HomeMy WebLinkAboutCC RES 94-111 1 RESOLUTION NO. 94-111 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, APPROVING SIGN CODE EXCEPTION 94-003 3 PERMITTING AN EXCEPTION FROM TUSTIN CITY CODE SECTION 9403HD REQUIRING SUPPLEMENTAL SIGNAGE TO BE 4 SUBORDINATE TO BUSINESS IDENTIFICATION, AND TO ALLOW SUPPLEMENTAL SIGNAGE TO EXCEED 25 PERCENT OF 5 THE ALLOWABLE SIGN AREA FOR A COPY CHANGE TO THE EXISTING NON-CONFORMING ROOF SIGN LOCATED AT 1542 ~. 6 EL CAMINO REAL. 7 I. The City Council finds and determines as follows: 8 A. That a proper application for Sign Code Exception 94-003 was filed by William Taylor requesting a 9 sign code exception from Section 9403hd of the Tustin City Code for a copy change to the existing 10 non-conforming roof sign_on the building located at 1542 E1 camln6"'~e~. 1t B. On August 8, 1994, the Planning Commission 12 authorized Resolution No. 3294, denying the requested Sign Code Exception. 13 C. The applicant appealed the Planning Commission's 14 action and the request was discussed on September 6, 1994, by the City Council. 15 D. Pursuant to City of Tustin Sign Code Section 9405c, 16 the request to authorize an exception to the Sign Code to allow a sign to display only supplemental 17 signage, thus exceeding the 25% of the allowable sign area can be supported by the following 18 findings: 19 1. Siqn size and placement of the Siqn Code shall be as closely followed as practicable. The 20 subject sign can is existing non-conforming and no changes tothe location or size of the 21 sign are requested. 22 2. The intent and purpose of the siqn requlations of the land use zone in which the siqn is 23 located are followed as closely as possible. The intent of the sign regulations of 24 commercial zones is to provide effective business identification and to maintain the 25 visibility and effectiveness of on-premise signs. The freeway expansion project has 26 impacted the subject site in that the increased soundwall height has obscured 27 visibility of the existing signs on the site. The applicant has increased the visibility of 28 the sign by utilizing capital letters with an Resolution 94-111 Page 2 1 illuminated background of bright red. The 2 copy, which reads "BURGERS," is a more easily identified with a restaurant than is the 3 business name, Taylor's, therefore the new sign is more effective than the previous sign. 4 Granting.the exception would meet the purpose of the sign regulations to maintain the 5 visibility and effectiveness of the existing on premise sign structure. 6 3. There are special circumstances unique to th~ 7 property to ~ustify the exception, In February of 1994, a tornado damaged the non- 8 conforming roof signs located on the restaurant located at 1542 E1 Camino Real. 9 This act of nature is a special circumstances ................ unique to the property to justify the 10 requested exception'i 11 . 4. Grantinq the exception will have a neqativ~ impact on surroundin~ properties. Granting 12 the exception would not have a negative impact on the surrounding properties as the amount of 13 sign clutter at the location will not be increased by the copy change. 14 5. The siqn application promotes the public 15 health, safety, welfare and aesthetics of tho communitV and the ~rantinq of the exception 16 meets the findinqs and intent of the Siqn Code. The sign copy change is a face change 17 only to an existing sign. Building permits were issued at the time of the sign's 18 construction' in 1973, and the sign was inspected for code compliance. Therefore, the 19 sign structure does not pose a threat to the public health, safety or welfare. Granting 20 the exception would meet the intent of the Sign Code to continue to allow the visibility 21 and effectiveness of an existing sign structure, as specified in paragraph 2, above. 22 " Granting the exception would not set a precedent, based upon the merits of this case, 23 as the there are special circumstances unique to the property in that the non-conforming 24 .roof sign on the restaurant was damaged by a tornado, an uncontrollable act of nature. 25 26 27 28 Resolution 94-111 Page 3 1 2 II. The City Council hereby approves Sign Code Exception 94- 003 authorizing a Sign Code Exception from Section 9403hd 3 of the Tustin City code for a copy change on the existing non-conforming roof sign located at 1542 E1 Camino Real. 4 5 6 7 PASSED AND ADOPTED at a regular meeting of the Tustin City Council, held on the 19th day of September, 1994. 8 10 ~ ....
