That the City Council authorize the Mayor and City Clerk, subject to final City Attorney approval, to execute the attached Professional Services Agreement with Daniel Boyle Engineering, Inc. for engineering services for the design of improvements to the Foothill Reservoir. FISCAL IMPACT The recommended agreement will be funded with $82,801 from the Water Capital Improvement Program. There is currently $101,000 budgeted within Water Capital Improvement Project No. 600113 for completion of this phase of the project. BACKGROUND In November of 1996, R~H Engineering, Inc., completed a structural evaluation of the roof at Foothill Reservoir. The evaluation indicated that the roof is structurally sound, but needs grout sealing of numerous cracks and overlay with lightweight concrete in order to avoid furore degradation of the reinforcing steel. It also indicated that adjacent retaining walls are in poor condition and should be replaced. The scope of work in the recommended agreement addresses these issues. DISCUSSION Written proposals for this project were received from four firms. They are as follows: AKM Consulting Engineers, Inc. 'Black & Veatch Daniel Boyle Engineering, Inc. IWA Engineers, Inc. Professional Services Agreem~ (Project No. 600113) December 7, 1998 Page 2 ,r Design of Foothill Reservoir In 'emems A selection committee consisting of City staff and the Program Manager determined that, based on professional qualifications and recent experience with related work, Daniel Boyle Engineering, Inc. is the most qualified firm to perform the requested work. Daniel Boyle Engineering, Inc. and their project team have extensive experience in the design of retrofits for existing reinforced concrete reservoirs and demonstrated a significantly better work plan for dealing with the issues which will need to be addressed for a successful project. Once it was determined that Daniel Boyle Engineering, Inc. was the most qualified firm, the final scope of work and fee were negotiated. The consultant contract has also been structured with a pay for performance feature. The consultant will be paid only upon completion of certain milestones which have been included in the proposal and made a part of the agreement. Serlet Director of Public Works/City Engineer Water Services Manager CONSULTANT SERVICES AGREEMENT THIS AGREEMENT FOR CONSULTANT SERVICES, is made and entered into this 7th day of December, 1998, by and between the CITY OF TUSTIN, a municipal corporation, hereinafter referred to as "City", and Daniel Boyle Engineering, Inc., a California corporation, hereinafter referred to as "Consultant". RECITALS WHEREAS, City requires the services of a consultant to furnish the necessary engineering services for the desi~ of improvements to the Foothill Reservoir, hereinafter referred to as "Project", and · WHEREAS, Consultant has submitted to City a revised proposal dated October 29, 1998, a copy of which is attached hereto, marked as Exhibit "A", and is by this reference incorporated into this Agreement; and WHEREAS, Consultant is qualified to provide the necessary services for the Project and desires to provide said services; and WHEREAS, City desires to retain the services of Consultant for said Project. NOW, THEREFORE, for the consideration and upon the terms and conditions hereinafter set forth, the parties agree as follows: AGREEMENT Section 1' ScoPe of Consultant's Services Consultant shall perform ail work necessary to complete in a manner satisfactory to City, the services set forth in the City's Request for Proposal dated August 5, 1998, a copy of which is attached hereto, marked as Exhibit "B" and is by this reference incorporated into this Agreement. ConSultant shall also perform all the services set forth in Exhibit "A". Section 2: Order of Precedence In the event of a conflict between or among any of the documents comprising this Agreement, the following order to precedence shall govern the provision in question: 1. City's Request 'for Proposal (Exhibit "B") 3 Consultant's Proposal (Exhibit "A') · Section 3: Time for Completion The time for completion of the work to be performed by Consultant is an essential condition of this Agreement. Consultant shall prosecute regularly and diligently the work of this Agreement according to reasonable schedules established by the City for various items described and as outlined within Consultant's proposal. Consultant shall not be accountable for delays in the progress of its work caused by any condition' beyond its control and without the fault or negligence of Consultant. Delays shall not entitle Consultant to any additional compensation regardless of the party responsible for the delay. Section 4: Compensation me The compensation to be paid under this Agreement shall be as set forth in Exhibit "A", not to exceed a total cost of $82,801. B, Consultant shall submit detailed invoices, based upon the actual work performed for each individual task accompanied by backup documentation as requested by the City. Gl Progress payments for work completed shall be paid by City as each major Task delineated in the Consultant's proposal is completed not exceeding that provided in the Consultant's proposal, within thirty (30) days of the date of Consultant's invoice. Do Consultant shall provide City with a monthly itemization of all work performed, and the fees accrued thereon, in complete and sufficient detail to fully apprise City thereof. Section 5: Independent Contractor Consultant's relationship to City in the perfo.rmance of this Agreement is that of an independent contractor. Consultant's personnel performing services under this Agreement shall at all times be under Consultant's exclusive direction and control and shall be employees of Consultant and not employees of City. Consultant shall pay all wages, salaries and other amounts due its employees in connection with this Agreement and shall be responsible for all reports and obligations respecting them, such as social security, income tax withholding, unemployment compensation, workers' compensation and similar matters. Section 6: Indemnification Consultant agrees to indemnify, defend and hold City, its officers, agents, employees, successors and assigns harmless from any loss, damage, injury, sickness, death, or other claim made by any person and from all costs, expenses and charges including attorney's fees caused by or arising out of Consultant's, its officers', agents', subcontractors', or employees' negligent acts, negligent errors, or negligent omissions or willful misconduct, or conduct for which the law imposes strict liability on Consultant in the performance or failure to perform this Agreement. Section 7: Insurance mo Consultant shall maintain in full force and effect during the term of this Agreement policies of comprehensive general liability, personal injury and automobile liability insurance with limits of at least $1,000,000 combined single limit coverage per occurrence. Bo Consultant shall maintain in full force and effect during the term of this Agreement a policy of professional liability instance coverage with limits of at least $500,000 combined single limit coverage per claim or per occurrence. If Consultant provides claims made professional liability insurance, Consultant shall also agree in writing either (1) to purchase tail insurance in the amount required by this Agreement or to cover claims made within five (5) years of the completion of Consultant's service 'under this Agreement, or (2) to maintain professional liability insurance coverage with the same carrier in the amount required by this Agreement for at least five (5) years after completion of Consultant's services under this Agreement. Consultant shall also provide evidence to the City of the purchase of the required tail insurance or continuation of the professional liability policy by executing the attached Letter Agreement on Consultant's letterhead. Co Consultant shall carry and pay for such compensation insurance as is necessary to fully protect Consultant and its employees under California Worker's Compensation Insurance and Safety Laws, and shall relieve the City from all responsibility under said laws in connection with the performance of this Agreement. Do All insurance required pursuant to this Section shall be issued by a company admitted in the State of California and rated A, VII or better by the latest edition of Best's Key Rating Guide. mo Upon execution of this Agreement, Consultant shall provide to City certificates of insurance on the City's form evidencing the required insurance. If self-insured for worker's compensation, Consultant shall submit to City a copy of its certification of self- insurance issued by the Department of Industrial Relations. Section 8: Termination of Agreement City shall have the right to terminate any or all of the services covered by this Agreement at any time for any reason by giving written notice to Consultant. Upon termination of this Agreement, Consultant Shall be paid for services rendered by the effective date of the termination. Upon termination of this Agreement or completion of the Project, all documents'relating to the Project shall become the sole property of City. Should City terminate this Agreement pursuant to subparagraph A. of this Section, Consultant shall, within ten (10) business days of receipt of notice of termination, provide City with all documents within Consultant's possession relating to this Ageement and the Project, including but not limited to all completed documents and all drafts of uncompleted documents. Co This Agreement shall extend to and be binding upon and inure to the benefit of heirs, executors, administrators, successors and assigns of the respective parties hereto. D° Consultant shall perform all services required under this Agreement using that degree o.f care and skill ordinarily exercised under similar conditions in similar localities, and shall be responsible for all errors and omissions for services performed by Consultant under the terms of this Agreement. Eo Consultant certifies that there shall be no discrimination against any employee who is employed in the work covered by this Agreement, Or against any application for such employment, because of race, religion, color, sex or national origin including but not limited to, the following: employment, upgrading, demotion or transfer, recruitment, or recruitment advertising, lay-off or termination, rate of pay or of other forms of compensation, and selection for training, including apprenticeship. PAGE I SECTION 2 EXPERIENCE 2.1 RESERVOIR REHABILITATION EXPERIENCE - DBE,I POINT LOMA RESERVOIR REHABILITATION Client/Owner: City of San Diego Reference: Ms. Lucia Lee (619) 533-5154 Construction Cost: $2,000,000 Project Status: Project desig-n is complete. Project Description: The existing reservoir'is a 10.0 million gallon buffed concrete reservoir with sloping sides and a flat bottom. The existing roof structure consists of concrete columns, wood frame and a built up asphalt roofing system. The original reservoir was constructed in 1942 and is in need of a complete rehabilitation. Daniel Boyle Engineering, Inc.'was retained by the City of San Diego to perform a thorough investigation of the existing reservoir conditions, prepare a Predesig-n Report which documented the condition of the existing reservoir, and provide recommendations and construction cost estimates for the required rehabilitation. Improvements recommended and incorporated into the construction plans and specifications are as follows: Scope of Services: · A 12-inch bypass pipeline and PRV station so the reservoir can be taken out of service during construction. · Hypalon reservoir lining system. · Reinforced concrete sheer walls for seismic support of new wood roof structure. · Cathodic protection. · Control valve modifications. · Site drainage and pavement improvements. · Reservoir ventilation system improvements. · New wood frame roof system with rolled membrane roofing.. · Irrigation and landscaping improvements. · Piping repainting and recoating. · Electrical and telemetry modifications. SAN JOAQUIN AND VIE JO RESERVOIRS REHABILITATION Client/Owner: Laguna Beach County Water District Reference: Mr. Jim Nestor (949) 494-1041 Construction Cost: $412,000 Project Status: Construction to start in Fall of 1998. Project Description: Daniel Boyle Engineering, Inc. was retained by Laguna Beach County Water Distric{ to perform an investigation and prepare construction plans, specifications and bid documents for the rehabilitation of a 2.5 MG and a 0.5 MG reservoir. PAGE 2 SECTION 2 EXPERIENCE structures with wood roofs supported by precast concrete columns. Alternatives for column and roof replacements were investigated and compared to determine the most cost effective rehabilitation. Final improvements consisted of replacing the columns with new precast concrete columns and replacing the existing wood roofs with pressure treated lumber. Four alternative roofing systems were bid to determine the most cost effective system. The reservoir access hatches and ventilation openings were replaced with non-corrosive stainless steel materials. BUDDY TODD RESERVOIR REHABILITATION Client/Owner: City of Oceanside Reference: Mr. Nazir Qureshi, currently with the City of Torrance (310) 618-2820 Construction Cost: $240,000 to $813,000 Project Status: Preliminary design is complete. Project Descri£tion: Daniel Boyle Engineering, Inc. was retained by the City of Oceanside in October 1993 to evaluate the City's 5.0 MG Buddy Todd Reservoir. The reservoir was constructed in 1929 and involved a concrete structure with sloping sides, flat bottom and a wood structure built up roofing system. In 1982 the wooden roof failed and was removed and replaced with a hypalon floating cover. The existing floating cover was in bad shape and needed replacement, rehabilitation or a new structural roof system constructed. The City was not sure about the condition of the interior of the concrete reservoir structure itself and asked us to evaluate it during construction of the new cover installation. Alternative 1: Remove existing floating cover and install new floating cover. Estimated cost $240,000 to $259,000. Alternative 2' Remove existing floating cover and install new concrete columns and wood frame structural system with built up roof. Estimate cost $573,000. Alternative 3: Remove existing floating cover and install new concrete columns and panelized wood roof system with built up roof. Estimated cost $695,000. Alternative 4: Remove existing floating cover and install new concrete columns and concrete roof. Estimated cost $813,000. CITY OF TUSTIN UPGRADE OF THE FOOTHILL RESERVOIR DANIEL BOYLE ENGINEERING, INC. PAGE 3 SECTION 2 EXPERIENCE RESERVOIR REPAIRS Client/Owner: Padre Dam Municipal Water District Reference: Mr. Neil Brown Coltstrttctiolt Cost: $600,000 Project Status: Construction is complete. Project Description: Daniel Boyle Engineering, Inc. was retained by Padre Dam Municipal Water District to inspect the condition of the roofs and linings, prepare inspection and preliminary desi~ reports, and prepare final construction plans and specifications for five reservoirs. Each of the five reservoirs had similar characteristics; wood framed roof structures supported by precast concrete columns, concrete linings and corrugated aluminum roofs. Three of the reservoirs had hypalon lining systems. Our inspection team performed complete interior and exterior inspections of the wood roof structural system, kolumns, ventilation and roofing systems. A listing of the five reservoirs and sizes is as follows: · Blossom Valley Reservoir · Chocolate Summit Reservoir · Mountain Top Reservoir 0.2 MG · West Victoria Reservoir 2.8 MG 3.5 MG · East Victoria Reservoir 1.0 MG 2.5 MG Since all of the reservoirs were similar and originally constructed within the same time period, the defects noted during the inspections were common to all reservoirs and were as follows: · Wood beams, joints and rafters were warped · which caused splices and connection to be separated in several locations. · Structural members experienced dry rot and were cracked. · Ventilation intake screens were damaged and provided access to insects and rodents. · The corrugated aluminum roofing was not fastened properly and was allowing dust and rainwater intrusion. · The galvanized hangers, connectors and fasteners were severely corroded. · Two of the reservoirs did not have hypalon lining systems and were experiencing excessive leakage. · Ventilation systems were inadequate for sufficient air flow. · Concrete lining systems were spalling and cracking. CITY OF TUSTIN UPGRADE OF THE FOOTHILL RESERVOIR DANIEL BOYLE ENGINEERING; INC. PAGE 4 SECTION 2 EXPERIENCE CLEARWELL ROOF REPLACEMENT Client/Owner: Helix Water District Reference: Mr. Carlos Lugo (619) 466-0585 Construction Cost: $425,000 Project Status: Construction is complete. Project Description: Helix Water District retained Daniel Boyle Engineering, Inc. in 1994 to perform a preliminary design, prepare final plans and specifications for a windgirder and review of shop drawings for a new aluminum dome to be installed on a 5.0 million gallon reservoir originally constructed in the 1960s. The project required the existing cone style roof to be removed. The tank shell then had to be reinforced around the top to resist wind and seismic loads prior to installation of the new aluminum dome. ALICIA & VILLA RESERVOIRS Client/Owner: Santa Margarita water District Reference: Mr. Dan Ferons (949) 459-6590 Construction Cost: $900,000 Project Status: Construction is complete. Project Description: Above grade steel tanks were recoated, retrofit for seismic flexibility, inlet/outlets were modified and the sites were improved with new paving, drainage and fencing. 2.2 ADDITIONAL RESERVOIR EXPERIENCE- DBE,I 16TH STREET RESERVOIR Client/Owner: City of Newport Beach Reference: Mr. Michael J. Sinacori, (949) 644-3342 Construction Cost: $3,000,000 Project Status: Construction is complete. Project Description: 3.0 million gallon reinforced concrete buried reservoir. The reservoir has a hopper bottom (Proposed by DBE,I to save approximately $150,000) and a divided wall to allow half the reservoir to be drained for cleaning and maintenance while the remaining reservoir is in service. The reservoir is integrated into the City Utilities Yard, and accommodates traffic loading/parking on top of CITY OF TUSTIN UPGRADE OF THE FOOTHILL RESERVOIR DANIEL BOYLE ENGINEERING, INC. Habash (949) 643-2584 Construction Cost: $3,900,000 Project Status: Completed in 1992. Project Description: 3 million gallon reclaimed water reservoir. Circular, prestressed concrete tank. Completely buried with a hilltop park over the tank. The park includes landscaping, picnic areas and view overlooking the Saddleback Valley. The site is located in a private gate guarded community. PAGE 6 SECTION 2 EXPERIENCE District also owns storage capacity in the facility, and metering is provided for both agencies on the inlet and outlet sides of the reservoir. The reservoir was constructed in 1959 with the floor and sloping sides made of 3 to 4 inches of wire mesh reinforced gunite and a 7½ inch thick reinforced concrete slab roof supported by five rows of eight columns. The roof-is covered with 6 inches of topsoil. Because of leaks in the floor and sides, a hypalon liner was installed in 1990. Rawlings Reservoir: The Rawlings Reservoir is 4.7 million gallon rectangular reservoir (218 feet by 175 feet by 26 feet deep) with sloping sides and covered by a timber and sheet metal roof. The sloping sides and floor were constructed of 4 inches of asphaltic concrete overlain with two layers of asphalt panels. The roof structure consists of glulam beams supported by precast reinforced concrete columns. The roof joists are covered by galvanized and painted pressed steel panels. The reservoir was constructed in 1971. As with Foothill Reservoir a hypalon liner was added in 1989 due to floor and side' slope leaks. Geotechnical Evaluation for the h'vine Desalter in Irvine Client: Orange County Water District c/o Black & Veatch Contact: Mr. Dan Badaluco; 714-753-0500 Project Description: Ninyo & Moore performed a geotechnical evaluation relative to the proposed Irvine Desalter Project in Orange County, California. The project is to be located in Irvine and unincorporated areas of Orange County west of the E1 Toro Marine Corps Air Station, and involves construction of a water treatment plant coveting approximately one acre and installation of 26,000 linear feet of pipelines with associated wells. The completed desalter facilities will be used to collect groundwater, desalt it, and pump it back into the ground, thereby improving the quality of the groundwater in the region. Services included