HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/FIELD SERVICES CONTRACT RENEWAL FOR LANDSCAPE MAINTENANCE SERVICES WITH PLANT CONTROL LANDSCAPE MAINTENANCE, INC. RECOMMENDATION: It is recommended that the City Council approve the third and final amendment to the contract agreement between Plant Control .Landscape Maintenance, Inc. and the City of Tustin for landscape maintenance services, subject to City Attorney approval. FISCAL IMPACT: The 1% adjustment will increase the monthly contract price by $113.79 and increase the annual 12-month contract total amount to $137,914.80. The increase in the monthly service fee was anticipated and will be incorporated into the 1999/2000 Fiscal Year Budget. DISCUSSION: 'The City has contracted with Plant Control Landscape Maintenance, Inc. since August 1, 1996 for maintenance of all General Fund areas including all center islands and specific City and Water Operations facilities. The original agreement was for a 1-year period with three 1-year extensions available to the City. This contract amendment would extend the agreement for the third and final 1-year extension, from July 1, 1999 through June 30, 2000, and would grant the contractor a 1% increase in the monthly base price of the contract, effective July 1, 1999. Plant Control Landscape Maintenance, Inc. requested a 2% increase in the contract amount. However, staff negotiated a 1% increase, which is lower than the increase in the Consumer Price Index for the counties of Los Angeles, Orange, and Riverside during the same time period. The overall increase in the contract price is $113.79 per month or $1,365.48 over a 12-month period. Plant Control Landscape Maintenance, Inc. has provided consistent service of a reasonably high quality for the past 3-years and has been very responsive in the correction of any service that was not up to City standards. The implementation of this increase will allow the Contractor to continue to provide the quality and responsiveness the City has received previously. Tim D. Serlet Director of Public Works/City Engineer Wisam Altowaiji Field Services Manager WA/TDS/ccr Attachment TmRD AMENDMENT TO CONTRACT AGREEMENT THIS THIRD AMENDMENT is entered into this day of ,1999, by and between the City of Tustin, a Municipal Corporation (herein referred to as "City"), and Plant Control Landscape Maintenance, Inc., a California corporation, (herein referred to as "Contractor"). This Amendmentis made with reference to the following: RECITALS A. WHEREAS, City and Contractor entered into an Agreement dated November 11, 1996, the "Agreement", wherein Contractor agreed to perform landscape maintenance services in accordance with the agreement and specifications entitled "Landscape Maintenance Services for General Fund Areas, Senior Center and Maintenance Facility"; B. WHEREA.S, City and Contractor entered into the First Amendment to that Agreement on November 20, 1997, and entered into the Second Amendment to that Agreement on September 8, 1998; C. WHEREAS, the initial term of the Agreement was one year, with the option to be extended for three additional one-year terms by written agreement of the parties; D. WHEREAS, City and Contractor desire to exercise the extension clause pursuant to Section B, Page B-2, Paragraph 4, Item B, to extend the Agreement for one year; E. WHEREAS, City and Contractor also desire to adjust Contractor's compensation under the Agreement to reflect a negotiated 1% increase, which is less than the consumer price index for the counties of Los Angeles, Orange and Riverside. AGREEMENT The Agreement is hereby amended as follows: A. The term'of the Agreement is extended for one year, through June 30, 2000, unless sooner terminated pursuant to Section B, Page B-32, Item 48 of the Agreement. B. City shall pay the Contractor the following sums for the periods indicated: 1. From July 1, 1999 to June 30, 2000, the City shall pay the Contractor, on a monthly basis, an amount equal to $11,492.90. 2. City shall pay the Contractor a sum not to exceed $137,914.80, for the period from July 1, 1999 to June 30, 2000. C.
