GRANT FUNDS FOR PLAYGROUND SURFACING
RECOMMENDATION:
Request approval to apply for a Tire Recycling Grant from the California Integrated Waste
Management Board for playground surfacing at Peppertree Park and adopt Resolution No. 98-116
to support the grant request.
FISCAL IMPACT:
Funding in the amount of $250,000 for the renovation of Peppertree Park is included in the 1998/99
Capital Improvement Program. An additional $100,000 is being provided by a County of Orange
Urban Parks and Recreation (UPAR) grant. The matching grant request of $12,660 for playground
surfacing material would allow the City to expand the scope of improvements duhng renovation.
BACKGROUND:
Planning is currently underway for the City of Tustin Department of Parks & Recreation to
renovate Peppertree Park during summer, 1999. The City's ADA (Americans with Disabilities
Act) 1990 Self Evaluation and Transition Plan identified that the play equipment and surfacing at
the park did not comply with recommended ADA or Consumer Product Safety Commission's
guidelines. The report called for the replacement of the surfacing material whenever funds
became available.
Other proposed improvements to Peppertree Park include a new restroom building, additional
windows at the Senior Center, ADA compliance improvements, an enhanced venue for the
summer concert series and new playground equipment. The City's 1998-99 Capital
Improvement Program does not include funding for all of the proposed improvements.
The Tire recycling Act authorized the California Integrated Waste Management Board to award
grants for the purpose of diverting tires from landfill disposal by promoting markets for recycled
tires. The Parks and Recreation Department identified an eligible project for playground
surfacing in conjunction with the renovation of Peppertree Park. A matching fund grant would
allow the City to expand the scope of the project. Grant recipients will be notified of awards
during February/March 1999.

RESOLUTION NO. 98-116
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, APPROVING AN APPLICATION TO THE CALIFORNIA
INTEGRATED WASTE MANAGEMENT BOARD FOR A PLAYGROU2ND
COVER AND SURFACING GRANT.
WHEREAS, the people of the State of California have enacted Assembly Bill 1843
(W. Brown, Chapter 974, Statutes of 1989) that provides grants to local governments,
businesses and non-profit organizations for the purpose of diverting tires from landfill
disposal by fostering new business enterprises and encouraging cooperative local government
programs; and
WHEREAS, the California Integrated Waste Management Board has been delegated
the responsibility for the administration of the program in the state, setting up necessary
procedures governing application by local agencies, businesses and non-profit organizations
under the program; and
WHEREAS, said procedures established by the California Integrated Waste
Management Board require the applicant to certify by resolution approval of the application
before said application to the state; and
WHEREAS, the applicant Will enter into an agreement with the State of California
for development of the project;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Tustin
Authorizes the submittal of an application to the California Waste
Management Board for a 98/99 Tire recycling Grant.

Authorizes and empowers Patrick Sanchez, the Director of the Parks and
Recreation Services Department, to execute in the name of the City of Tustin
all necessary applications, contracts, agreements, amendments and payment
requests hereto for the purposes of securing grant funds and to implement
and carry out the purposes specified in the grant application.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 7~ day of December, 1998.
