SUMMARY
Supplement Agreement No. 001-M is a Project-Specific Program Supplement to the Administering Agency-State
Agreement No. 12-5271 for reimbursement of Federal funds covering preliminary engineering on the Red Hill
Avenue Rehabilitation Project.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 99-15 approving Supplement Agreement No. 001-
M to Administering Agency-State Agreement No. 12-5271 and authorize the Mayor and City Clerk to execute said
agreement on behalfo£the City of Tustin.
FISC.M~ IMPACT
The FY 1998-99 Capital Improvement Program budget allocated $60,000 for design of the Red Hill Avenue
Rehabilitation Project. With the approval of Supplement Agreement No. 001-M the City will be eligible for
Federal reimbursement of 50% of the preliminary engineering cost up to a maximum of $30,000.
BACKGROUND
Program supplements to the Master Agreement formalize the financial responsibilities and provisions for each
specific Federal-aid funded project.
Under a previous agenda item scheduled for this meeting, the City Council considered approval of the updated
Administering Agency-State Master Agreement No. 12-5271. Approval of that A~eement is a necessary step for
reimbursement of various Federal aid programs. City Council approval of Supplement Agreement No. 001-M is
required for the reimbursement of Federal funds for preliminary engineering on the Red Hill Avenue
RehabilitationProject (C.I.P. 7.00124).
The Cib' Attomey has reviewed and approved as to form the attached Program Supplement Agreement No. 001-M
and staff recommends that the City Council adopt Resolution No. 99-15 approving the Supplement Agreement and
authorize the Mayor and City Clerk to execute the Agreement on behalf of the Cib' of Tustin.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORxNIA APPROVING PROGRAM SUPPLEMENT AGREEMENT NO.
001-M TO UPDATED .-ti)MINISTERING AGENCY-STATE MASTER
AGREEMENT NO. 12-5271 FOR THE RED HILL AVENUE
REHABILITATION PROJECT (C.I.P. NO. 700124)
WHEREAS, the City of Tustin previously approved the updated Master Agreement
No. 12-5271 with the State of California. acting by and through the California Department
of Transportation (Caltrans); and
WHEREAS, Program Supplements to the Master Agreement formalize the financial
responsibilities and provisions for each specific Federal-aid Funded Project; and
WHEREAS, approval of Program Supplement Agreement No. 001-M is required for
the reimbursement of Federal funds for preliminary engineering on the Red Hill Avenue
Rehabilitation Project (C.I.P. No. 700124).
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin
that Program Supplement A~eement No. 001-M to the updated Administering Agency-
State Master Agreement No. 12-5271 is hereby approved;
AND BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby
authorized to execute Program Supplement Agreement No. 001-M.

Tustin held on the 16~ day of February 1999.

This Program Supplement is hereby incorporated into the Agency-State Agreement for Federal Aid which was entered into
between the Agency and the State on / / and is subject to all the terms and conditions thereof. This Program
Supplement is adopted in accordance with Article I of the aforementioned Master Agreement under authority of Resolution No.
, approved by the Agency on (See copy attached).
The Agency further stipulates that as a condition to payment of funds obligated to this project, it accepts and will comply with
the covenants or remarks setforth on the following pages.

SPECIAL COVENANTS OR RF~L%RKS
1. The Local Agency will reimburse the State for their share of
costs for work requested to be performed by the State.
2. The Local Agency agrees the payment of Federal funds will be
limited to the amounts approved by the Federal Highway
Administration in the Federal-Aid Project Agreement (PR-2)/Detail
Estimate, or its modification (PR-2A) or the FN~-76, and accepts
any increases in Local Agency Funds as shown on the Finance or
Bid Letter or its modification as prepared by the Office of Local
Programs Project Implementation.
3. This Program Supplement will be revised at a later date to
include other phases of work.
4. The Local Agency will advertise, award and administer this
project in accordance with the current Local Assistance
Procedures Manual.
5. Ail maintenance, involving the physical condition and the
operation, of the improvements, referred to in Article III
MAINTENANCE of the aforementioned Master Agreement will be the
responsibility of the Local Agency and shall be performed at
regular intervals or as required for efficient operation of the
completed improvements.
