AUTHORIZATION OF A CHANGE ORDER FOR PREPARATION OF THE JOINT
ENVIRONMENTAL IMPACT STATEMENT/ENVIRONMENTAL IMPACT REPORT
(EIS/EIR) FOR THE DISPOSAL AND REUSE OF MCAS-TUSTIN
SUMMARY:.. Revision and recirculation of the.Draft Joint EIS/EIR for the Disposal and
ReUSe of the Marine Corps Air Station is reqUired, neCessitating a change order for additional
services with the firm of HNTB.
RECOMMENDATION
It is recommended that the City Council:
o
Authorize the City Manager to execute an amendment to the Consultant Services Agreement
with the firm of HNTB for preparation of the Reuse Plan/Specific Plan and Joint EIS/EIR for
the Disposal and Reuse of MCAS Tustin, subject to approval of the City Attorney;
2. Appropriate $204,830 from unappropriated 1998-99 General Fund reserves as the City's share
of the costs for the additional services.
FISCAL IMPACT
Additional services required for the project will be funded through cost sharing between the Marine
Corps and City of' Tustin. The City of Tustin's cost share will be in an amount of $204,830. With
the exception of the General Fund, no other funding source is available.
BACKGROUND
As the City Council is aware, the public comment period on the Draft Joint EIS/EIR for the
Disposal and Reuse of MCAS Tustin closed on March 2, 1998. At the CiD' Council closed session
on June 15, 1998, the City Council conferred with the City Attorney regarding exposure to litigation
as it related to the Draft Joint EIS/EIR for the project. Based on the advice of the City's legal
counsel, revision and recirculation of the Draft Joint EIS/EIR will be required.

The City is the project manager for preparation of the joint document based on an executed
memorandum of understanding with the Marine Corps. Based on direction of the City Council on
June 15, 1998, it has been necessary over the last several months to negotiate the scope of work
associated with the revision and recirculation of the Joint EIS/EIR with the Marine Corps and Navy.
Based on this lengthy negotiation, the change order for the additional services to be rendered on the
project under the City's existing contract will compensate HN~ the Prime Consultant (with work
to also be completed by subconsultant fim~ of Cotton/Beland, the Planning Center, Austin Foust
and KEA) in a not-to-exceed amount of $475,395.
The City of Tustin's share ofthe change order will be $204,830 as shown in Exhibit A. The Marine
Corps has already authorized transfer of the remaining $270,525 for the project to the City of Tustin
for disbursements. A proposed schedule for completion of the project is also attached.
