HomeMy WebLinkAboutCC RES 94-110  RESOLUTION NO. 94-110 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF i~ TUSTIN, APPROVING AMENDMENT TO VESTING TENTATIVE 3 TRACT MAP 14669 TO MODIFY CONDITION NO. 2.2 OF PLANNING COMMISSION RESOLUTION NO. 3078 RELATED TO 4 THE LOCATION OF THE PASEO. 5 The City Council of the City of Tustin does hereby resolve as follows: 6 I, The City Council finds and determines as follows: 7 A. That Amendment to Vesting Tentative Tract Map 14669 8 was submitted to the Planning Commission and City Council by California Pacific Homes for 9 consideration to modify Condition No. 2.2 of Planning Commission Resolution No. 3078 related to 10 the location of the paseo. 11 B. That a public hearing was duly called, noticed and held for said amendment on August 8, 1994, by the 12 Planning Commission on September 6, 1994 by the City Council. 13 C. That the proposed subdivision is in conformance 14 with the Tustin Area General Plan, adopted East Tustin Specific Plan, Development Agreement and 15 Subdivision Map Act as it pertains to the development of single family detached dwellings. 16 D. The 0.7038 acres of parkland required for this 17 development was previously dedicated with recordation of Tract 12870. 18 ,.. E. That the City has reviewed the status of the School 19 Facilities Agreements between the Irvine Company and the Tustin Unified School District. The East 20 Tustin Specific Plan, EIR 85-2 with subsequently adopted supplements and addenda, the impact of 21 Vesting Tentative Tract 14669 on School District facilities, and reviewed changes in State law, and 22 finds and determines that the impacts on School District facilities by approval of this map are 23 adequately addressed. 24 F. That the site is physically suitable for the type of development proposed. 25 G. That the site is physically suitable for the 26 proposed density of development. 27 28 Resolution No. 94-110 Page 2 1 H. That the design of the subdivision or the proposed 2 improvements are not likely to cause substantial environmental damage or substantially and avoidably 3 injure fish or wildlife in their habitat. 4 I. That the design of the subdivision or the type of improvements proposed will not conflict with 5 easement acquired by the public at large, for access through or use of the property within the 6 proposed subdivision. 7 J. That the design of the subdivision or the types of improvement proposed are not likely to cause 8 serious public health problems. 9 II. The City Council hereby approves Amendment to Vesting Tentative Tract Map 14669 to modify Condition 2.2 of 10 ........ ~i~h~ng ~i~sio~ Resolu~0n 3078 ~0~ead~S f0ii0~:''I ll "The subdivider shall provide a paseo link for the 12 tract over Lot "S" of Tract 14669 combined with Lot "E" of Tract 14168 networking the tract pedestrian 13 circulation between Tract 14669 and 14168 and to 'the sidewalks adjacent to Township Drive and Tustin 14 Ranch Road." 15 All other conditions of approval in Exhibit A of Planning Commission Resolution No, 3078 remain in full force and 16 effect. 17 PASSED AND ADOPTED at a regular meeting of the Tustin City Council, held on the 6th day of September, 1994. 18 19 THOMAS R.
