FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS- BAKER PIPELINE BLOW-
OFF EXTENSION TO STORM DRAIN- JAMBOREE ROAD 1625' _+ SOUTH OF
PIONEER ROAD, 1997-98 FY (PROJECT No. 700077)

RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 98-83, accepting
authorize the recordation of the Notice of Completion, and direct the City Clerk to:
said work as complete and

Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation
of the Notice of Completion; and
Release the Faithfial Performance Bond not sooner than one-year after the date of recordation of the
Notice of Completion; and
Assuming no claims or stop notices are filed, it is further recommended that 35 days after the date of recordation of
the Notice of Completion the City Council authorize payment of the final 10% retention in the amount of
$1,514.40 to B.R. Day Construction, Inc. This amount together with previous payments totaling $13,629.60
represents 100% of the final contract amount.
FISCAL IMPACT
The final cost of construction was $15,144.00 with no contract change orders. Adequate funding for this project
was provided in the City's 1997-98 F.Y. Capital Improvement Program Budget with Re-Assessment District 95-1
monies.
BACKGROUND
This project provided for the connection of the existing Municipal Water District of Orange County (MMDOC)
39" Baker Pipeline Blow-off Assembly to the existing storm drain in Jamboree Road. The blow-off assembly was
installed to drain water and/or sediment from the existing 39" pipeline during routine maintenance operations. The
work on this project has been completed by B.R. Day Construction, Inc. to the satisfaction of the Engineering
Division.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA ACCEPTING THE WORKS OF IMPROVEMENT 'AND
AUTHORIZING RECORDATION OF THE NOTICE OF COMPLETION FOR'
BAKER PIPELINE BLOW-OFF EXTENSION TO STORM DRAIN -
JAMBOREE ROAD 1625' _+ SOUTH OF PIONEER ROAD (Project No. 700077)

WHEREAS, B.R. Day Construction, Inc., having a contract with the City of Tustin to
construct the hereinafter described public works and improvement; and
WHEREAS, the City Engineer has duly certified to the construction and completion of
said public improvements hereinafter mentioned in a manner satisfactory to the City Council
of the City of Tustin; and

WHEREAS, the City Council finds that said contractor has completed said public'
improvement hereinafter more particularly described in accordance with the provisions of
the Contract Documents and the Notice of Completion, .and acceptance of said public work
and improvement should be filed and payment of the balance due said contract authorized in
accordance with the Contract Documents;

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin
that said public work and improvement is found to be' complete, and the same is hereby
accepted. Said public work and improvement is more particularly described as follows:
Baker Pipeline Blow-off Extension to Storm Drain- Jamboree Road
1625' + south of Pioneer Road (Project No. 700077)

AND BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is
hereby authorized to execute and file a Notice of Completion for the acceptance of said
public works and improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin
held on the 21 st day of September 1998.
