RECOMMENDATION:
That the City Council approve the joint use agreement with the Tustin Unified School District
for improvements to the Tustin High School basketball courts.
FISCAL IMPACT:
According to terms of the agreement, the City would reimburse the School District in an amount
not to exceed $15,000 for the cost of rehabilitation and reconstruction of the basketball courts at
Tustin High School The Redevelopment Agency-South Central Project Area will be providing
the allocation for the project. A resolution of benefit will be forthcoming.
BACKGROUND:
There are twelve basketball courts located at Tustin High School that are in need of total
rehabilitation. The City and the School District are desirous of improving the condition of the
courts for use by the school and the general public. The City is willing to pay for the cost of
repairs in an amount not to exceed $15,000. In return the District would allow the City to use
the basketball courts at no charge for organized recreation programs. The total cost of the
project is estimated to be $85,000.
Proposed improvements include court resurfacing, striping and the installation of new
backboards. The School District would manage the project and provide the City with an
invoice for reimbursement upon completion of the project. Any improvements would become
the property of the District. The District would be responsible for all required maintenance
costs.
The agreement has been approved as to form by the City Attorney. The District Mll submit
the agreement to the School Board for approval at the next meeting scheduled for June 14,
1999. Upon approval the District would begin renovation with completion of the project
scheduled by September 1, 1999.

JOINT USE AGREEMENT FOR IMPROVEMENTS TO
TUSTIN HIGH SCHOOL BASKETBALL COURTS
This Agreement, made and entered into this. day of ,1999, by and between
the TUSTIN UNIFIED SCHOOL DISTRICT, a California school district, hereinafter referred to as
"DISTRICT' and the CITY OF TUSTIN, a municipal corporation, hereinafter referred to as "CITY."
WHEREAS, there are presently located on the Tustin High School. property of.the TUsTIN
~D SCHOOL DISTRICT twelve (12) basketball courts which are in need of complete
rehabilitation_ ..
WHEREAS, DISTRICT AND CITY are desirou.5 of causing these basketball courts to be
resurfaced, striped, have new backboards installed, and made available for the use by the general public
during times when they are not needed for the use of students of DISTRICT, and.
WHEREAS, CrlW is willing to pay for the cost of the repair of the backboards and r~suffacing
and re-striping of twelve (12) basketball courts, and
WHEREAS, the DISTRICT will supply the CITY with an invoice describing the scope of
work and specifications of the project, and
~2-12EREAS, the CITY will reimburse the DISTRICT upon receipt of that invoice 'not to
exceed $15,000 (Fifteen Thousand Dollars),
NOW, THEREFORE, in consideration of the mutual promises hereinafter set forth, the parties
hereto agree as follows:
AGREEMENT
1. The DISTRICT shall commence steps to cause the resuffacing, striping, and
replacement of backboards. Once undertaken, DISTRICT shall cause the construction and installation
to proce~ and be completed by September 1, 1999. -
2. From and after the date of this Agreement, DISTRICT agrees that the basketball court
facn]kies will be available at no charge to CITY for the conduct of its organized recreation programs
immediately following scheduled school activities. '
3. DISTRICT further agrees that all the basketball courts not othenv/~e being used by
CITY or DISTRICT in the conduct oftheir organized recreation programs shall be avmqable for use by
the general public. Access w;fll be monitored closely by both DISTRICT and CITY to ensure proper
utilization of the corers. Faikue by the general public to utilize the courts properly may result in
muttmlly agreeing upon closing access to the courts to the general public.
4. Upon construction completion and acceptance, CITY agrees that DIS.TI_~,I_ CT shall
retain_sole ownersh~ of the improvements,
5. All required maintenance of the basketball courts, and backboards shall be at the sole
cost and expense of DISTRICT.

6. This Agreement is a continuing agreement, and it may be amended in writing by mumaI
consent of both parties.
7. Either party may terminate this Agreement for any reason after giving the other party a
six (6) month written notice of intent to terminate. The DISTRICT agrees to reimburse'the CITY a
prorate_ s_hare of the total improvement costs if this agreement is terminated by the DISTRICT during
the "u~efi~ life" of the improvements. Any notice to be given hereunder shall be addressed as
hereinafter set forth and shall be personally delivered or mailed, postage prepaid, to the. other at the
addresses hereinafter set forth:
