2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, RECERTIFYING THE FINAL NEGATIVE
3 DECLARATION, AS MODIFIED, AS ADEQUATE FOR
CONDITIONAL USE PERMIT 93-038 AND DESIGN REVIEW 93-
4 040 INCLUDING REQUIRED FINDINGS PURSUANT TO THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT.

The City Council of the City of Tustin does hereby resolve as
6 follows:
7 The Planning Commission finds and determines as follows:
8 A. The request to approve Conditional Use Permit 93-
038 and Design Review 93-040 are considered
9 "projects" pursuant to the terms of the California
Environmental Quality Act.

B. A Negative Declaration has been prepared for this
11 project and has been distributed for public review.
12 C. Whereby, the Planning Commission and City Council
of the City of Tustin has considered evidence
13 presented by the Community Development Director and
other interested parties with respect to the
14 subject Negative Declaration.
15 D. The City Council has evaluated the proposed final
Negative Declaration and determined it to be
16 adequate and complete, as modified.
17 II. A Final Negative Declaration has been completed in
compliance with CEQA and State guidelines. The City
18 Council, having final approval authority over Conditional
~ Use Permit 93-038 and Design Review 93-040 has received
19 and considered the information contained in the Negative
~ Declaration, prior to approving the proposed project, and
20 found that it adequately discussed the environmental
effects of the proposed project. The City Council has
21 found that the project as conditioned involves no
potential for an adverse effect, either individually or
22 cumulatively, on wildlife resources and makes a De
Minimis Impact Finding related to AB3158, Chapter 1206,
23 Statutes of 1990. On the basis of the initial study and
comments received during the public review process, the
24 City Council has found that although the proposed project
could have a significant effect on the environment, there
25 will not be a significant effect on it in this case
because mitigation measures identified in the Negative

Declaration and as modified by the City Council have been
3 incorporated into the project which mitigate any
potential significant environmental effects to a point
4 where clearly no significant effect would occur and are
adoptedas findings and conditions of Resolution No. 94-
5 82, incorporated herein by reference. In particular, the __
City Council finds that the project will have a
6 significant adverse effect on traffic circulation along
the E1 Camino Real frontage and that the dedication of
7 additional right-of-way will mitigate such impacts to a
level of insignificance.

PASSED AND ADOPTED at a regular meeting of the Tustin City
9 Council, held on the 18th day of July, 1994.
