HUSTON, CITY MANAGER COMMUNITY DEVELOPMENT DEPARTMENT FINAL TRACT MAP 15574 (REILLY HOMES, INC.) SUMMARY: The approved Tentative Tract Map 15574 pemdtted a subdivision to eliminate fourteen (14) planned residential units and construct a comntunity recreation facility within Venturanza del Verde at the northwest comer of Jamboree Road and Robinson Drive. Tentative Tract 15574 was approved by the City Council on March 2, 1998, and included conditions to be fulfilled prior to approval of the Final Tract Map. The conditions have now been fulfilled. If approved by the City Council, the Final Tract Map may be recorded with the Orange County Recorder's Office. AppEcant: Reilly Homes, Inc. RECOMMENDATION That the City Council adopt Resolution No. 98-85 approving Final Tract Map 15574. FISCAL IMPACT The Final Map is an applicant initiated project. The applicant has paid application fees to recover the cost of processing this application. DISCUSSION On February 23, 1998, the Planning Commission adopted Resolution No. 3580 recommending that the City' Council approve Tentative Tract Map 15574. The City Council approved Tentative Tract Map 15574 on March 2, 1998, by adopting Resolution No. 98-17. These approvals included conditions to be met prior to approval of the Final Map. The site is located within the "Venturanza del Verde" project located at the northwest comer of Robinson Drive and Jamboree Road (2834 Ballesteros) within Sector 7 of the East Tustin Specific Plan. The community recreation facility site is located on an interior street within the project and bordered by residential uses on the north, south, east, and west (Attachment A - Location Map). City Council Report Final Tract Maps 15574 September 21, 1998 Page 2 Final Tract Map 15574 provides for the establishment of a recreation facility and elimination of fourteen (14) residential units previously entitled under Tract 13835. A new tract map was required to modify, the existing property rights established under previous Tract Map 13835 (i.e., replacement of fourteen units with a recreation facility on Lot 2); and, to adjust the boundary line between Lots 1 and 2 to accommodate parking adjacent to the facility on Ballesteros Circle (see Attachment B - Tract Map No. 15574). The Final Map is in substantial conformance with the Tentative Tract Map approvals, the East Tustin Specific Plan, the Subdivision Code, and the State Subdivision Map Act. Based upon this conformance, staff recommends that the City Council approve Final Tract Map 15574. '5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP 15574 TO ELIMINATE FOURTEEN (14) PLANNED RESIDENTIAL UNITS AND DEVELOP A COMMUNITY RECREATION FACILITY AT 2834 BALLESTEROS DRIVE WITHIN THE VENTURANZA DEL VERDE PROJECT The City Council of the City of Tustin does hereby resolve as follows: I. The City Council finds and determines as follows: A. That Final Tract Map 15574 has been submitted by Reilly Homes, Inc. ("the Subdivider"); B. That a public hearing was held by the Planning Commission on February 23, 1998. At this hearing, the Planning Commission recommended that the City Council approve Tentative Tract Map 15574. Subsequently, the City Council approved Tentative Tract Map 15574 on March 2, 1998; C, Pursuant to Section 15268(b) (Ministerial Projects) of the California Environmental Quality Act (CEQA), the Final Map is considered statutorily exempt from the requirements of CEQA. D. That the proposed subdivision is in substantial conformance with the Tustin General Plan, the Tustin Zoning Code and Subdivision Map Act; E, The parkland dedication requirement for Tract 13835, as revised by Tentative Tract Map 15574, has been satisfied with the recordation of Tract 12870. The parkland dedication requirement has been reduced from 1.8612 acres to 1.7688 acres; F, That the City has reviewed the status of the School Facilities Agreements between the Irvine Company and the Tustin Unified School District for the impact of Tentative Tract 15574 on School District facilities, and changes in state law. Impacts associated with this approval on School District facilities are adequately addressed; G. That the site is physically suitable for the type of development proposed; H. That the site is physically suitable for the proposed density of development; That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife in their habitat; J. That the design of the subdivision or the type of improvements proposed will not conflict with easements acquired by the public-at-large, for access through or use o.f the property within the proposed subdivision; K. That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems; and, L. That the Final Map is in substantial conformance With the Tentative Tract Map. II. The City Council hereby approves Final Tract Map 15574, subject to final approval by the City Attorney and City Engineer.
