HomeMy WebLinkAbout12 PLANT CONTROL 09-08-98AGENDA DATE: SEPTEMBER 8, 1998 NO. 12 9-8-98 Inter-Com( TO' FROM' SUBJECT: WILLIAM HUSTON, CITY MANAGER PUBLIC WORK DEPARTMENT / FIELD SERVICES CONTRACT RENEWAL FOR LANDSCAPE MAINTENANCE SERVICES WITH PLANT CONTROL LANDSCAPE MAINTENANCE, INC. RECOMMENDATION: It is recommended that the City Council, at their meeting of September 8, 1998, approve the second amendment to the contract agreement between Plant Control Landscape Maintenance, Inc. and the City of Tustin for landscape maintenance services subject to City Attorney approval. FISCAL IMPACT: The proposed 1.8% negotiated adjustment will increase the monthly contract price by $201.20 per month and increase the annual 12-month contract total amount to $136,549.32. The increase in the monthly service fee was anticipated, and incorporated into the 1998/99 Budget. DISCUSSION: The City has contracted with Plant Control Landscape Maintenance, Inc. since August 1, 1996 for maintenance of all General Fund areas including all center islands, and specified City/Water Facilities. The original agreement was for a 1-year period, with 1-year term extension that may be granted for 3 additional years. This contract amendment would extend the agreement for a second time, from July 1, 1998 to June 30, 1999 and would grant the contractor a 1.8% increase in the monthly base price of the contract, effective July 1, 1998. Plant ContrOl Landscape Maintenance, Inc. had requested a 2.1% increase in the contract amount. Staff has negotiated the increase down to 1.8% per the Consumer Price Index for the counties of Los Angeles, Orange and Riverside. The overall increase in the contract price is $201.20 per month or $2,414.40 over a 12-month period. Plant Control Landscape Maintenance, Inc. has provided consistent service of a reasonably high quality for the past 2-years and has been very responsive to correct areas when maintenance was not up to City standards. The implementation of this increase will allow the Contractor to continue to provide the quality and responsiveness the City has received previously. Iim D. Serlet Director of Public Works/City Engineer Wisam Altowaiji Acting Field Services Manager Attachment Field Services Files/Adrnin/Memos/Huston/090$9$ Plant Control Renewal.doc SECOND AMENDMENT TO CONTRACT AGREEMENT THIS SECOND AMENDMENT is entered into this day of ., 1998, by and between the City of Tustin, a Municipal Corporation (herein referred to as "City"), and Plant Control Landscape Maintenance, Inc., a California corporation, (herein referred to as "Contractor"). This Amendment is made with reference to the following: RECITALS A. WHEREAS, City and Contractor entered into an Agreement dated November 11, 1996, the "Agreement", wherein Contractor agreed to perform landscape maintenance services in accordance with the agreement and specifications entitled "Landscape Maintenance Services for General Fund Areas, Senior Center and Maintenance Facility"; B. WHEREAS, City and Contractor entered into the First Amendment to that Agreement on November 20, 1997; C. . WHEREAS, the initial term of the Agreement was one year, with the option to be extended for three additional one-year terms by written agreement of the parties; D. WHEREAS, City and Contractor desire to exercise the extension clause pursuant to Section B, Page B-2, Paragraph 4, Item B, to extend the Agreement for one year; E. WHEREAS, City and Contractor also desire to adjust Contractor's compensation under the Agreement to reflect the increase in the consumer price index for the counties of Los Angeles, Orange and Riverside. AGREEMENT The Agreement is hereby amended as follows: A. The term of the Agreement is extended for one year, through June 30, 1999, unless sooner terminated pursuant to Section B, Page B-32, Item 48 of the Agreement. B. City shall pay Contractor the following sums for the periods indicated: 1. From July 1, 1998 to June 30, 1999, the City shall pay the Contractor, on a monthly basis, an amount equal to $11,379.11. 2. City shall pay the Contractor a sum not to exceed $136,549.32 for the period from July 1, 1998 to June 30, 1999. C. Except as expressly amended by this Second Amendment, all other terms and conditions of the Agreement and all attachments and exhibits thereto, shall remain in full force and effect.
