HomeMy WebLinkAboutCC RES 94-070 1 RESOLUTION NO. 94-70 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, CERTIFYING THE FINAL 3 NEGATIVE DECLARATION AS ADEQUATE FOR THE ADOPTION OF AN OWNER PARTICIPATION AGREEMENT 4 FOR THE IMPROVEMENT ON OF THE PROPERTY AT 100 WEST MAIN STREET INCLUDING REQUIRED FINDINGS 5 PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. The City CoUncil of the City of Tustin does hereby 7 resolve as follows: 8 I. The City Council finds and determines as follows: 9 A. The proposed adoption of an owner participation agreement for the improvement of _ 10 .... the.--property._._~a~ 100- West Main-Street is considered a "project" pursuant to the terms 11 of the California Environmental Quality Act. 12 B. A Negative Declaration has been prepared for this project and has been distributed for 13 public review. 14 C. The City Council has considered evidence presented by the Community Development 15 Director and other interested parties with 16 respect to the subject Negative Declaration. D. The City Council has evaluated the proposed 17 final Negative Declaration and determined it to be adequate and complete. 18 II. A Final Negative Declaration has been completed in 19 compliance with CEQA and State guidelines. The City Council, having authority over the approval of 20 the owner participation agreement for the improvement of the property at 100 West Main 21 Street, has received and considered the information contained in the Negative Declaration, prior to 22 approval of the proposed project, and found that it adequately discussed the environmental effects of 23 the proposed project, The City Council has found that the project involves no potential for an 24 adverse effect, either individually or cumulatively, on wildlife resources and makes a De 25 Minimis Impact Finding related to AB3158, Chapter 1206, Statutes of !990.