review of geologic background information; excavation, sampling, and logging of thirty-two small-diameter exploratory borings to depths of up to 71.5 feet; performance of laboratory tests to evaluate soil characteristics, including shear strength, consolidation potential, corrosivity, and expansivity; performance of geotechnical analyses; and preparation of a detailed, illustrated report presenting findings and geotechnica! recommendations regarding lateral earth pressures, foundation design, and construction of the proposed water treatment building, pump stations, air strippers, wells, pipelines, and process tanks. Both mat and shallow foundations will be used, and the pipeline crossing under the AT&SF Railroad will likely be by means of pipe jacking. The proposed construction involves the shoring, instrumentation, excavation, and construction of the pump station, which extends to a depth approximately 30 feet below the existing street surface. Services have included evaluating the subsurface conditions by way of logging and sampling three mud rotary borings to approximately 50 feet, and laboratory testing to evaluate the in-sim moisture and density, shear strength, and corrosivity of the on-site soils. An illustrated written report is being prepared to provide findings and geotechnical recommendations including geology and subsurface conditions, faulting and seismicity, liquefaction susceptibility, lateral earth pressures, instrumentation, beating capacity of a mat foundation, uplift design, and corrosivity. Mr. Rush has been project engineer/project architect in charge of structural designs, architectural designs, plan preparations, specifications, cost estimates, contract administrations and construction inspections of a wide variety of civil and architectural projects. Project types include bridge works, culverts, reservoirs, water/wastewater plants, underground vaults, retention systems, shoring systems, industrial facilities, commercial buildings, military facilities,, schools, hospitals, dormitories and post offices. His responsibilities have included Project Manager and Principal-in-Charge on a variety of projects including pipelines, water and sewer facilities, dams and flood control structures, transportation facilities, culverts, bridges and residential and commercial developments. His background includes teaching and performing quality research in the field of geotechnical engineering. PROJECT ENGINEER - LANDSCAPING Landscape Irrigation Consulting (LIC) is a Southern Califomia based firm, with a staff of four full time employees, landscape and irrigation design projects ranging from half-acre residential sites to 850 acres of streetscapes and development projects. Also included are several reservoir projects. During the past 15 years LIC's office has completed many diversified projects such as resort hotels, public schools, parks (both regional and community), slope stabilization, highway beatification, streetscapes, and a variety of projects involving renovation of existing systems. The design philosophy of Landscape Irrigation Consulting is to produce designs that will accommodate the landscape design most effectively and economically. Concern is stressed in cOnservation by proper application of water through well designed systems to maintain operational control to eliminate wasted water. LIC is also'experienced with projects that involve the removal of. native materials from undeveloped areas for the purpose of constructing reservoirs and cross country roadways similar in nature to the proPosed project. Mr. Frank Simon, Company President, will be the key person involved with the design and preparation of plans and specifications for the required irrigation and landscaping system. PAGE 24 SECTION 4 APPROACH 4.1 PROJECT DESCRIPTION The Foothill Reservoir is a buried rectangular reservoir (180 feet long, 130 feet wide, and 26-1/2 feet deep) with a storage capacity of 3.3 million gallons. The reservoir was constructed in 1959 with the floor and sloping sides made of 3 to 4 inches of wire mesh reinforced gunite and a 7-1/2 inch thick reinforced concrete slab roof supported by five rows of eight columns. The roof is covered with 6 inches of topsoil. Because of leaks in the floor and sides, a hypalOn liner was installed in 1990. The existing major storage reservoirs of the City of Tustin Water Service, including Foothill Reservoir, are in a poor state of condition and subject to major damage or failure as a result of seismic aCtivity at any time. The potential for the collapse of the roof structure of the Foothill Reservoir presents a potential hazard to City personnel and would result in a serious Storage capacity loss. The City commissioned R2H Engineering in 1996 to prepare a structural evaluation of several of the City's existing reservoirs including the Foothill Reservoir. The recommended improvements to Foothill Reservoir consist of work both inside the reservoir and on the exterior. As of this time, it is the City's intent to only implement those recommendations which can be accomplished while maintaining the reservoir in service. These items include providing a new gunite retaining wall over the existing gunite wall and the replacement of the cast-in-place retain/ng wall along the adjacent alley, both to be designed based upon the recommendations of a geotechnical engineer; remove soil from the top of the reservoir, remove and reinstall the existing FAA equipment, fence and support system; repair concrete cracks in the roof and seal with a protective waterproofing cement based slurry; provide proper drainage around the reservoir site and perimeter fencing; modify the existing ladder rtmgs to conform with OSHA regulations;' and install a new Bilco access hatch. 4.2 GENERAL The City intends to keep Foothill Reservoir in service and to implement only those repairs or upgrades that can be accomplished without jeopardizing the continuous oPeration of the potable water system. The proposed work consists of the following: CITY OF TUSTIN UPGRADE OF THE FOOTHILL RESERVOIR DANIEL BOYLE ENGINEERING, INC. PAGE 25 SECTION 4 APPROACH 4.3 Soil RESERVOIR ROOF All soil must be removed from the top of the reservoir roof slab. The contractor will be required to limit the size and weight of construction equipment to be used upon the roof. Equipment access will be limited to specific portions of the roof. The specifications will clearly call out maximum equipment weights and roof access limitations and pathways. FAA Equipment The existing FAA outer marker beacon equipment, which sits on the roof slab, must be moved to repair and seal the roof slab. The County of Orange is responsible for moving this equipment, however they will only move it one time and must be coordinated 90 days in advance. During design, we will determine, with input fi'om the County/FAA, the best timing with respect to the reservoir rehabilitation work and location on the roof for