ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE NOTICE OF COMPLETION FOR
MITCHELL AVENUE WIDENING BETWEEN "B" STREET AND NEWPORT AVENUE - COMMUNITY
DEVELOPMENT BLOCK GRANT (CDBG) FUNDING 1997-98 F.Y. (C.I.P. NO. 200032)
SUMMARY I
The Mitchell Avenue Widening Project between "B" Street and Newport Avenue has been completed and the project is ready for
City Council acceptance.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 98-88, accepting said work as complete and authorize the
recordation of the Notice of Completion, and direct the City Clerk to:
1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of
Completion; and
2. Release the Faithful Performance Bond not sooner than one-year after the date of recordation of the Notice of Completion;
and
Assuming no claims or stop notices are filed, it is further recommended that thi .rty-five (35) days after the date of recordation of the
Notice of Completion the City Council authorize payment of the final 10% retention in the amount of $5,855.69 to Crossroads
Engineering, Inc. This amount together with previous payments totaling $52,701.25 represents 100% of the final contract amount.
FISCAL IMPACT
The final cost of construction was $58,556.94 with no contract change orders. The City's 1997-98 F.Y. Capital Improvement
Program/Budgetprovided sufficient funds for the construction with Community Development Block Grant (CDBG) funding.
BACKGROUND
This project provided for street widening along the north side of Mitchell Avenue between "B" Street and Newport Avenue. The
construction consisted of new curb and gutter, sidewalk, drive aprons, catch basins, street pavement and a street light. The work on
this project has been completed by Crossroads Engineering, Inc., to the satisfaction of the EngineeringDivision.

RESOLUTION NO. 98-~o
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING RECORDATION OF THE NOTICE OF COMPLETION
FOR MITCHELL AVENUE WIDENING BETWEEN "B" STREET AND
NEWPORT AVENUE - COMMUNITY DEVELOPMENT BLOCK GRANT
(CDBG),1997-98 F.Y. (C.I.P. NO. 200032)
WHEREAS, Crossroads Engineering, Inc., having a contract with the City of
Tustin to construct the hereinafter described public works and improvement; and
WHEREAS, the City Engineer has duly certified to the construction and
completion of said public improvements hereinafter mentioned in a manner satisfactory to
the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions of
the contract documents and the Notice of Completion, and acceptance of said public work
and improvements should be filed and payment of the balance due said contract authorized
in accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Tustin that said public work and improvement is found to be complete, and the same is
hereby accepted. Said public work and improvement is more particularly described as
follows:
Mitchell Avenue Widening Between "B" Street and Newport Avenue -
Community Development Block Grant (CDBG) 1997-98 F.Y.
(C.I.P. No. 200032)
AND BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin
is hereby authorized to execute.and file a Notice of Completion for the acceptance of said
public works and improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the 19th day of October 1998.
