ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE NOTICE OF
COMPLETION FOR THE "B" 'STREET AND "C' STREET RECONSTRUCTION PROJECTS BETWEEN
FIRST STREET AND IRVINE BOULEXL~RD (C.I.P. NOS. 700151 AND 700150)
SUMMARY
The reconstruction of both "B" Street and "C" Street between First Street and Irvine Boulevard has been
completed and the projects are ready for City Council acceptance.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 98-82 accepting said work as complete and
authorize the recordation of the Notice of Completion and direct the City Clerk to:

Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation
of the Notice of Completion; and
Release the Faithful Performance Bond not sooner than one year after the date of recordation of the
Notice of Completion; and
Assuming no claims or Stop Notices are filed, it is further recommended that 35 days after the date of recordation.
of the Notice of Completion the City Council authorize payment of the final 10% retention in the amount of
$19,155.97 for "B" Street and $15,912.96 for "C" Street for a total of $35,068.93 to Sequel Contractors, Inc. This
amount together with the previous payments of $315,620.37 represents 100% of the final contract amount.
FISCAL IMPACT
The final cost of construction was $191,559.70 for "B" Street and $159,129.60 for "C" Street for a total
construction cost of $350,689.30. The final construction cost for "B" Street included two Contract Change Orders.
Contract Change Order Number 1 was for phasing the construction in order to minimize the inconvenience to the
residents during rainy days and to provide for the 'safe pedestrian passage of school children to and from Helen
Estock Elementary School. Contract Change Order Number 2 covered the cost of adjusting water meter boxes to
finish grade along with a negotiated charge to cover the 90-day maintenance/plant establishment for additional
landscape repair areas.
The final construction cost for "C" Street also included two Contract Change Orders. As with "B" Street, Contract
Change Order Number 1 was for phasing the construction. Contract Change Order Number 2 covered the cost of
three new sanitary sewer manhole covers along with a negotiated cost similar to "B" Street for the 90 day
maintenance/plant establishment.
Adequate funding for these projects was'provided in the City's 1997-98 F.Y. Capital Improvement Program
Budget.
BACKGROUND
These projects provided for the reconstruction of the existing street pavement, curb, gutter, sidewalk and drive
aprons along with the addition of decorative residential street lighting.

RESOLUTION NO. 98-82
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA ACCEPTING THE WORKS OF IMPROVEMENT' AND
AUTHORIZING RECORDATION OF THE NOTICE OF COMPLETION FOR
"B" 'STREET AND "C" STREET RECONSTRUCTION PROJECTS
BETWEEN FIRST STREET AND IRVINE BOULEVARD (C.I.P. NOS. 700151
& 700150)
WHEREAS, Sequel Contractors, Inc., having a contract with the City of Tustin to
construct the hereinafter described public wOrks and improvement; and
WHEREAS, the City Engineer has duly certified to the construCtion and completion of
said public improvements hereinafter mentioned in a manner satisfactory to the City Council of
the City of Tustin; and
WHEREAS, the City Council finds, that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions of the
contract documents and the Notice of Completion, and acceptance of said public work and
imlSrovement should be filed and payment of the balance due said contract authorized in
accordance with the'contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that
said public work and improvement is found to be complete, and the same is Hereby accepted.
Said public work and improvement is more particularly described as follows:
"B" Street and "C" Reconstruction Projects between First Street
and Irvine Boulevard (C.I.P. Nos. 700151 & 700150)
AND BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is
hereby authorized to execute and file a Notice of Completion for the acceptance of said public
works and improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin
held onthe 8th day of September 1998.