moving the equipment. The FAA prefers the center of the reservoir, since that provides the most protection from trees, and to some extent, vandalism. It may be to the City's best interest to relocate it to another location on the roof for structural or construction considerations. We will obtain the equipment weight from the FAA and verify the roof will support these wei~ts. Our proposal assumes the roof will support the equipment without modification. The project plans and specifications will clearly inform the contractor that he is responsible for coordinating this move, the advanced notice requirements and the precise location the equipment will be relocated. Fencing on Ro'of The existing fence located on the reservoir roof is in poor condition and will be )~'!,7:-i completely removed. It will be replaced with a site perimeter fence. The project plans and specifications will provide details for this work. CITY OF TUSTIN UPGRADE OF THE FOOTHILL RESERVOIR DANIEL BOYLE ENGINEERING, INC. PAGE 26 SECTION 4 APPROACH Roof Slab Repair The existing roof slab will be repaired by sealing the cracks and then applying a protective waterproofing system over the entire roof surface. Alternative methods and materials will be considered and discussed with the City. Our initial thinking is to utilize a structural epoxy injected under pressure into the cracks to provide a structural bond, protect the exposed reinforcing bars and result in a watertight seal. The entire roof slab would then be overlain with a specialized cement mortar topping which includes a corrosion inhibitor. This would provide waterproofing and additional corrosion protection. The City has indicated the reservoir may be taken out of service during winter months for a maximum of 60 days during this work. Access Hatch and Steps The existing access hatch is difficult to open and does not meet OSHA safety requirements. The existing steps from the hatch opening into the reservoir also do not meet OSHA safety requirements. We will consider both improving the existing hatch / entry and converting the existing hatch entry to a non-entry hatch for cross ventilation and constructing a new,' second entrance hatch and stairway meeting all OSHA requirements. The plans and specifications will provide details for either alternative and include the removal of the old hatch, modification of the opening beam, if necessary, and installation of a new Bilco type hatch and new steps. 4.4 RESERVOIR SITE Drainage Drainage from the roof is to the northwesterly comer. Currently, drainage leaves the roof and runs down an unprotected slope, causing erosion. The reservoir modifications will include, slope protection to prevent future erosion. PAGE 27 SECTION 4 APPROACH Fencing As stated above, the existing link chain fencing on the roof will be removed and new link chain fencing will be constructed around the entire site perimeter, except where not re.quired by the walls. Appropriate gates for access, coordinated with City staff, will be provided. Wooden Entry Stairs The existing wooden stairs at the entry to the site will be removed and replaced with cast-in-place concrete stairs and handrail meeting OSHA requirements. Landscaping The existing site has'minimal landscaping. The City desires to keep the landscaping minimal. The contractor will be required to replace any landscaping removed or damaged, as determined by City staff. The large bougainvillea along the southerly wall will be protected. The contractor will be allowed to cut it back for construction, under the direction of the City. Under this contract, new landscaping and irrigation systems will be installed along the Old Foothill Boulevard frontage. Our proposal assumes up to 0.5 acre of landscaping and irrigation sys.tems with booster pump. Grading Other than as required for the specific work described herein, no general site grading will be required. 4.5 RESERVOIR PIPING AND V.a~LVING At the pre-proposal meeting Gary Veeh stated that there would not be any modifications made to the existing reservoir piping and v. alving under this contract. 4.6 EXISTING RETAINING W.hJ.,LS A Geotechnical evaluation will be conducted as described in Section 4.7. When the preliminary results of that evaluation are available, we will conduct a workshop including the City, Geotechnical engineer and structural engineer to discuss the findings of the investigation and alternative methods to protect the reservoir, site and adjacent improvements. During the preliminary design phase, we will consult with one or more contractors to obtain their input regarding the contemplated alterative construction. CITY OF TUSTIN UPGRADE OF THE FOOTHILL RESERVOIR DANIEL BOYLE ENGINEERING, INC. PAGE 28 SECTION 4 APPROACH 4.6.1 Easterly Side of Site A cast-in-place concrete retaining wall makes up the grade difference between the reservoir site and the alley/driveway, which inclines to the south, on the easterly side of the site. This retaining wall is offset in all three planes at the location of what appears to be a cold joint. After the Geotechnical evaluation it will be determined if any of this wall can be saved. Our proposal assumes this entire wall will be removed and replaced. 4.6.2 Southerly Side of Site The wall on the southerly' side of the reservoir appears to be a combination of cast-in-place and gunite. The upper portion is'cast- in-place and retains the lot and house above. The lower portion may be gunite overlying rock. The remedial work required to this wall will be determined after a geotechnical investigation and further structural analysis. Our proposal assumes that the upper cast-in- place portion can remain without modification and a new gunite wall will be constructed over the existing gunite. 4.7 GEOTECHNICAL SERVICES Based on the above information and our current understanding of the project, our Project Team has developed a scope of geotechnical, services that will be limited to evaluating the existing gunite wall and providing the following information for the project structural engineer: · Site Existing Gunite Wall (south) and Retaining Wall (east): - Allowable beating pressures - Allowable passive pressures and friction values - Equivalent fluid pressures (lateral earth pressure) for static, hydrostatic and seismic loading · Reservoir: - Lateral earth pressures and allowable pressures CITY OF TUSTIN UPGRADE OF THE FOOTHILL RESERVOIR DANIEL BOYLE ENGINEERING, INC. PAGE 29 / / SECTION 4 APPROACH To aid in the preparation of this proposal, a representativ, e from our geotechnical engineer visited the site. Based on his site reconnaissance, it is their preliminary opinion that the proposed new gunite wall is necessary from a slope stability viewpoint. In order to evaluate the soil characteristics behind the existing gunite wall, and due to the limited access behind the wall, one or two borings up to approximately 40-feet deep in the alley east of the reservoir will be drilled. The