HUSTON, CITY MANAGER PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION FINAL ACCEPTANCE OF PUBLIC IMPROVEMENTS - NEWPORT AVENUE FROM MC FADDEN AVENUE TO FIRST STREET AND EL CAMINO REAL FROM NEWPORT AVENUE TO ORANGE STREET REHABILITATION PROJECT (CA:P: NOS: 700!26~ 7f}fr[ 2o AND 7flf}153) ISUMM._~_~_~Y' The City s repair and resurfacing project on Newport Avenue from McFadden Avenue to First Street and E1 camino Real from Newport Avenue to Orange Street has been completed to the satisfaction of the Public Works Department/Engineering Division and is now ready for acceptance by the City Council. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 98-52 accepting said work as complete and authorizing the recordation of the Notice of Completion and direct the City Clerk to: o Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion; and , Release the Faithful Performance Bond not sooner than one year after the date of recordation of the Notice of Completion; and Assuming no claims or stop notices are filed, it is further recommended that 35 days after the date of recordation of the Notice of Completion, that the Council authorize payment of the final 5% retention in the amount of $35,046.45. This amount together with previous payments of $665,882.45 represents 100% of the final contract amount. FISCAL IMPACT The final cost of the construction contract is $700,928.90. This project was funded 50% fi.om Measure "M" Turn Back funds with 50% match in Federal funds. The 50% Federal match was for design, construction and construction engineering and will be reimbursed to the City after submittal and approval of the final project report. BACKGROUND The Orange County Transportation Authority previously approved the three segments of this project for Local Surface Transportation Program (LSTP) Federal funds with a 50% match for preliminary engineering, construction and construction engineering phases. 'The street pavement was repaired, reconstructed and/or resurfaced within the limits of the project along with all appurtenant work as shown on the attached project location map, The work has been completed to the satisfaction of the Engineering Division. The final contract amount of $700,928.90 represents an increase of 0.5% from the original contract amount of $697,611.55. The increase reflects final field measured quantities. Noble Company having a contract with the City of Tustin to construct the hereinafler described public works and improvements; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvements hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more 'particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said · public work and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public work and imp~:ovement is found to be complete, and the same is hereby accepted. Said public work and improvement is more particularly described as follows: Newport Avenue from McFadden Avenue to First Street and El Camino Real from Newport Avenue to Orange Street Rehabilitation Project (C.I.P. Nos. 700126, 700129 and 700153) AND BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works and improvement described herein as required by law. PASSED AND ADOPTED at a regular meeting of the City Council of the City ' of Tustin held on the 154 day of June 1998. ATTEST: Thomas R.
