AGREEMENT FOR ROUTE 261 (THE WEST LEG) BETWEEN THE CALIFORNIA
DEPARTMENT OF TRANSPORTATION, THE FOOTHILL/EASTERN TRANSPORTATION
CORRIDOR, THE CITY OF IRVINE, AND THE CITY OF TUSTIN
ISUMMARY
As a result of no direct freeway to freeway interchange between Route 261 (West Leg) and I-5, Caltrans requires aI
Maintenance and Signage Agreement between the involved agencies to maintain their respective surface streetsI
and signage priOr to accepting the West Leg of the Eastern Transportation Corridor. I
RECOMMENDATION
It is recommended that the City Council authorize the Mayor and City Clerk to execute Caltrans Agreement No.
12-353 regarding the maintenance of those surface streets and City signs within the City of Tustin directing traffic
to and from I-5 and Route 261 (the West Leg)
FISCAL IMPACT
The street maintenance and signing costs are included in the Public Works budget. No significant additional street
maintenance or signage costs are anticipated as a result of this agreement.
DISCUSSION
The early planning and development process for the West Leg resulted in the West Leg passing under Interstate
Route 5 and terminating in the "transition area" on Jamboree Road near Walnut Avenue. Since there is no direct
freeway to freeway interchange between Route 261 and I-5, some traffic will be utilizing local arterial highways to
get from one freeway to the other. This agreement provides that Caltrans will accept Route 261 (the West Leg) for
maintenance if designed and constructed in conformance with the Cooperative Agreement, even though there is no
direct freeway to freeway interchange between I-5 and Route 261. It also provides that the cities will maintain
their respective surface streets and all related signing that directs traffic to and from I-5 and Route 261. Caltrans
had been concerned that the local cities may expect Caltrans to contribute to the maintenance of local streets as a
result of traffic having to use the local streets to travel from Route 261 to I-5.

AGREEMENT
This AGREEMENT ("Agreement") is made and entered into effective this 16th day of September,
1998, by and between the FOOTHILL/EASTERN TRANSPORTATION CORRIDOR AGENCY, a joint
powers agency (the "Agency"), the CALIFORNIA DEPARTMENT OF TRANSPORTATION ("Caltrans"),
THE CITY OF .IRVINE ("Irvine") and the CITY OF TUSTIN CTustin"). Hereinafter, the Agency,
Caltrans, Irvine and Tustin are referred to collectively as the "Parties" and each individually as a "Party".
RECITALS
WHEREAS, the Agency is a joint powers agency created to cause the construction of two divided
limited access highways, known respectively as the Foothill Transportation Corridor (the "Foothill
Corridor") and the Eastern transportation Corridor (the "Eastern Corridor"), located in Orange County,
California; and
WHEREAS, Caltrans and the Agency have entered into that certain Cooperative Agreement dated
as of April 7, 1995, as amended ("Cooperative Agreement"), which provides for the acceptance of
ownership and maintenance responsibility for the Eastern Corridor upon substantial completion of said
Eastern Corridor; and
WHEREAS, Irvine and Tustin will own, operate and maintain those surface streets which provide
access between the West Leg of the Eastern Corridor ("West Leg") and Interstate 5 (I-5) highway; and
WHEREAS, due to the Agency's determination not to design and construct a connecting
interchange between the West Leg (Route 261) and I-5 for the use of traffic connecting between the West
Leg and I-5, the Parties hereto desire to establish the responsibilities of the respective local agencies for all
affected Irvine and Tustin surface streets.
AGREEMENT
NOW, THEREFORE, for good and valuable consideration hereby deemed received, the adequacy
of which hereby is acknowledged, the Parties agree as follows:
Acceptance of West Leg by Caltrans. Caltrans shall not refuse to accept the West
Leg of the Eastern Corridor if designed and constructed in conformance with the Cooperative
Agreement on grounds related to the absence of a connecting interchange between the West
Leg and I-5. Except as stated herein, nothing in this Agreement shall affect or impair any
other rights or obligations which Caltrans or the Agency may have with respect to the Eastern
Corridor and the Foothill Corridor.

Surface Streets. Irvine and Tustin hereby agree to own, operate and maintain their
respective surface streets between the West Leg and I-5 to their respective standards and to
bear all associated costs.

Sienine. Irvine and Tustin agree to institute and maintain, to their respective
standards, sign plans mutually acceptable to Caltrans and Irvine (with respect to signs in
Irvine) and to Caltrans and Tustin (with respect to signs in Tustin) providing adequate signing
directing traffic to and from I-5 and the West Leg within their respective jurisdictions.

Counterparts and Effective Date. This Agreement may be executed in any number
of counterparts, each of which shall be deemed an original; however, all such counterparts
shall constitute but one and the same instrument with the "Effective Date" hereof being the
date first set forth above.
IN WITNESS WHEREOF, the Parties have executed this Agreement as of the date first hereinabove
written.
