2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN, CERTIFYING THE FINAL NEGATIVE DECLARATION
3 AS ADEQUATE FOR VESTING TENTATIVE TRACT MAP 14914
INCLUDING REQUIRED FINDINGS PURSUANT TO THE
4 CALIFORNIA ENVIRONMENTAL QUALITY ACT.
5 The City Council of the Cityof Tustin does hereby resolve as
follows:
~ 6
The City Council finds and determines as follows:
7
A. The request to approve Vesting Tentative Tract Map
8 14914 is considered a "project" pursuant to the
terms of the California Environmental Quality Act.
9
B. A Negative Declaration has been prepared for this
10 project and has been.distributed for public review.
11 C. Whereby, the Planning Commission and the City
Council of the City of Tustin have considered
12 evidence presented by the Community Development
Director and other interested parties with respect
13 to the subject Negative Declaration.
14 D. The Planning Commission and City Council have
evaluated the proposed final Negative Declaration
15 and determined it to be adequate and complete.
16 II. A Final Negative Declaration has been completed in
compliance with CEQA and State guidelines. The City
17 Council, having final authority over Vesting Tentative
Tract Map 14914 has received and considered the
18 information contained in the Negative Declaration, prior
~. to approving the proposed project, and found that it
~ 19 adequately discussed the environmental effects of the
! proposed project. The City Council has found that the
20 project involves no potential for an adverse effect,
either individually or Cumulatively, on wildlife
21 resources and makes a De Minimis Impact Finding related
to AB3158, Chapter 1206, Statutes of 1990. On the basis
22 of the initial study and comments received during the
public review process, the City Council has found that,'
23 although the proposed projects could have a significant
effect on the environment, there will not be a
24 significant effect on it in this case because mitigation
measures identified in the Negative Declaration have been
25 incorporated into the project which mitigate any
potential significant environmental effects to a point
26 where clearly no significant effect would occur and are
~ identified in Exhibit A to the attached Negative
27i Declaration and initial study and are adopted as findings
and conditions of Planning Commission Resolution Nos.
3279 and 3280, incorporated herein by reference.
