CALL TO ORDER— Meeting #2324 ROLL CALL— City Clerk PUBLIC INPUT — Members of the public may address the City Council on the Special Meeting Agenda item. REGULAR BUSINESS ITEM 1 1. AWARD CONTRACT FOR THE ARMSTRONG AVENUE, WARNER AVENUE, DISPOSITION AREA 2B, 2C, & 8 GRADING AND STORM DRAIN PROJECT (COLLECTIVELY, CIP NO. 70201, 70202, & 70222) Staff is requesting that the City Council award the construction contract for the Armstrong Avenue, Warner Avenue, and Disposition Area 2B, 2C, & 8 Grading and Storm Drain Project (Collectively CIP No. 70201, 70202, and 70222) to the lowest responsive/responsible bidder, Sukut Construction, Inc., and appropriate necessary project funding from Land Proceeds. Recommendation: That the City Council: 1. Appropriate $10,700,000 from Land Proceeds (Fund No. 189) as identified in the adopted Fiscal Year 2013-2014 Capital Improvement Program; obligating $2,200,000 for Armstrong Avenue Grading and Storm Drain (CIP 70201), $500,000 for Warner Avenue Grading and Storm Drain (CIP 70202), and NOTE: As required by Senate Bill 343, any non-confidential writings or documents provided to a majority of the City Council members regarding any item on this agenda will be made available for public inspection in the City Clerk's office located at 300 Centennial Way, Tustin, CA during normal business hours. $8,000,000 for Disposition Area 2B, 2C, & 8 Grading (CIP 70222) covering the costs of construction, construction management and engineering, environmental mitigation monitoring/compliance, geotechnical and materials testing, archaeology and paleontology monitoring/compliance, and a fifteen (15%) construction contract contingency. 2. Award the construction contract for the Armstrong Avenue, Warner Avenue, and Disposition Area 2B, 2C, & 8 Grading and Storm Drain Project (Collectively CIP No. 70201, 70202, and 70222) to the lowest responsive/responsible bidder, Sukut Construction, Inc., in the amount of $8,486,135 and authorize the Mayor and the City Clerk to execute the contract documents on behalf of the City; CLOSED SESSION MEETING PUBLIC INPUT — Members of the public may address the City Council on the Closed Session Agenda item. CLOSED SESSION ITEM - The Brown Act permits legislative bodies to discuss certain matters without members of the public present. The City Council finds, based on advice from the City Attorney, that discussion in open session of the following matters will prejudice the position of the City in existing and anticipated litigation: 1. CONFERENCE WITH REAL PROPERTY NEGOTIATORS (Govt. Code § 54956.8) — One case 1. Property Lots 1,2,3,4,5,6,7,8,9, 10,11, II, D, Final Map 17144; Lots 32, 34, Address/Description Tentative Tract Map 17404; a portion APN's 430-27-31 and 33 and a portion of APN 430-37-10 Agency City of Tustin City Negotiators Jeffrey C. Parker, City Manager, John Buchanan, Deputy Director of Economic Development and David E. Kendig, City Attorney Negotiating Parties O.C. Property Company, LLC, represented by Rick Kaplan, Mark Smith, John Tran and Mark McGranahan, Cushman Wakefield of California, Inc., Irvine, CA. CLOSED SESSION REPORT— David E.
