RECOMMENDATION:
It is recommended that the City Council approve the third and final amendment to the contract agreement between
Accurate Landscape & Maintenance, Inc. and the City of Tustin for landscape maintenance services, subject to
City Attorney approval.
FISCAL IMPACT:
The 1% adjustment will increase the monthly contract price by $122.07 and increase the annual 12-month
contract total amount to $147,946.92. The increase in the monthly service fee was anticipated and will be
incorporated into the 1999/2000 Fiscal Year Budget.
DISCUSSION:
The City has contracted with Accurate Landscape & Maintenance, Inc. since July 15, 1996 for maintenance of
East Tustin Assessment District parkway landscaping. The original agreement Was for a 1-year period with three
1-year extensions available to the City. This contract amendment would extend the agreement for the third and
final 1-year extension, from July 1, 1999 through June 30, 2000, and would grant the contractor a 1% increase in
the monthly base price of the contract, effective July 1, 1999.
Accurate Landscape & Maintenance, Inc. requested a 1.5% increase in the contract amount. However, staff
negotiated a 1% increase. This increase is lower than the increases in the Consumer Price Index for the counties
of Los Angeles, Orange, and Riverside during the same time period. The overall increase in the contract price is
$122.07 per month or $1,464.84 over a 12-month period.
Accurate Landscape & Maintenance, Inc. has provided consistent service of a reasonably high quality for the past
3-years and has been very responsive in the correction of any service that was not up to City standards. The
implementation of this increase will allow the ContractOr to continue to provide the quality and responsiveness
the City has received previously.

THIRD AMENDMENT TO
CONTRACT AGREEMENT
THIS THIRD AMENDMENT is entered into this day of ,1999, by and
benveen the City of Tustin, a Municipal Corporation (herein referred to as "City"), and Accurate Landscape &
Maintenance, Inc., a California corporation, (herein referred to as "Contractor").
This Amendment is made with reference to the following:
RECITALS
A. WHEREAS, City and Contractor entered into an Agreement dated July 15, 1996, the
"Agreement", wherein Contractor agreed to perform landscape maintenance services in accordance with
the agreement and specifications entitled "Landscape Maintenance Services for the Assessment District
Areas";
B. WHEREAS, City and Contractor entered into the First Amendment to that Agreement on March
16, 1997, and entered into the Second Amendment to that Agreement on August 4, 1998;
C. WHEREAS, the initial term of the Agreement was one year, with the option to be extended for
three additional one-year terms by written agreement of the Parties;
D. WHEREAS, City and Contractor desire to exercise the extension clause pursuant to Section B,
Page B-2, Paragraph 4, Item B, to extend the Agreement for one year;
E. WHEREAS, City and Contractor also desire to adjust Contractor's compensation under the
Agreement to reflect a negotiated 1% increase, which is less than the consumer price index for the
counties of Los Angeles, Orange and Riverside.
AGREEMENT
The Agreement is hereby amended as follows:
A. The term of the Agreement is extended for one year, through June 30, 2000, unless
sooner terminated pursuant to Section B, Page B-32, Item 48 of the Agreement.
B. City shall pay the Contractor the following sums for the periods indicated:
1. From'July 1, 1999 to June 30, 2000, the City shall pay the Contractor, on a
monthly basis, an amount equal to $12,328.91.
2. City shall pay the Contractor a sum not to exceed $147,946.92, for the period
from July 1, 1999 to June 30, 2000.
C. Except as expressly amended by ti'tis Third Amendment, all. other terms and conditions
of the Agreement and all attachments and exhibits thereto, shall remain in full force and effect.
