SUMMARY: The apProved Tentative Parcel Map 98-161 permitted subdivision of a 4-acre site
betw'e'-&~'Sixth Street and E! Camino Real into two (2) numbered lots for donveyance pUrposes
only. If approved by the City Council, the Final Map may be recorded with the Orange County
Recorders Office.

RECOMMENDATION
That the City Council adopt Resolution No. 98-94 approving Final Parcel Map 98-161.
FISCAL IMPACT
The Final Map is an-applicant-initiated project. The applicant has paid application fees to
recover the cost of processing this application.
DISCUSSION
On August 10, 1998, the-Planning Commission adopted Resolution No: 3604
recommending that the City Council approve Tentative Parcel Map 98-161 for
conveyance purposes. On August 17, 1998, the City Council approved the Tentative
Parcel Map 98,161, by adopting Resolution No.98-75.
The subject site is located in the Multiple-family Residential and the Central Commercial
Parking overlay zoning districts. The site is bordered by Sixth Street on the north, E!
Camino Real on the west and south and Newport Avenue on the east. The site is 4.1
· acres in size, and is currently developed with a fifty-six (56) unit apartment complex .and
approximately 7,200 square feet of retail commercial space. The proposed subdivision
~will divide the existing site into two parcels.

Parcel-1 is planned for re-development that will replace the existing apartment complex
with single family detached residential units. The Redevelopment Agency is currently
working with the applicant and Warmington Homes to redevelop this parcel. A separate
application for Design Review/Zone Change/Tentative Parcel Map in conjunction with site
'redevelopment is being reviewed and will be scheduled for public hearing late this year.
Parcel 2 is planned for a substantial renovation to the existing commercial buildings.
A condition was placed on the Tentative Parcel Map that requires the property owner to
enter into an agreement with the Redevelopment Agency. This agreement obligates the
owner to bdng each parcel into full compliance with the General Plan, Zoning and Uniform
Building Code, and Town Center Redevelopment Plan. It is anticipated that this condition
will be satisfied shortly.
Furthermore, for the purpose of conveyance, the property line between the two parcels is
jogged to address the Zoning and Uniform Building Code setback requirements of the
existing commercial building. A condition was placed on the Tentative Parcel Map that
requires the elimination of the jogged property lines on any subsequent map and the
demolition of the retail building appendage to conform to the Uniform Building Code
requirements.
Staff has determined that the Final Map is in substantial conformance with the Tentative
Parcel Map approvals, the City's Zoning Code and Subdivision Code, and the State
Subdivision Map Act. Based upon this conformance, staff recommends that the City
Council approve Final Parcel Map 98-161.

RESOLUTION NO. 98-94
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, APPROVING FINAL PARCEL MAP 98-161, SUBDIVIDING
A 4-ACRE SITE BETWEEN SIXTH STREET AND EL CAMINO REAL INTO
TVVO (2) NUMBERED LOTS FOR CONVEYANCE PURPOSES ONLY
The City Council of the City of Tustin does hereby resolve as follows:
I. The City Council finds and determines as follows:

That Final Parcel Map 98-161 has been submitted by Debeikes Investment
company, ("the Subdivider");
B.
That a public hearing was held by the Planning Commission on August 10,
1998. At this hearing,' the Planning Commission recommended that.the
City 'Council approve Tentative Parcel Map 98-161. Subsequently, the City
Council approved Tentative Parcel Map 98-161 on August 17, 1998;
C,
Pursuant to Section 15268(b) (Ministerial Projects) of the California
Environmental Quality Act (CEQA), the Final Maps are considered
statutodly exempt from the requirements of CEQA;
Do
That the proposed'subdivision is in substantial conformance with the Tustin
General Plan, the Tustin Zoning Code and Subdivision Map Act subject to
all subdivision bonds as approved by the City Engineer and the City
Attorney;

That the site is physically suitable 'for the type of development proposed;

That. the design of the subdivision or the proposed improvements are not
likely to cause substantial environmental damage or substantially and
avoidably injure fish or wildlife in their habitat;

will not conflict with easements acquired by the public-at-large, for access
through or use of the properb/within the proposed subdivision;

final approval by the City Engineer and the Executive Director of the