existing gunite wall will also be core drilled at three locations. In addition, one boring up to approximately 30-feet deep will be excavated in the slope west of the reservoir to evaluate the soil properties in front of and below the reservoir. CITY OF TUSTIN UPGRADE OF THE FOOTHILL RESERVOIR DANIEL BOYLE ENGINEEKING, INC. PAGE 30 SECTION 5 SCOP'- .e¢ LABOR HOURS 5.1 PHASE I - PRELIMINARY DESIGN Task 1 A. B, C. Research and Investigation Meet with City staff and Pro,am Manager as necessary to discuss the existing Foothill Reservoir and appurtenant facilities and the needed improvements and to gain an understanding of the City's philosophy regarding the operation of the reservoir. Research, review and verify existing documents 'including reports, existing final or preliminary improvement plan drawings, specifications, existing easement legal descriptions or other pertinent information prepared by others which are related to this project. Commission a Geotechnical investigation of the existing perimeter foundations and walls to be rehabilitated. Do Coordinate with the Federal Aviation Administration for specific requirements for removal and reinstallation of the outer marker beacon. Task 2 Ao B, C, 5.2 Preliminary Facility Layout and Concept Plan Prepare preliminary design concept plans for the reservoir improvements Identify phasing and procedures necessary to keep the existing Foothill Reservoir in operation until the improvements are ready for commissioning. Prepare a project design memorandum presenting the conceptual layout and design of the reservoir improvements and outlining the major design issues that are pertinent and necessary to design the proposed facilities and that are relevant to the preparation of the plans and specifications. Preliminary landscape concepts will be included as will a preliminary construction cost estimate and technical specifications table of contents. PHASE II - CONSTRUCTION DOCUMENTS Task 1 Final Design and Construction Plans Prepare complete, detailed construction plans, specifications, details and sections and a cost estimate for reservoir improvements, site work and all other work necessary for the complete installation of the proposed facilities. CITY OF TUSTIN UPGRADE OF THE FOOTHILL RESERVOIR DANIEL BOYLE ENGINEERING, INC. PAGE 31 SECTION 5 SCOP? ': LABOR HOURS · All plans and details shall be drawn at an appropriate scale to produce clear, accurate, easy to read drawings. Construction plans shall be complete and fully detailed as required by City staff and the Program Manager. All specifications and construction plans shall be subject to final review and acceptance by the City staff and the Program Manager. Prepare the necessary plans in' AutoCAD, Release 12 or newer, and plot them on City standard mylar sheets. Once completed, the original mylars of all approved drawings shall be submitted to the City together with all other bid documents. Project'plan originals shall be 24"x 36" sized City of Tustin standard mylar sheets with title and signature blocks. Digital files are acceptable in either AutoCAD drawing file (DWG) or a data exchange file (DXF) format. Task 2 Technical Specifications As required by City policy, the Standard Specifications for Public Works Construction (latest edition) shall be used and referenced in the construction specifications wherever practical. Sample plans fi.om previous City projects will be available for reference. Project technical specifications, special provisions and contract bid documents shall be prepared in accord with the requirements of the City's design criteria. Coordinate with Program Manager and prepare a table of contents for the project's contract documents and technical specifications. The requirements shall not include those for which the City is exempt from by public agency laws. The Program Manager will perform the coordination with any agencies with jurisdiction over the work involved. The Cit-y's e,'dsting 3.3 MG Foothill Reservoir located at the southeast is the subject of this proposed design eh'om. BACKGROUND The e,,dsting major storage reservoirs of the City of Tustin Water Service are in a poor state of condition and subject to major damage or failure as a result of seismic activity, at any time. The potential for the collapse of the roof structure of the Foothill Reservoir presents a potential hazard to City personnel and would result in a serious storage capacity loss. Foothill Reservoir The Foothill Reservoir is a buried rectangular reservoir (180 feet long, 130 feet wide, and 26-1/2 feet deep) with a storage capacity of 3.3 million gallons. The reservoir was constructed in 1959 with the floor and sloping sides made of 3 to 4 inches of wire mesh reinforced gunite and a 7-1/2 inch thick' reinforced concrete slab roof supported by five rows of eight columns. The roof is covered with 6 inches of topsoil. Because of leaks in the floor and sides, a hypalon liner was installed in 1990. REQUEST FOR PROPOSAL August 5, 1998 Page 2 The City commissioned R2H Engineering in 1996 to prepare a structural evaluation of several of the City's existing reservoirs including the Foothill Reservoir. A copy of their recommendations for the Foothill Reservoir is attached to th/s RFP. As of this time, it is the City's intent to only implement those recommendations which can be accomplished while maintaining the reservoir in service. These items include providing a new gunite retaining wall over the existing ~manite wall and the replacement of the cast-in-place retaining wall along the adjacent alley, both to be designed based upon the recommendations of a geotechnical engineer; remove soil from the top of the reservoir, remove and reinstall the existing FAA equipment, fence and support system; repair concrete cracks in the roof and seal with a protective waterproofing cement based slurry; provide proper drainage around the reservoir site and perimeter fencing; modify the existing ladder rungs to conform with OSHA regulations; and install a new Bilco access hatch. All services will be procured in accordance with existing City of Tustin policies wkich require professional fn-ms to be selected on the basis of professional experience, qualifications and cost. Compensation to be paid under any resulting agreement will be based on individual tasks and progress payments will be made for completed tasks only. Proposing frans will be evaluated on demonstrated Competence, professional qualifications, familiarity and experience with providing this type of service, and the understanding of the City of Tustin's needs. The experience of the Project Manager and the percentage of his time to be dedicated to the project will be key factors. The method for maintaining close communication with City staff and approach to completing the project in a timely manner will be of utmost importance. The selected finn will report directly to the City's Program Manager, ASL Consulting Engineers. It