APPEAL OF CONDITIONAL USE PERMIT 98-007 & DESIGN REVIEW 98-007
SUMMARY: Conditional Use Permit (CUP).98-007 and DeSign Review 98-007 are requests to
construct a 1,472 square foOt ~e through oil=change faciIity with three service bays. The property is
located at 12972 Newport"AvenUe On 'northeast corner'of Newport /lvenue and Old Irvine
Boulevard. The Property is located within the Retail commercial (C-I) Zoning DistricL On OctOber
26, 1998, the Planning CommiSSibn' denied CU~ 98;O07'ahd DR 98-007. On November 2, 1998 the
applicant appealed the Planning Commission's decision.

RECOMMENDATION
At the applicant's request, the City Council continued this item from the November 16, 1998
meeting. The applicant has waived his right to have the appeal heard by the City Council within 20
days of the appeal date as required by the Tustin City Code. The applicant has requested another
continuance until after January 12, 1999. The first available Council meeting after January 12th
would be January 19, 1999. The applicant was advised of this date and concurs; therefore, staff
recommends that the Council continue Conditional Use Permit 98-007 and Design Review 98-007
to the January 19, 1999, meeting.
