Type of Listinq Date/Amount JUNE 5, 1998 GENERAL DEMANDS $ 33,877.2 -~ The Director of Finance has certified that the above listing is in accordance with the approved budget with the following exceptions: Exceptions: NONE BACKGROUND: In September of '1972, the City council approved the use of Government Code Section 37208 which expedites payment of City payroll and accounts payable obligations which are in accordance with an approved budget. Under this procedure, each purchase is not only reviewed at the time the purchase order is issued, but is reviewed by the Finance Department prior to payment of the invoice from the vendor to insure that it conforms to the approved budget. The City Council is'then provided a listing at each Council meeting of the payroll and general warrants issued since the last report.so that it can inspect and confirm these warrants. AFFIDAVIT OF DEMANDS: In accordance with Government Code Section 37208, I hereby certify that the above demands listing (accounts payable of the City) have been found to conform to the approved budget except as noted and have been paid. Recommendation by the Agency Legal Counsel: 1. Open and close the public hearing. . HUSTON, EXECUTIVE DIRECTOR REDEVELOPMENT AGENCY LEGAL COUNSEL JUNE 15, 1998 RELOCATION PLAN AND REPLACEMENT HOUSING PLAN FOR TUSTIN MEADOWS APARTMENT PROJECT PROPERTY This is a supplement to the staff report dated June 15, 1998. RECOMMENDATION.: It is recommended that the Redevelopment Agency: (1) solicit public input, and (2) adopt the enclosed resolution approving the Replacement Housing Plan and the Relocation Plan for the Tustin Meadows Apartment Project property. ~- ENVIRQNMENTALI~CT: The attached resolution states that both the Replacement Housing~ Plan and the Relocation Plan are not "projects" subject to the California Environmental Quality Act ("CEQA") because neither will cause a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. Public Resources Code Section 21065; 14 California Code of Regulations Section 153378(a). Both the Replacement Housing Plan and the Relocation Plan are, in effect, contingency plans that will only be implemented if a disposition and development agreement ("DDA") is entered into between the Redevelopment Agency and the developers of the property containing the Tustin Meadows Apartments Project. The direct physical and indirect physical impacts to the environment stemming from such DDA will be examined by the Agency prior to approval of the DDA. In summary, approval of the Replacement Housing Plan and Relocation Plan for the Tustin Meadows Apartments Project does not commit the Agency to any action that will have a direct physical or indirect physical impact on the environment. JEFFRI~/,/-~/ i~ Agency Counsel Attachment 11Ol.Ol JUN-11-1998 11:55 714 835 7787 98% P.02 JUN-ii-1998 11:~6 WOODRU~ SPR~DLIN & SMART 7i4 8~5 7787 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 1'9 20 21 22 23 24 25 26 27 28 RDA 98-3 RESOLUTION RDA NO. - A RESOLUTION OF THE TUSTIN COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF TUSTIN, CALIFORNIA APPROVING AND ADOPTING THE REPLaCEMENT HOUSING PLAN AND.RELOCATION PLAN FOR THE TUSTIN MEADOWS APARTMENT PROJECT PROPERTY, LOCATED AT 120-250 6TH STREET IN THE CITY OF TUSTIN WHEREAS, the Tustin Community Redevelopment Agency ("Agency") has previously entered into an exclusive offer to negotiate with DeBeikes Investment Company ("DeBeikes") to redevelop the property located at 120-250 6th Street and currently known as the Tustin Meadows Apartment Project (the "Property"); and WHEREAS, it is anticipated that the Agency, DeBeikes, and Warmington Homes of Southern California will negotiate a Disposition and Development Agreement for the redevelopment of the Property with 38 owner occupied, single family homes (the "Project"); and WHEREAS, Health and Safety Code Section 33413.5 requires the Agency to adopt a Replacement Housing Plan not less than 30 days prior to executing an agreement for the disposition and development of property which would lead to the destruction' or removal of dwelling units from the low and moderate income housing market; and WHEREAS, Section 6038 of the state Redevelopment Guidelines (25 California Code of Regulations Section 6038) requires the Agency to prepare, as soon as possible after the initiation of negotiations, and prior to proceeding with any phase of a project that will result in displacement of residents or businesses, a specific Relocation Plan; and WHEREAS, a Replacement Housing Plan and a Relocation Plan have been prepared for the Project and notice of the availability of the Plans for review has been provided to interested persons, including residents of the Tustin Meadows Apartment Project; and WHE~, there will be no direct or indirect fiscal impacts on the Agency or physical impacts on the environment from 'the approva! and adoption of each Plan because neither will be implemented until such time as a Disposition and Development Agreement for redevelopment of the Property is approved by the Agency; and WHEREAS, environmental review in accordance with CEQA will occur prior to the approval of a Disposition and Development Agreement for the Project; and WHEREAS, the Agency now desires =o' approve the Replacement Housing Plan and the Relocation Plan. Public Resources Code Section 21065; 14 California Code of Regulations Section 153378(a). SECTION 2: The Replacement Housing Plan attached hereto is hereby approved and adopted.