is expected that the selected finn will provide the necessary analysis and make recommendations on all'technical issues. Written proposals will be evaluated by a selection committee. Subsequently, selected firms may be asked to give a presentation to the committee. Upon selection of the most qualified firm, a Scope of Work and Fee Arrangement will be negotiated. If the selected firm and the City are unable too negotiate a fee arrangement deemed fair and reasonable, the City will attempt to negotiate an agreement with the next most qualified fn'rn, and so on until an agreement is reached. The Consultant is required to prepare preliminary design concept plans for the requested reservoir improvements B. Identify the phasing and procedures necessary to keep the existing Foothill Reservoir in operation until the improvements are ready for commissioning. C..Prepare a project design memorandum presenting the conceptual layout and design of the reservoir improvements and outlining the major design issues that are pertinent and necessary to design the proposed facilities and that are relevant to the preparation of the plans and specifications. PHASE II CONSTRUCTION DOCUMENTS TASK 1 Final Design and Construction Plans Prepare complete detailed construction plans, specifications, details and sections and a cost estimate for reservoir improvements, site work and all other work necessary for the complete installation of the proposed facilities. Digital files are acceptable in either AutoCad drawing file (DWG) or a data exchange file (DXF) format. TASK 2 Technical Specifications As required by City policy, the Standard Specifications for Public Works Construction (latest edition) shall be used and referenced in the construction specifications wherever practical. Sample plans from previous City projects will be available for reference by the Consultant. Project technical specifications, special provisions and contract bid documents shall be prepared in accord with the requirements of the City's design criteria. Coordinate with Program Manager and prepare a table of contents for the project's contract documents and technical specifications. Also} prepare separate bid schedule sheets breaking out construction items as coordinated with the Program Manager. The items listed in the bid schedule shall relate to the actual numbered construction call-outs shown on the plans. The consultant shall provide a copy in Microsoft Word compatible format of the special provisions and contract bid documents. TASK3 Project Design Notebook & Engineer's Estimate of Probable Construction Cost Assemble'and submit for City staff reference and files two copies o~' a tabbed, three ring note book summarizing all aspects of engineering design for the proposed reservoir improvements or any other related items specified by the City. August 5, 1998 Page 5 Prepare an engineer's estimate of construction costs for the reservoir improvements and appurtenant facilities, including any associated costs. These engineer's estimates shall be prepared using the bid items broken out in the bid schedule and shall relate to the actual construction items shown on the plans. The estimate shall be promptly completed after the City has approved the construction plans and specifications so that this information is readily available for prospective bidders use. Project Deliverables Upon Completion of design activities, provide the City with the original, wet signature (4 mil double matte clear mylar or 4 mil double matte photo mylar) set of the construction plans and camera ready originals of the technical specifications for City reproduction, assembly and bidding. All original mylars will be returned to the consultant in order for any construction plan revisions to be completed by the Consultant after bidding All costs associated with the printing of preliminary originals, the printing of in-house and progress plans at the 50% and 90% stage as well as the 100% final mylar production shall be included in the Consultant's deliverables and/or reproduction budget. At ~e submittal of the final plans and specifications for City signature, the Consultant shall provide to the City a composite map of the reservoir facilities including site boundaries, appurtenant facilities and right-of, way information at a scale of 1 "= 80' (80 scale) in an AutoCad drawing file (DWG) or data exchange fie (DXF) for use by the City in the preparation of grid maps. Plan and specification originals will be turned over to the Program Manager for printing and advertising with the appropriate number of submittal copies. Construction Plans & Specification Review Process The City will require a number of submittals prior to approval and signature of the plans and specifications. Consultant's Proposal fee shall include all meetings and submittals 'necessary for review and coordination. The following list identifies key submittals and required design information for each. A. 50% Design Review: Consultant shall, as a minimum, submit preliminary title sheet, second sheet (including vicinity map, location map, general notes and construction notes), preliminary, civil, mechanical, electrical, piping & instrumentation diagrams (P & ID's) and detail sheets and a preliminary cost estimate for the project. B. 90% Design Review: Consultant shall, as a minimum, submit complete plans, a refined cost estimate and preliminary special provisions, as well as addressing the 50% design review comments. August 5, 1998 Page 6 C. 100% Design Review: Consultant shall, as a minimum, submit the final plans reflecting 90% design review corrections; a complete and detailed cost estimate on the contractor's bid proposal form (with cost estimate backup detail); complete (and bound) special provisions, contract documents and any appendices necessary for final approval. De Final Approval Review: Consultant shall submit final plans reflecting 100% design review corrections; complete (and bound) special provisions, contract documents and any appendices for final approval and plan signature and a complete (and bound) set of the project calculations supporting the design. E. Approval of Plans: Consultant shall submit mylar originals w/th Consultant's stamp and signature with original specifications. The Consultant is responsible for addressing all plan review comments at each of the formal submittals and informal coordination throughout the plan preparation process. The 'City will commit to an accelerated period of five (5) working days of plan review for each submittal. The City will require review meetings at each of the submittals described above as a minimum. During the bid period, the Consultant shall assist the City and Program Manager by answering bidder questions and providing clarifications to the interpretation of plans and specifications. PHASE III CONSTRUCTION SERVICES The Consultant shall be expected to provide a certain level of assistance during conslruction. This