FISCAL IMPACT The Tentative Parcel Map is an applicant initiated project. The applicant has paid application fees to recover the cost of processing this application. DISCUSSION The 4.1-acre site is currently developed with a fifty-six (56) unit apartment complex and approximately 7,200 square feet of retail commercial space. Parcel-1 is planned for redevelopment that will replace the existing apartment complex with single family detached residential units. Parcel 2 will include substantial renovation to the existing commercial buildings. On August 10, 1998, the Planning Cornmission adopted Resolution No. 3604 recornrnending that the City Council approve Tentative Parcel Map 98-161 for conveyance purposes only (Attachment- A). No new development is proposed as part of this project. City Council Report TPM 98-161 August 17, 1998 Page 2 Parcel- 1 is currently being reviewed by staff and will be scheduled for public hearings this fall. The subdivision is for conveyance purposes only and is the first of several actions that the City Council will consider on this property related to these efforts. Parcel 1 is approximately 3.25 acres in size and will have street frontage along Sixth Street. Parcel 2 is approximately 0.86 acres in size with street frontage along E1 Camino Real and is currently developed with two commercial buildings. For the purpose of this subdivision, the property line division between the two parcels is jogged to address the Zoning and Uniform Building Code setback requirements of the existing commercial building. Condition 2.1 has been included to require the owner to enter into an agreement with the Redevelopment Agency for compliance of each parcel with the General Plan, Zoning, Uniform Building Code and Town Center Redevelopment Plan within 6 months of recordation of the map. Condition 2. lA has been included to require elimination of the jog in the property line and demolition of the retail building's appendage to conform to the Uniform Building Code requirements for any subsequent map. The existing development provides reciprocal parking between the commercial and residential components of the site. Condition 2. lB has been included that would require releasing reciprocal access and parking easements between two parcels upon any future subdivisions. Planning Commission Secretary EXHIBIT A TENTATIVE PARCEL MAP 98-161 RESOLUTION NO. 3604 CONDITIONS OF APPROVAL GENERAL (1) 1.1 Within 24 months from tentative map approval, the Subdivider shall record with appropriate agencies, a final map p.repared in accordance with subdivision requirements of the Tustin Municipal Code, the State Subdivision Map Act, and applicable conditions contained herein unless an extension is granted pursuant to Section 9321.H of the Tustin Murficipal Code· (5) (1) 1.2 The subdivider shall conform to all applicable requirements of the State Subdivision Map Act and the City's Subdivision Ordinance. ' .. · · 1.3 As required by the Subdivision Map Act, the subdivider shall furnish the City security guaranteeing the setting of the monuments for this parcel map. It is recommended that a cash deposit be provided at this time as a new subdivision is being proposed over Parcel One (1) of this parcel map. If the new subdivision is. not approved within one (1) year, monumentation of this parcel will be required. Additional specific provisions shall be included in any agreement that: A· The jog in the property line dividing two parcel reflects the setback requirements of the existing buildings.
