HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE NOTICE OF COMPLETION FOR THE RED HILL AVENUE PEDESTRIAN IMPROVEMENTS AT OCTA/SCRRA RAILWAY AND F-10 CHANNEL AREA (C!P NO. 700!44~. SUMMARY Construction of the Red Hill Avenue Pedestrian Improvements at the OCTA/SCRRA Railway and the F-10 Channel area have been completed and the project is ready for citY Council acceptance. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 98-62 accepting the improvements for the Red Hill Avenue Pedestrian Improvements at OCTA/SCRRA Railway and F- 10 Channel area as complete and authorize the recordation of the Notice of Completion and direct the City Clerk to: 1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion; and 2. Release the Faithful Performance Bond not sooner than one year after the date of recordation of the Notice of Completion; and Assuming no claims or stop notices are filed, it is further recommended that 35 days after the date of recordation of the Notice of COmpletion the City Council authorize payment of the final 10% retention in the amount of $8,311.70 to Hondo Company. This amount together with the previous payments of $74,805.30 represents 100% of the final contract amount. FISCAL IMPACT The final cost of construction is $83,117.00. The final construction cost includes one contract change order Of $15,695.00 for: E~ctra bollards, extra curbing near Cookies Restaurant, pavement for the countY flood control driveway, additional chain link fencing, relocation of a drainage facilitY, modification of the abutment retaining facilities, and additional traffic control to accommodate the above construction activities. Adequate funding for this project is provided in the 1997-9'8 F.Y. Capital Improvement Program budget. BACKGROUND This project provides for a pedestrian bridge across the Santa Ana-Santa Fe (F- 10) Flood Control Channel west of Red Hill AvenUe and an all-weatherpedestrian walkway across the OCTA/scRRA Railway tracks. These improvements provide continuous pedestrian and bicycle access along the west side of Red Hill Avenue thereby relieving pedestrians and bicyclists from having to walk into the roadway. As part of these improvements, the sidewalk on the east side of' Red Hill Avenue has been closed to pedestrian traffic and signs have been installed to direct pedestrians to use the west side of Red Hill Avenue in this area. NO. 700144) WHEREAS, Hondo Company having a contract with the City of Tustin to construct the hereinafter described public works and improvements; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvements hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in acCordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public work and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents; ... NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public work and improvement is found to be complete, and the same is hereby accepted. Said public work and improvement is more particularly described as follows: Red Hill Avenue Pedestrian Improvements at OCTA/SCRRA Railway and F-10 Channel Area. (C.I.P. No. 700144) AND BE IT FURTHER RESOLVED that the City Engineer of the City of TUstin is hereby authorized to execute and file a Notice of Completion for the acceptance of said Public works and improvement described herein as required by 1aw.
