SUBJECT: CITY OF TUSTIN MEASURE M GROWTH MANAGEMENT/CONGESTION
MANAGEMENT ANNUAL PROGRAM COMPLIANCE (1998-99 FY)
SUMMARY
In order to maintain eligibility for the Measure M Programs and the Proposition 111 Congestion
Management Program, the City is required t° annually submit a compliance package to the Orange County
Transportation Authority that includes an updated Seven-Year Capital Improvement Program and a
Maintenance of Effort Certification.
RECOMMENDATION
In order to maintain eligibility for the Measure M Programs and the Proposition 111 Congestion
Management Program (CMP), it is recommended that the City Council take the following actions in
compliance with Measure M and CMP requirements:
A)
Adopt the attached draft Measure M Growth Management/Congestion Management Seven
Year Capital Improvement Program (Fiscal Year 1998-99 through Fiscal Year 2004-2005).
B)
Authorize the Public Works Director/City Engineer to submit the City of Tustin's
Proposition 111 CMP and Measure M eligibility packages, including certification of the
City's Maintenance of Effort (MOE) to the Orange County Transportation Authority
(OCTA).
FISCAL IMPACT
Compliance with Measure M and CMP requirements will ensure continued City eligibility for the Measure
M Local Tumback Program, the Measure M competitive programs and the Proposition 111 Congestion
Management Program Gas Tax Subventions.
BACKGROUND
In June 1990, California voters passed Proposition 111, establishing a gas tax for the purpose of
transportation funding improvements statewide. In November 1990, the voters of Orange County approved
Measure M, the revised Traffic Improvement and Growth Management Plan (GMP), which established a
one-half cent sales tax over a 20-year period. In order to receive revenue from these programs for facility
improvements, Tustin and other cities of Orange County must continue to meet certain requirements.
Tustin's Measure M eligibility package for Fiscal Year 1997-98 was approved by OCTA last year. In order
to maintain eligibility for these programs, the City is required to submit the following items for the Fiscal
Year 1998-99 submittal:
Seven Year Capital Improvement Plan (CIP)
The draft CIP is a seven year projection of specific projects upon which Measure M and Proposition 111
funds will be expended. Adoption of the seven year CIP is a requirement of both Measure M (GMP) and
CMP. It is intended that this CIP supersede the one filed with last year's Measure M Compliance Package
on June 16, 1997. Included in the plan are projects that could be submitted to OCTA during this year's
Measure M "call for projects". At this time, the proposed CIP is in a draft form until the formal adoption
of the City's seven year Capital Improvement Program as part of the 1998-99 budget process, at which time
the seven year draft CIP will be adjusted accordingly and forwarded to OCTA.
Maintenance of Effort (MOE)
A maintenance of effort report form, with a statement certifying that the City will meet its Maintenance of
Effort expenditure in accordance with Measure M requirements for 1998-99 Fiscal Year, must be submitted
together with a copy of the City's draft budget sections showing those expenditures. The certification will
be executed by the Director of Public Works/City Engineer and submitted to OCTA.
Congestion Management Pro.am (CMP) Monitoring Checklist
The City of Tustin is required every two years to complete the CMP Monitoring Checklist. The checklist
includes information on the Capital Improvement Program, Deficiency Plans, Land Use Coordination, Level
of Service, and the City's TDM Ordinance: This checklist will be executed by the Director of Public
Works/City Engineer and submitted to OCTA.
