HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE NOTICE OF SUBdEGT: COMPLETION FOR THE SYCAMORE AVENUE STORM DRAIN AND BLOCK WALL IMPROVEMENTS BETWEEN NEWPORT AVENUE AND THE SR-S5 FREEWAY (PROJECT NO. 700149) SUMMARY I ConstruCtiOn of the sUbject project has been completed and the project is ready for City Council acceptance subject to ConcUrrenCe from the Tustin commUnity Redevelopment Agency. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 99-40 accepting said work as complete and authorize the recordation of the Notice of Completion, subject to concurrence from the Tustin Communib' Redevelopment Agency, and direct the City Clerk to: 1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion, and 2. Release the Faithful Performance Bond not sooner than one year after the date of recordation of the Notice of Completion, and Assuming no claims or stop notices are filed, it is further recommended that 35 days after the date of recordation of the Notice of Completion the City Council authorize payment of the final retention in the amount of $22,307.01 to Brongo Construction. This amount together with the previous payments of $589,824.45 represents 100% of the final contract amount. -- This project is scheduled before the Tustin Community Redevelopment Agency, at their meeting of June 7, 1999. to authorize the City Council to accept the work as complete and authorize the recordation of the Notice of Completion. FISCAL IMPACT The final cost of construction for this project is $612,131.46, which includes four Contract Change Orders. The storm drain and block wall construction is funded from the 1998-99 Capital Improvement Budget with the Tustin Community Redevelopment Agency-South Central Account No. 560-400-9999-9530-700149 and the water related construction is funded from the unallocated Water Capital Improvement Fund Account No. 680-401-9999- 9610-700149. In addition, portions of the construction were funded from the 1998-99 FY Public Wor'ks Department/EngineeringDivision Operating Budget as follows: Account No. 490-400-8015-9530 for new street light related construction, and Account No. 010-400-4020-6235 for new sidewalk related construction. Acceptance of Public Improvements and Authorization to File Notice of Completion for the sycamore Avenue Storm Drain and Block Wall Improvements between Newport Avenue and the SR-55 Freeway (Project No. 700149) June 1, 1999 Page 2 BACKGROUND The original construction contract provided for the construction of a masonry block wall along the City's southerly fight-of-way line of Sycamore Avenue from Newport Avenue to Pasadena Avenue and along Caltrans' southerly fight-of-way line of the northbound SR-55 Freeway off-ramp, from the SR-55 Freeway to Pasadena Avenue. In addition, the earthen "V" ditches along both sides of Sycamore Avenue between Pasadena Avenue and Newport Avenue were replaced with an underground storm drain system. On July 7, 1998, the Tustin Community Redevelopment Agency (RDA) authorized the City Council and staff to administrate a Contract Change Order with Brongo Construction for the construction of a block wall and relocation of the 8" water main along the northerly side of Sycamore Avenue between Newport Avenue and Pasadena Avenue. The RDA also authorized the installation of landscape and irrigation improvements, within the same area, in conjunction with the East Tustin Landscape Replacement Project. Construction of the storm drain, block wall, water main relocation, sidewalk, street light installation, and related work has been completed by Brongo Construction to the satisfaction of the Engineering Division. The landscape and irrigation improvements are being installed by the City's Contractor for the East Tustin Landscape Replacement Project as a Contract Change Order to that project and acceptance of these improvements will be scheduled for a future City Council meeting. Serlet Director of Public Works/City Engineer TDS:JO:ccg:NOC Syc Storm Drain & Block Wall & Reso 99-40.doc Attachments rv"6ttes&- Associate Civil Engineer Z u ~ .i© 2 3 5 6 8 9 10 11 12. ~3 15 ~6 17 18 19 '2_I 2.3 RESOLUTION NO. 99-40 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA ACCEPTING THE WORKS OF IMPROVEMENT AND AUTHORIZING THE RECORDATION OF THE NOTICE OF COMPLETION FOR THE SYCAMORE AVENUE STORM DRAIN AND BLOCK WALL CONSTRUCTION BETWEEN NEWPORT AVENUE AND THE SR-55 FREEWAY (PROJECT NO. 700149) WHEREAS, Brongo Construction, having a contract with the CitY of Tustin to construct the hereinafter described public works and improvements; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvements hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public work and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public work and improvement is found to be complete, and the same is hereby accepted. Said public work and improvement is more particularly described as follows; Sycamore Avenue Storm Drain and Block Wall Construction between Newport Avenue and the SR-55 Freeway (Project No. 700149) AND BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin be, and is hereby authorized to execute and file a Notice of Completion for the acceptance-of said public works and improvement described herein as required by law.
