REGULAR MEETING OF THE CITY COUNCIL
CITY OF TUSTIN, CALIFORNIA
MAY 5, 1997
CALL TO ORDER/PLEDGE OF ALLEGIANCE
The meeting was called to order by Mayor Thomas at 7:00 p.m. at the
Council Chambers, 300 Centennial Way, Tustin, California. The Pledge of
Allegiance was led by Councilmember Potts.

:The Invocation was given by Dr. Lloyd Strelow, Peace Lutheran Church.

PROCLAMATIONS
ANTI -GRAFFITI POSTER CONTEST WINNERS
Mayor Thomas read and presented proclamations to Anti Graffiti
Poster Contest winners: Tavia Bulman, First Place fourth grade
winner at Veeh Elementary School; Anthony Carlos, First Place
third grade winner at Heideman Elementary School; and Mynor
Revolorio, First Place tenth grade winner at Foothill High School.
Sue Pflomm, Tustin Pride Committee, said the Anti Graffiti posters
would be on display through August at various locations in the
City including the Senior Center Art Gallery, City Hall, and the
Tustin Family and Youth Center.
TUSTIN HIGH SCHOOL UNITED NATIONS TEAM
Mayor Thomas read and presented a proclamation to the following
Tustin High School Model United Nations Team Members, winners of
the Best Delegation Award at the 7th Annual Bath, England, Model
United Nations Conference: Don Anthony, Matt Ching, Paul Collins,
Hanh Dao, Robert Flowers, Phil Gruber, Madeline Lee, Sarah
Stockwell, Tim Thurston, Brion Vibber, David Waldram, advisors
Mimi Kroll and Linda Levine, and parents Karen Ching and Kimberly
Do.
Mayor Thomas read and presented a proclamation to the following
Tustin High School Model United Nations Team Members, winners of
the Outstanding Delegation Award at the 45th Annual University of
California at Berkeley Model United Nations Conference: Andres
Barcenas, Julie Bell, Doug Boutwell, Robert Cruickshank, Kelly
Flint, Brian Forde, Lisa Hadad, Eleanor Isenhour, Kai Kaahaaina,
Susan Lee, Alison Moody, My Le Nguyen, Chenin Rose, Aaron Sizer,
Amber Vann, Loc Van, Duane Williams, Shanta Wilson, advisors Bryan
Levine and Maura Mattson, and parent Linda Rose.

Robert Cruickshank, Berkeley team representative, stated that the
team enjoyed the competition and visiting the City of Berkeley;
and noted that all team members had been honored individually
during the conference.
David Waldrum, England team representative, stated that their team
had competed in an international contest; the conference had been
exciting; and noted the team had toured London and Paris, France.
A Tustin High School representative, noted former Mayor, Leslie
Pontious, joined the team in Bath, England, and that she had
exchanged plaques with the Mayor of Bath.
Leslie Pontious said that it had been a great experience observing
the team during the competition; noted the Bath, England, Mayor
wore an identifying mayoral emblem; thanked Council for
recognizing the team; and stated the team had honorably
represented the City during the competition.

PUBLIC INPUT
TUSTIN PRIDE PROGRAMS
Tim Curry, Tustin Pride Committee, reported that future Tustin
Pride programs included landscape recognition and Angels in
Tustin.
PUBLIC HEARING (ITEM 1)
1. VESTING TENTATIVE TRACT MAP NO. 15427 MAYWOOD)
Dan Fox, Senior Planner, reported that the subject property was
located at the southeast corner of Irvine Boulevard and Tustin
Ranch Road; the site was approximately 5.9 acres; the applicant
was proposing to subdivide the property to create 53 single family
dwelling units at a density of 9 dwelling units per acre; the
development agreement amendments required the property be
developed as townhomes or single family residences; the land use
designation allowed 16 dwelling units per acre; the project was
significantly below the allowable density; the proposed product
was single family detached units; and the Planning Commission had
approved a conditional use permit to utilize cluster development
standards and recommended approval of the project.
Council/staff discussion followed clarifying that no parking was
allowed in the project's alleys.
Mayor Thomas opened the Public Hearing at 7:20 p.m. There were no
speakers on the subject and the Public Hearing was closed.
It was moved by Potts, seconded by Worley, to adopt the following
Resolution No. 97-34 approving the Environmental Determination for
the project:
RESOLUTION NO. 97-34 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, FINDING THAT THE FINAL ENVIRONMENTAL
IMPACT REPORT (EIR) PREPARED FOR THE EAST TUSTIN SPECIFIC PLAN
(FINAL EIR 85-2, AS MODIFIED BY SUBSEQUENTLY ADOPTED SUPPLEMENTS
AND ADDENDA) IS ADEQUATE TO SERVE AS THE PROGRAM EIR FOR VESTING
TENTATIVE TRACT MAP NO. 15427, APPLICABLE MITIGATION MEASURES HAVE
BEEN INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL
QUALITY ACT
Motion carried 5-0.
Councilmember Worley stated she was pleased that a pool and tot
lot were proposed for the project.
It was moved by Potts, seconded by Worley, to adopt the following
Resolution No. 97-35 approving Vesting Tentative Tract Map No.