assistance shall be limited in scope and shall include the following: TASK 1 Preconstmction Phase A. Respond to bidder's questions during the bid advertisement period and provide information and clarification of construction documents to prospective bidders including preparation of complete addenda documentation as required for Program Manager issuance and distribution. Addenda resulting from omissions or incorrect information provided by the Consultant in the plans or specifications shall be prepared and issued by the Consultant after the Program Manager's review. Attend the pre-bid and pre-construction meetings and be available during the bid process to respond to questions and resolve any discrepancies in the proje, ct plans and specifications. C. Prepare final construction drawings 'including revising the plans and project specifications to include any bid addenda that become necessary. TASK 2 Shop Drawing Review Provide shop drawing review and any necessary plan revisions and processing services during consumction of the facilities and for all other aspects of the 'project. The Consultant shall budget for the review and acceptance of all anticipated shop drawing submittals for the facilities and all appurtenances. Consultant shall include in his budget a second review of each shop drawing submittal. TASK 3 Construction Engineering Support Services A. Provide engineering support services during construction in response to requests for information or clarification fi.om the City or Program Manager or for field coordination activities with the contractor. The Consultant shall also provide budget of 4 hours of staff time for minor plan revisions to the construction drawings. Two (2) site visits of two hours each should also be budgeted for by the Consultant. Site visits will be requested by the Program Manager on an as needed basis. B. Prepare record drawings once the project construction has been completed based on Contractor furnished "Redline" construction plans. ADDITIONAL RESPONSIBILITIES Meet periodically with City staff and Program Manager during the design process to review and discuss progress and coordinate courses of action. Make recommendations on site layouts, etc. It is anticipated that only one design meeting will be required. This does not include the initial project meeting, project submittal meetings, the pre-bid meeting or the preconstruction meeting. Consultant shall be responsible for notifying the City in writing of any regulatory requirements' or conditions for design or construction of the reservoir improvements and appurtenances. The requirements shall not include those for which the City is exempt from by public agency laws. The Program Manager will perform the coordination with any agencies with jurisdiction over the work involved. The Program Manager will also authorize any needed permit applications. 1LEQ~ST FOR PRC' 'qAL August 5, 1998 Page 8 ITEMS TO BE SUPPLIED BY THE CITY The City shall supply/prOvide the consultant with the following: A. Site Plans delineating the locations of existing improvements (attached hereto). B. Rights-of-Way information on the project site. C. Plans and drawings, as are available and appurtenant to the proposed project. D. Topographic survey records and easement information as are, available and appurtenant to the project site. E. Preliminary Site Plan and Design criteria, hydraulic data and other technical information, as are available and appurtenant to the project. F. Sample Special Provisions and City's standard contract documents, as are available and appurtenant to the project. G. The City shall be responsible for administering the required contractor completion of all applications for any required permits from other governing agencies. H. Environmental documentation for the projects proposed under this RFP PROJECT SCHEDULE The City proposes to pursue an aggressive schedule for completion of this critical water storage facility. The project goal is to have the completed facility improvements operational by January 2000. Your firm's qualifications for performing this work, including your related experience in the preparation of plans and specifications for the rehabilitation of reinforced concrete water reservoirs. Provide a brief list of similar .types of projects which your firm has previously performed, including scope, cost and agency for whom completed, including contact person and phone number. Bo Identification, titles and qualifications of individuals who will supervise and perform the necessary services .as discussed in the Scope of Work. The experience and qualifications of the project manager and of other key individuals proposed to assist in the project will be significant factors in the evaluation process. The percentage of time that will be dedicated to the project by the project manager and other key staff should also be provided. The Consultant will assign a responsible representative and an alternate to perform the assigned tasks. Both will be identified in the proposal. The Consultant's representative will remain in responsible charge of all duties from contract negotiations through project completion. If the primary representative is unable to continue with the project, then the alternate representative will become the primary, representative. Any other changes in responsible representative must be approved, in advance, by the City and the Program Manager. The City will have the fight to reject other proposed changes in personnel, and may consider any other changes in responsible personnel a breach of contract. C. An identification of the tasks necessary to complete the Scope of Work and an estimate of the time and man hours necessary to complete each task. Identify. the individuals who will be assigned to each task. D. A proposed project schedule depicting the time of completion for the project design. The schedule shall include the number of calendar days required to perform each task and the total number of calendar days required to complete the entire project. The schedule should be coordinated with the review dates shown above. E. The information you expect to be provided by the City. F. Fee schedule (submit in a SEPARATE SEALED ENVELOPE) indicating the proposed cost for completing each task and a resulting "not to exceed" cost of the project based upon the work hours, hourly rates, and other associated costs. The proposed cost to complete each task shall include the costs of all administration and overhead, project site visits, attendance at meetings, and all reproduction costs. Any other information you feel is pertinent to this project. The Consultant shall be responsible for completing the specified services in accord with the City's standard "Professional Services Agreement", which will be prepared by the City's Program Manager. Services specified in this agreement shall be taken directly from this "Request for Proposal" and from the Consultant's proposal.
