AMENDMENT TO THE 1994-95; 1995-96 AND 1996-97 ACTION
PLANS FOR FEDERAL COMMUNITY DEVELOPMENT BLOCK.
GRANT (CDBG) FUNDS
SUMMARY: The Community Development Department is proposing to amend the 1994-
95, 1995~96 and 1996-97 Action Plans by reallocating/redistributing funds between
previously approved activities.
RECOMMENDATION
That the City Council adopt Resolution No. 98-60 amending the Action Plans for Fiscal
Year 1994-95, 1995-96 and 1996-97.
FISCAL IMPACT
The proposal involves the reallocation or redistribution of CDBG funds between
previously approved projects. No impacts to the General Fund are anticipated.
PROPOSED AMENDMENTS / FUNDS REALLOCATIONS
The Housing and Community Act-of 1974, as amended, created the Community
Development Block Grant (CDBG) program to return federal funds to local communities
for the purpose of developing viable urban communities by providing adequate housing,
a suitable living environment, and by expanding economiC opportunities, specifically for
Iow and moderate income persons.
In May of each fiscal year, the City submits to U.S. Department of Housing and Urban
Development (HUD) a one-year Action Plan. The Action Plan describes the activities
that the City will undertake during the program year to address the priority needs of
housing and community development. The Action Plan also describes program budget
for disbursement of CDBG funds to the activities that will be undertaken during the fiscal
year.
The Community Development Department is proposing' to amend the submitted Action'
Plans by reallocating funds from previously approved activities to existing activities that
need additional funding. The amendment involves activities that had been completed

where there are excess 'or unused funds available for re-programming. These excess or
unused funds Will be allocated to three priority projects. The projects are as follows: (1)
Senior Center Rehabilitation which needs additional funding for re-carpeting; (2)
Mitchell Avenue Reconstruction which needs additional fimds to cover contingency,
construction engineering and inspection costs; and (3) Valencia/Armstrong Street
Construction which requires additional funding for construction of the entire street
through-out the MCAS-Tustin base.
The following delineates the distribution of unused CDBG funds to the above activities:

Fiscal Year 1995-96

No. 080-400-9999-6018-700140) to Valencia/Armstrong Avenue activity (Account
No. 080-400-9999-5124-700139) - Amount $12,050.20.
From Mitchell Avenue (right of way acquisition) activity (Account No. 080-400-
9999-6018-700140) to Senior Center Rehabilitation activity (Account No. 080-400-
9999-9255-200033)- Amount $20,000.
From Mitchell Avenue (right of way acquisition) actiVity (Account No. 080-400-
9999-6018-700140) to Mitchell Avenue (construction) activity (Account No. 080-
400-9999-9530-200032) - Amount $10,000.

The proposed amendments will offset some of the budget shortfalls for the three
mentioned activities. The City also will be able to fund activities that otherwise may not
be realized until other funding resources are secured.

A RESOLUTION OF THE CITY coUNcIL OF THE CITY OF
TUSTIN, CALIFORNIA, APPROVING AN AMENDMENT TO
THE CITY'S 1994-95, 1995-96 AND 1996-97 ACTION PLANS
FOR COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS
AND AUTHOR/ZING SUBMISSION OF THE AMENDMENT
TO THE FEDERAL DEPARTMENT OF HOUSING AND
URBAN DEVELOPMENT.
WHEREAS, under the Housing and Community Development Act'of 1974, as
amended, Federal assistance may be provided for the support of community development
activities which are directed toward certain specific objectives as set forth, in the Act as
the Community Development Block Grant (CDBG) Program; and
WHEREAS, previously funded activities had been completed, and a portion of
funds remain unexpended; and
WHEREAS, it is important that the City of Tustin expend CDBG funds
expeditiously; and
WHEREAS, monies must be formally reallocated to other eligible activities prior
to expenditures; and
WHEREAS, citizens were notified of the propOsed changes in use of CDBG
funds through an advertisement published in the local newspaper; and
WHEREAS, a staff report has been prepared recommending the proposed funding
reallocations; and
WHEREAS, a public hearing to obtain the view of citizens on the amended one-
year Action Plans was held by the City Council on July 20, 1998.
NOW THEREFORE BE IT RESOLVED, the City Council of the City of Tustin
resolves as follows:

Section 2: Staff is hereby directed to prepare and submit the amended Action
Plans to the Federal Department of Housing and Urban Development reflecting Council's
direction for the City's funding allocations to eligible program activities.
Section 3: The City Manager of the City of Tustin or his designated
representative, such as the Director of Community Development, is authorized to execute
documents, certification, contracts or other instruments as may be required to carry out
the City's Community Development Block Grant Program.
PASSED and ADOPTED by the City Council of the City of Tustin this 20th day
of July, 1998.