RESOLUTION NO. 97-35 - A RESOLUTION OF THE CITY COUNCIL OF THE

Items No. 11 and 12 were removed from the Consent Calendar by
Councilmember Worley. It was moved by Worley, seconded by Potts, to
approve the remainder of the Consent Calendar as recommended by staff.

2.
APPROVAL OF MINUTES - APRIL 21, 1997 REGULAR MEETING
Recommendation: Approve the City Council Minutes of April 21,
1997.
3.
APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL
Recommendation: Approve Demands in the amount of $1,488,794.75
and ratify Payroll in the amount of $396,492,54. 380-10

4.
APPOINTMENT OF NEW MEMBER FOR TUSTIN PUBLIC INFORMATION, INC.
Recommendation: (1) Remove Susan Jones, former Recreation
Superintendent and Christine Carpenter, former Recreation
Coordinator in Community Services, from Tustin Public Information,
Inc. Board of Directors; and (2) Appoint Nanette Turner,
Recreation Coordinator, as a Board Member of Tustin Public
Information, Inc. as recommended by the Community Services

TERM EXPIRATIONS FOR COMMISSIONS/COMMITTEES
Recommendation: Direct staff to issue a press release seeking
candidates to serve on the Audit Committee, Planning Commission,
Parks and Recreation Commission, Tustin Community Foundation
Board, and Cultural Resources Advisory Committee as recommended by

PLANNING COMMISSION ACTION AGENDA - April 28, 1997 120-50
All actions of the Planning Commission become final unless
appealed by the City Council or member of the public.
Recommendation: Ratify the Planning Commission Action Agenda of

FINAL COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) ONE-YEAR ACTION
PLAN FOR FISCAL YEAR 1997-98
Recommendation: Adopt the Final Community Development Block Grant
(CDBG) one-year Action Plan and authorize transmittal to the U.S.
Department of Housing and Urban Development (HUD) for review and
approval as recommended by the Community Development Department.

RESOLUTION NO. 97-33 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP NO. 14901 TO
SUBDIVIDE 14 ACRES INTO 8 LOTS, LOCATED AT THE SOUTHWEST CORNER OF
JAMBOREE ROAD AND IRVINE BOULEVARD
Recommendation: Adopt Resolution No. 97-33 approving Final Tract

RESOLUTION NO. 97-37 - A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF TUSTIN, CALIFORNIA, AUTHORIZING THE DEPARTMENT OF GENERAL
SERVICES OF THE STATE OF CALIFORNIA TO PURCHASE CERTAIN ITEMS
Recommendation: Adopt Resolution No. 97-37 authorizing the
General Services Department of the State of California to purchase
a current model year Ford pickup truck on behalf of the City as
recommended by the Public Works Department/Field Services

10. DENIAL OF CLAIM NO. 97-10, CLAIMANT: JOSEPH AND HEATHER DIEMERT
Recommendation: Deny subject claim and direct the City Clerk to
send notice to the claimant and claimant's attorney as recommended
by the City Attorney. 180-10

CONSENT CALENDAR ITEMS NO. 11 AND NO. 12 - DENIAL OF CLAIM NO. 97-12,
CLAIMANT: DANIEL ALEJANDRO; AND DENIAL OF CLAIM NO. 97-13, CLAIMANT:
JEANETTE AND CHARLENE AMOROSA
Councilmember Potts remarked on the lack of knowledge by the claimants'
attorneys because both incidents had occurred outside the City's
jurisdiction.
Councilmember Worley noted that one claim occurred in the County of Orange
and the other occurred on Tustin Unified School District property; and
questioned City reimbursement of costs and expenses incurred as a result
of the claim filings.
Ken Smart, Assistant City Attorney, clarified that lawsuits had not been
filed against the City regarding these matters; the recommended action
requested Council denial of the claims; and he explained the Code of Civil
Procedure regarding cost recovery incurred by filing frivolous actions.
Council/staff discussion followed regarding the failure of cities to
recover costs on lawsuit/claim filings.
It was moved by Potts, seconded by Worley, to deny subject claims and
direct the City Clerk to send notices to the claimants and claimants'
attorneys.
Motion carried 5-0.
REGULAR BUSINESS (ITEMS 13 THROUGH 14)
13. QUARTERLY INVESTMENT REPORT

subject report.

14. REQUEST FOR FUNDING, TUSTIN AREA HISTORICAL SOCIETY
Mayor Thomas clarified that the amount requested by the Tustin
Area Historical Society was $5,700.
It was moved by Potts, seconded by Doyle, to appropriate $5,700 to
the Tustin Area Historical Society for annual rent.

David Bryant, Tustin Area Historical Society President, stated
that the Historical Society's request of $5,700 would pay the
annual building rent; Carol Jordan's book, "Tustin: A City of
Trees," sold enough copies to allow the Historical Society to
purchase a computer; Linda Jennings was the Historical Society
director; the Historical Society had new industrial sponsors; this
year's Home and Garden Tour successfully surpassed past tours; he
noted the cooperation between the City and Historical Society;
explained the significance of the Historical Society's local
history museum to elementary school classes; the Historical
Society's development of a local area history program for school -
site presentations; and he commended Council for supporting the
community.

