even ride for vehicle traffic.
In addition, City staff requested a review by the County of Orange Materials Laboratory
representatives of the road conditions. The County of Orange representatives reviewed the road
conditions and made a visual inspection of the contractor's work. They concluded that the
pavement overlay application was within industry standards. The City also retained the services of
a third party pavement specialist to evaluate the reconstructed pavement surface. Based upon this
analysis it was determined that the pavement surface was within industry standards. The
pavement specialist also indicated that the surface would even out and provide a smoother ride as
more vehicles use this roadway in the future.
All of the construction work for this project has been completed to the satisfaction of the City
Engineer, and is now ready for City Council acceptance.

RESOLUTION NO. 02-86
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR
THE CONSTRUCTION OF THE WALNUT AVENUE REHABILITATION FROM
BROWNING AVENUE TO MYFORD ROAD (CIP NO. 7125)
WHEREAS, R. J. Noble Company, having a contract with the City of Tustin to
construct the hereinafter described public works and improvement; and
WHEREAS, the City Engineer has duly certified to the construction and
completion of said public improvement hereinafter mentioned in a manner satisfactory
to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions
of the contract documents and the Notice of Completion, and acceptance of said public
works and improvement should be filed and payment of the balance due said contract
authorized in accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin
that said public works and improvement is found to be complete, and the same is
hereby accepted. Said public works and improvement is more particularly described as
follows'

BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is
hereby authorized to execute and file the Notice of Completion for the acceptance of
said public works and improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 21st day of October 2002.
