Huffer, Associate Planner Adrianne DiLeva -Johnson, Management Assistant None PUBLIC CONCERNS Approved CONSENT CALENDAR: 1 APPROVAL OF MINUTES — MAY 28, 2013, PLANNING COMMISSION MEETING. RECOMMENDATION: That the Planning Commission approve the minutes of the May 28, 2013, meeting as provided. Motion: It was moved by Altowaiji, seconded by Smith, to move the Consent Calendar. Motion carried 4-0-1. PUBLIC HEARINGS: Adopted Resolution 2. TENTATIVE PARCEL MAP 2012-137 AND No. 4226 CONDITIONAL USE PERMIT 2012-14; A REQUEST VON, TO SUBDIVIDE AN EXISTING OFFICE COMPLEX AND ESTABLISH JOINT USE PARKING. Minutes - Planning Commission June 25, 2013 — Page 1 of 4 Tentative Parcel Map 2012-137 and Conditional Use Permit 2012-14 is a request to subdivide, for conveyance purposes, an existing 6.17-acre office complex into three (3) numbered lots and establish joint use parking on the project site. The resulting map will create one parcel for each building that also includes the parking and landscape areas around each building. This will allow for each of the buildings and associated parking area to be separately owned. Proposed Condition 4.1 of Resolution No. 4226 requires the applicant to submit a copy of the proposed Covenants, Conditions, and Restrictions (CC&Rs) for review and approval by the City and City Attorney's office to ensure that maintenance responsibilities are specified. The CC&Rs will regulate, among other items, shared/reciprocal parking and access, shared maintenance and assessment, exterior improvements, etc. APPLICANT: Masoud Mike Moshayedi Centurion Plaza, LLC 1 Rim Ridge Newport Coast, CA 92657 PROPERTY OWNER: Centurion Plaza, LLC Attn: Masoud Mike Moshayedi 1 Rim Ridge Newport Coast, CA 92657 PROJECT LOCATION: 15621, 15641, and 15661 Red Hill Avenue ENVIRONMENTAL: The project is categorically exempt pursuant to the California Environmental Quality Act (CEQA) Section 15315, Class 15 and Section 15301, Class 1. That the Planning Commission adopt Resolution No. 4226 recommending that the City Council approve Tentative Parcel Map 2012-137 and Conditional Use Permit 2012-14, a request to subdivide properties located at 15621, 15641, and 15661 Red Hill Avenue for conveyance purposes and establish joint use parking for the subject properties. FORM 0 Commission questions generally included: the location of the drive apron; clarification on the terminology used on the map indicating "lot" and "parcel "; the number indicated for the traffic index; and, ADA compliance and landscaping along Bell Avenue. The public hearing opened at 7:11 p.m. Charlie C. Liu stepped forward representing the applicant. Mr. Liu stated he is the Public Engineer who has been working with the applicant on the project. He responded to the Commission's inquiry regarding the traffic index, and stated he will check the number provided and respond accordingly. Mr. Liu indicated that he understands and agrees with the Conditions of Approval. The public hearing closed at 7:13 p.m. Smith and Altowaiji Had no additional comments to discuss at this time. Lumbard Stated the use is consistent with surrounding area, and has no concerns regarding the project. Kozak Thanked the Mr. Liu for attending the meeting. Stated the project is consistent with the General Plan and Zoning. With incorporating the Commission's comments he would like to call for a motion to approve the item. Motion: It was moved by Smith, seconded by Altowaiji, to adopt Resolution No. 4226. Motion carried 4 -0-1. None REGULAR BUSINESS STAFF CONCERNS: The Director reported as follows: • Announced that the City Council will be holding a public Workshop on Saturday, June 29th, reviewing the MCAS Tustin Specific Plan and Disposition Strategy, as well as the Strategic Plan Update. Smith • Had no concerns to report.
