HUSTON, CITY MANAGER OFFICE OF THE CITY CLERK CONFLICT OF INTEREST CODE- DESIGNATED POSITIONS SUMMARY: Designated Positions in the City's Conflict of Interest Code require updating each year prior to the annual filing of Statements of Economic Interests by City employees and officials. RECOMMENDATION Adopt Resolution No. 99-12 modifying the Appendix (Designated Positions)contained in the City's Conflict of Interest Code to delete the positions of Tustin Community Foundation Board of Directors and Tustin Community Foundation ExecutiVe Director. FISCAL IMPACT None BACKGROUND The Appendix (Designated .Positions) of the City's Conflict of Interest Code defines those officials and employees who are required to file Statements of Economic Interests (Form 700). Annually, the Designated Positions should be modified to reflect changes that have occurred in the City's Classification Plan or to reflect additions/deletions of positions as determined by the City Attorney. On July 7,. 1998, the City Council authorized autonomy for the Tustin Community Foundation. This autonomy eliminates the necessity for the positions of Tustin Community Foundation Board Member and the Executive Director to file Statements of Economic Interests with the City Clerk. With adoption of Resolution No. 99-12, the Designated Positions will be amended to delete the positions of Tustin Community Poundation Board of Directors and the Tustin Community Foundation Executive Director. That the Appendix of the Conflict of Interest Code of the City of Tustin, approved by the City Council with the adoption of Resolution No. 98-3, should be modified and updated to delete the two (2) positions of Tustin Community Foundation Board of Directors and Tustin Community Foundation Executive Director from those positions required to file a Statement of Economic Interests. B. That the revised Appendix, attached hereto, be approved and the Conflict of Interest Code be modified accordingly. C. That pursuant to Section 4 of the Conflict of Interest Code of the City of Tustin, the City Council, as the Code-reviewing body, hereby instructs all persons occupying a Designated Position to file with the City Clerk a Statement of Economic Interests as required: assuming position, annually, and leaving position. Senior Public Works Inspector Public Works Inspector CONSULTANTS The City Manager shall determine on a case-by-case basis whether a particular consultant is required to comply with the disclosure requirements listed above. If the City Manager determines that a particular consultant must comply with the above disclosure requirements, the City Manager shall notify the consultant in writing. The written notification shall include a description of the consultant's duties and, based upon those duties, a statement of the extent of the diSclosure requirements. The City Manager's notification is a public record and shall be retained for public inspection by the City Clerk in the same manner and location as this Conflict of Interest Code.
