FINAL TRACT MAP 15563 (IRVINE COMMUNITY DEVELOPMENT COMPANY)
SUMMARY: The approved Tentative Tract Map 14396 (parent nmp) permitted a subdivision
to accommodate 113 single-fatnily detached sites, a 20 acre intermediate school site and an 8
acre equestrian center site in the Estate Density Residential Designation of East Tustin, on
the we~t side of Tustin Ranch/Pioneer/Peters Canyon Roads. Tentative Tract Map 14396
included numerous conditions to be fulfilled prior to approval of a Final Map. The applicant
intends to file multiple maps as permitted by the Subdivision Map Act. Tile conditions for
the first of two final maps (Tract 15563) have now been fulfilled. If approved by the City
Council, the first Final Map may be recorded with the Orange County Recorder's Office.

RECOMMENDATION
That the City Council adopt Resolution No. 98-65 approving Final Tract Map 15563.
FISCAL IMPACT
The Final Map is an applicant initiated project. The applicant has paid application fees to
recover the cost of processing this application.
DISCUSSION
On August 11, 1997, the Planning Commission adopted Resolution No. 3539
recommending that the City Council approve Tentative Tract Map 14396 (parent map).
The City Council approved Tentative Tract Map 14396 on August 18, 1997 by adopting
Resolution No. 97-86. These approvals included numerous conditions to be met prior to
approval of the Final Map. Tentative TraCt '14396 includes 115 numbered lots and 33
lettered lots to accommodate 113 single family home sites, a 20 acre intermediate school
site, and an 8 acre equestrian facility on a 205 gross acre site. The site is located west of
Tustin Ranch, Pioneer and Peters Canyon Roads (See Location Map).

As permitted by the Subdivision Map Act, the developer intendS to record the subdivision
in multiple maps. Each phase will 'be recorded as a separate Final Map in the following
sequence:
Phase 1 - Tract 15563 - PropOsed
Phase 2- Tract 14396
Final Map'15563 consiSts of 106 acres and includes 47 numbered lots and 21 lettered
lots. Final Map 15563 is shown in context with the overall project on the attached
Phasing Plan (Attachment A).
Condition 2.9 of Planning Commission Resolution 3539 requires that a deed restriction
prohibiting parking on certain streets be recorded prior to final map approval. The
applicant has agreed to defer the fulfillment of this condition until the Design Review for
the individual houses are approved (DR 98,015), which proposes to modify some of the
streets to provide parking on-street. If a deed restriction were recorded at this time, the
applicant would need to record additional restrictions removing the parking restrictions on
certain lots.
Two additional lettered lots (T and U) have been created. Lot T is a priVate drive to
provide access to Lots 28 and 29. The need for this private drive was identified during
building plan check to provide appropriate access to the individual lots as required by the
East Tustin Specific'Plan. Lot U is a landscape lot which includes improvements from a
countY resident which encroach into this development. Consistent with the treatment of
other encroachments along the County border, the applicant intends to create separate
lettered lots and convey them to the respective county resident.
With the additions noted above, staff has determined that the Final Map is in substantial
conformance with the Tentative Tract. Map approvals, the East Tustin Specific Plan, City's
Zoning Code and Subdivision Code, and the State Subdivision Map Act. Based upon this
conforman..ce, staff recommends that the City Council approve Final Tract Map 15563.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN APPROVING
FINAL TRACT MAP 15563, THE FIRST OF TWO FINAL MAPS FOR TENTATIVE
TRACT 14396, LOCATED LOTS 12, 13, 24 AND 25 OF TRACT 13627
The City Council of the City of Tustin does hereby resolve as follows:
I. The City Council finds and determines as follows:
A. That Final Map 15563 has been submitted by. Irvine Community
Development Company;
B,
That a public hearing was duly called, noticed and held for Tentative Tract
Map 14396 on August 11, 1997. At this hearing, the Planning Commission
recommended that the City Council approve said map. Subsequently, the
City Council approved Tentative Tract Map 14396 on August 18, 1997;
C,
That, pursuant to Section 66456.1 of the SubdiVision Map Act, the
Subdivider intends to file multiple final maps in relation to approved Tentative
Tract Map. 14396. Final Tract Map 15563 is the first of such final maps;
D. Pursuant to Section 15268(b) (Ministerial Projects) of the California
Environmental Quality Act, the Final map is considered statutodly exempt
from the requirements of CEQA;
E,
That the proposed subdivision is in conformance with the Tustin Area
General Plan, adopted East Tustin Specific Plan, Development Agreement
as amended and Subdivision Map Act as it pertains to the development of
single-family dwellings;'
F. The 1.4238 acres of parkland reqUired for this development was previously
dedicated with recordation of Tract 13627;
G.'That the City has reviewed the status of the. School Facilities Agreement
between the Ir~ine Company and the Tustin Unified School District, for the
impact of Tentative Tract 14396 on School District facilities, and changes in
state law. The impacts associated with this approval on School District
Facilities are adequately addressed;
H. That the site is physically suitable for the type of development proposed;
I. That the site is physically suitable for the proposed density of development;

J.
That the design of the subdivision or the proposed improvements are not
likely to cause substantial environmental damage or substantially and
avoidably injure fish or wildlife in their habitat;
K.
That the design of the subdivision or the type of improvements proposed will
not conflict with easements acquired by the public, for access through or use
of the property within the proposed subdivision;
L. That the design of the subdivision or the-types of improvements proposed
are not likely to cause serious public health problems;
M. The proposed project has been determined to be exempt from the provisions
of Measure "M" because entitlements specified in the East .Tustin
Development Agreement entered into in 1985, and the estimated project
generated traffic does not cause the roadway system to exceed established
level of service standards;
N. That the Final Map is in substantial conformance with the Vesting Tentative
Map.
II. The City Council hereby approves Final Map 15563, subject to final approval by the
City Engineer.
PASSED AND ADOPTED at a regular meeting of the Tustin City Council, held on the
20th day of July, 1998.