OTHER BUSINESS
TUSTIN HIGH SCHOOL BASEBALL TEAM CASINO NIGHT
Councilmember Doyle reported that Tustin High School's Baseball
team had a successful Casino Night.
Councilmember Potts stated that he had been out of town and unable
to attend the Baseball Casino Night.

SANTA COP CASINO NIGHT
Councilmember Doyle reported the Tustin Police Department's Santa
Cop Casino Night would be held May 31, 1997, and explained the
importance of the Santa Cop program.
LOU BONE - CHAMBER OF COMMERCE PRESIDENT
Councilmember Potts reported that Lou Bone had been selected as
President of the Chamber of Commerce.
TUSTIN HARDWARE CLOSING
Councilmember Worley reported that she was sad to hear Tustin
Hardware was closing and wished owner, Dave Vandaveer, success in
the future.
LA COLINA AVENUE CLOSURE
Councilmember Worley announced that the County of Orange was
considering partial closure of La Colina which would force
increased traffic on Browning Avenue; closure would pose potential
safety hazards for students at Tustin Memorial School; the City
was opposed to the closure; the City would be represented at the
County hearing on May 16, 1997; and she and Mayor Pro Tem
Saltarelli were meeting with Supervisor Spitzer on the matter.
GRANT SALTARELLI
Mayor Pro Tem Saltarelli welcomed his son, Grant, to the Council
meeting.
Mayor Thomas reported that Grant Saltarelli had obtained his
driver's license.
ORANGE COUNTY SANITATION DISTRICT
Mayor Pro Tem Saltarelli gave a status report on the Sanitation
District's consolidation; the necessity to increase rates for
funding infrastructure improvements; and the increased rates would
have minimal impact on Tustin.
TUSTIN WOMEN IN CHAMBER FASHION SHOW
Mayor Thomas reported he enjoyed attending the Tustin Women in
Chamber Fashion Show.
HAPPY MOTHER'S DAY
Mayor Thomas wished everyone a happy Mother's Day.
IRVINE RANCH WATER DISTRICT WATER AUDIT
Mayor Thomas reported that the Irvine Ranch Water District had
performed a thorough water audit at his residence and he
recommended residents take advantage of this extensive service to
avoid possible water use penalties.
OLDER AMERICANS MONTH
Mayor Thomas reported that May was "Older Americans Month,"
suggested honoring Tustin's oldest citizens, and requested staff
assistance with identification of those individuals.
SR -55 FREEWAY CONSTRUCTION
Councilmember Worley questioned if the Orange County Transit
Authority construction on the SR -55 Freeway between 17th Street
and the 22 Freeway had been suspended.
William Huston, City Manager, stated staff would investigate the
matter.

BASEBALL PLAYER'S DEATH
Councilmember Worley commented on the recent death of a teenage
baseball player.
EASTERN TRANSPORTATION CORRIDOR CONSTRUCTION MEETING
Mayor Pro Tem Saltarelli reported on his attendance at the Eastern
Transportation Corridor construction meeting and noted that the _
Homeowner Associations expressed concern with the lack of funding
to landscape the project.
Councilmember Potts, Corridor Agency Representative, stated that
OCTA/TCA would be exploring funding for landscaping.
COMMITTEE REPORTS
ORANGE COUNTY FIRE AUTHORITY
Councilmember Worley reported that the Orange County Fire
Authority had approved a fee increase as a cost recovery measure;
and the Fire Authority Board was continuing study of the ambulance
service issue with an expected vote in August.
CLOSED SESSION
Mayor Thomas announced that the City Council would convene in closed
session to confer with the City Attorney regarding the initiation of
litigation (one case) pursuant to Government Code Section 54956.9(c).
PROCLAMATION (Agenda Order)
MIRE CICCHESE, FORMER TUSTIN WEEKLY REPORTER
This item was taken out of agenda order at the request of Mayor
Thomas.
Mayor Thomas read and presented a proclamation to former Tustin
Weekly reporter, Mike Cicchese.
Mike Cicchese thanked Council for the proclamation and stated that
he believed accepting the new position was a wise career move.
Mary O'Rourke, 14611 Westfall, Tustin, commended Mike Cicchese for
the support, valuable assistance, and compassionate news article
given to her family during her son's losing battle with cancer.
Council complimented Mr. Cicchese on his impartial, well-written,
and compassionate reporting style.
Mayor Thomas adjourned the meeting at 7:58 p.m. The next regular meeting
of the City Council was scheduled for Monday, May 19, 1997, at 7:00 p.m.
in the Council Chambers at 300 Centennial Way.
CLOSED SESSION STATEMENT
It was moved and seconded to authorize the engagement of special legal
counsel Rosenthal and Zimmerman to represent the City of Tustin as an
intervenor in the El Toro Airport EIR litigation. C0_10
