REQUEST FOR LEAVE OF ABSENCE - ARTHUR LARRY DAVIS and ROMAN
LOPEZ
SUMMARY: Upon the recommendation of the City Manager, that the City Council
authorize a leave of absence for Arthur Larry Davis and Roman Lopez exceeding
30 days.
RECOMMENDATION:
That the City Council 'authorize a leave of absence be granted to Maintenance
Leadworker, A. Larry Davis, until December 1, 1999 and Custodian, Roman
Lopez, until September 1, 1999 for medical reasons due to non-industrial
disability until each is fully released by his doctor to return to work. If there is an
opening available in the position of Maintenance Leadworker for Mr. Davis when
he is able to return to work, he may be appointed to fill the opening. If no opening
exists when Mr. Davis is released to return to work by his doctor, he will be
placed on a re-employment list for one year and be eligible for reinstatement
when an opening occurs. Currently, Mr. Lopez's position is being filled on a
temporary basis.
FISCAL IMPACT:
Since Mr. Davis and Mr. Lopez have each exhausted 90 days of medical leave and
are not eligible for benefits at this time, there is no direct cost.
BACKGROUND:
On November 9, 1998, Mr. Davis was placed on a medical leave of absence and
was expected to return to work on February 7, 1999. Mr. Davis' non-industrial
disability has now been extended to December 1 , 1999 with no guarantee of
release at that time. The recommendation regarding Mr. Davis is consistent with
City policy. Because there is no clear indication that he will be able to return to
work for an extended period, it is necessary to fill his vacancy. The Public Works
Department is not staffed to absorb the extended loss of a Maintenance
Leadworker position. Mr. Lopez's position is currently filled by a temporary
appointment, therefore he will return to his position assuming he is able to return
in September, 1999.
