FINAL TRACT MAP 15707 (WARMINGTON OLD TOWN ASSOCIATES)
RECOMMENDATION
That the City Council adopt Resolution No. 99-30 approving Final Tract Map 15707.
FISCAL IMPACT
In accordance with Section 9.C of the Residential Project Disposition and Development
Agreement (DDA) by .and between The Tustin Community Redevelopment Agency and
Warmington Old Town Associates approved by the Redevelopment Agency on
September 21, 1998, all applicable fees have been waived.
DISCUSSION
On November 23, 1998, the Planning Commission adopted Resolution No. 3638
recommending that the City Council approve Tentative Tract Map 15707. The City
Council approved Tentative Tract Map 15707 on December 7, 1998 by adopting
Resolution No. 98-108. These approvals included numerous conditions to be met prior to
approval of the Final Map, and they have been satisfied. Tentative Tract Map 15707
contains approximately 3.5 acres of land including thirty-eight (38) numbered parcels and
ten (10) lettered parcels to accommodate a thirty-eight unit single family dwelling project.

Tract 15707 is located on a 4.1 acre site at the southeast corner of El Camino Real and
Sixth Street within the Old Town and Town Center Redevelopment Project Area. The site
is divided into two parts. Part 1 was developed with a fifty six (56) apartment complex,
which has been demolished for construction of Tract 15707. Part 2 includes existing
commercial buildings that would be substantially renovated.
The Final Map is in substantial conformance with the Tentative Parcel Map approvals, the
City's Zoning Code and Subdivision Code, and the State Subdivision Map Act. Based
upon this conformance, staff recommends that the City Council approve Final Tract MaP
15707.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, APPROVING FINAL TRACT MAP' 15707 LOCATED AT.
THE SOUTHEAST CORNER OF EL CAMINO AND SIXTH STREET
(715-765 EL CAMINO REAL & 120-250 SIXTH STREET), TO
SUBDIVIDE PARCEL 1 OF FINAL PARCEL MAP 98-161 INTO
THIRTY EIGHT (38) NUMBERED LOTS AND TEN (10) LETTERED
LOTS TO ACCOMMODATE DEVELOPMENT OF THIRTY EIGHT (38)
SINGLE FAMILY RESIDENTIAL DETACHED UNITS..
The City Council of the City of Tustin does hereby resolve as follows:
The City Council finds and determines as follows:
A.
That Final Tract Map 15707 has been submitted by Warmington Old
Town Associates ("the Subdivider") to subdivide Parcel 1 of Final
Parcel Map 98-161 into thirty eight (38) numbered lots and ten (10)
lettered lots to accommodate development of thirty eight (38) single
family residential detached units;
B,
That a public hearing was held by the Planning Commission on
November 23, 1998. At this hearing, the Planning Commission
recommended that the City Council approve Tentative Tract Map
15707. Subsequently, the City Council approved Tentative Tract Map
15707 on December 7, 1998;
C,
Pursuant to Section 15268(b) (Ministerial Projects) of the California
Environmental Quality Act (CEQA), the Final Map is considered
statutorily exempt from the requirements of CEQA.

That the proposed subdivision is in substantial conformance with the
Tustin General Plan, the Tustin Zoning Code and Subdivision Map Act;

That the proposed project has been reviewed for conformity with the
provisions of the Orange County Congestion Management Program,
and it has been determined that the additional traffic generated by the
proposed project onto the CMP Highway. System does not cause the
system to exceed established level of service standards '(ELS);
F,
That the City has reviewed the status of the school facilities and the
Tustin. Unified School District for the impact of Tentative Tract Map
15707. No impacts associated with this approval on School District
facilities have been determined;
G,
That the site is physically suitable for the type'of development
proposed;
H,
That the site is physically' suitable for the proposed density of
development;.
J.
That the design of the subdivision or the proposed improvements are
not likely to cause substantial environmental damage or substantially
and avoidably injure fish or wildlife in their habitat;
That the 'design of the subdivision or the type of imprOvements
proposed will not conflict with easements acquired by the public-at-

large, for access through or use of the property within the proposed
subdivision;
K,
That the design of the subdivision or the types of improvements
proposed are not likely to cause serious public health problems;
L,
That the Final Map is in substantial conformance with the Tentative
Tract Map; and,
M,
That the project has been reviewed for consistency with the Air Quality
Sub-Element of the City of Tustin General Plan and has been
determined to be consistent or has been conditioned to be consistent
with the Air Quality Sub-Element.
II.
The City Council hereby approves Final Tract Map 15707, to subdivide Parcel
1 of Final Parcel Map 98-161 into thirty eight (38) numbered lots and ten (10)
lettered lots to accommodate development of thirty eight (38) single family
residential detached units.
PASSED AND ADOPTED at a regular meeting of the Tustin City Council, held on the
19th day of April, 1999. .
