PUBLIC HEARING (ITEMS I THROUGH 3) 1. APPEAL OF CONDITIONAL USE PERMIT 98-012 (HERITAGE PARK) Conditional Use Permit (CUP) 98-012 is a request to install twelve (12) twenty-five foot high light poles around the perimeter of the roller hockey and basketball courts at Heritage Park (2350 Kinsman CirCle) currently under construction. On May 11, 1998, the Planning Commission approved CUP 98.012. On May 18, 1998, an appeal was filed by residents of the surrounding community requesting reconsideration of the Planning Commission's decision. Adopt the following Resolution No. 98-51 upholding the Planning Commission's ion approving Conditional Use ..mit 98-012' -- RESOLUTION NO. 98-51 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, UPHOLDING THE PLANNING COMMISSION'S ACTION TO APPROVE CONDITIONAL USE PERMIT 98-012 AUTHORIZING SPORTS FIELD LIGHTING AT HERITAGE PARK LOCATED AT 2350 KINSMAN CIRCLE RED HILL AVENUE UNDERGROUND UTILITY'DISTRICT NO. COPPERFIELD DRIVE AND 160'+ NORTH OF EL CAMINO REAL 14 BETWEEN On April 6, 1998, the City Council set Monday, June 1, 1998, as the date for a public hearing regarding the formation of the Red Hill Avenue Underground Utility District No. 14 between Copperfield Drive and 160'+ north of El Camino Real. Recommendation by the Public Works Department/Engineering Division' . Conduct the public hearing as noticed to determine if the public necessity, health, safety or welfare require the removal of poles, overhead wires and associated overhead structures along Red Hill Avenue between Copperfield Drive and 160'+ north of El Camino Real. . At the conclusion of the public hearing, if the City Council determines that this 'area should be designated an underground utility district, have first reading by title only and introduction of the following Ordinance No. 1202' ORDINANCE NO. 1202 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING THE RED HILL AVENUE UNDERGROUND UTILITY DISTRICT NO. 14 BETWEEN COPPERFIELD DRIVE AND 160'+ NORTH OF EL CAMINO REAL LOCAL LAW ENFORCEMENT BLOCK GRANT PROGRAM The Omnibus Appropriations Act for fiscal years 1996 and 1997 authorizes the Director of the Bureau of Justice Assistance to make .funds available to local governments under the Local Law Enforcement Block Grant Program for reducing crime and improving public safety. The Tustin Police Department proposes to expend.these funds for purchase of a Mobile Command Post/Substation. Recommendation by the Police Department: 1.' Open and close the Public Hearing. 2. OF MINUTES - MAY 18, 1998 REGULAR MEETING Recommendation: Approve the City Council Minutes of May 18, 1998. w APPROVAL OF DEMANDS AND RATIFICATION OF PAYROLL Recommendation: Approve Demands in the amount of $1,071,430.53 and ratify Payroll in the amount of $356,964.37. w GENERAL MUNICIPAL ELECTION- NOVEMBER 3, 1998 Recommendation: (1) Adopt the following Resolution No. 98-43 calling and giving notice of the November 3, 1998 General Municipal Election and requesting the Orange County Board of .Supervisors order consolidation and render specified election services, and (2) Adopt the following Resolution No. 98-44 setting candidate statement regulations as .recommended by the City Clerk's Office: RESOLUTION NO. 98-43 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, (1) CALLING AND GIVING NOTICE OF THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 3, 1998, FOR THE ELECTION OF CERTAIN OFFICERS AS REQUIRED BY THE PROVISIONS OF THE LAWS OF THE STATE OF CALIF.ORNIA RELATING TO GENERAL LAW CITIES; (2) REQUESTING THE COUNTY BOARD OF SUPERVISORS ORDER CONSOLIDATION OF THE GENERAL MUNICIPAL ELECTION WITH THE STATEWlDE GENERAL ELECTION ON NOVEMBER 3, 1998; (3) AUTHORIZING THE COUNTY BOARD OF SUPERVISORS TO CANVASS THE ELECTION RETURNS; AND (4) PROVIDING FOR EXPENSES OF THE ELECTION RESOLUTION NO. 98-44- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE PERTAINING TO CANDIDATE STATEMENTS SUBMITTED TO THE VOTERS'AT AN ELECTION TO BE HELD ON TUESDAY, NOVEMBER 3, 1998 ! ANNUAL REVIEW AND ADOPTION OF INVESTMENT POLICY Recommendation' Adopt the City of Tustin Investment Policy with changes as recommended by the City Treasurer. 8, PLANNING COMMISSION ACTION AGENDA- MAY 26, 1998 All actions of the Planning Commission become final unless appealed by the City Council or member of the public. Recommendation: Ratify the Planning Commission Action Agenda of May 26, 1998. Agenda - City Council June 1, 1998 - Page 3 a AUTHORIZATION TO ADVERTISE BIDS FOR DRILLING OF MAIN STREET WELL NO. 4 (CITY PROJECT NO. 600103) Recommendation: (1) Adopt the following Resolution No. 98-50 approving the environmental determination for subject project, and (2) Adopt the following Resolution No. 98-35 approving the plans and specifications and authorizing advertisement for bids for subject project as recommended by the Public Works Department/Water Services Division: RESOLUTION NO, 98-50- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, FINDING THAT THE NEGATIVE DECLARATION APPROVED BY THE CITY COUNCIL-ON FEBRUARY 17, 1998 (RESOLUTION NO. 98-14) IS ADEQUATE FOR THE MAIN STREET WELL FACILITIES WELL NO. 4 CONSTRUCTION PROJECT AND APPLICABLE MITIGATION MEASURES HAVE BEEN INCORPORATED AS REQUIRED BY THE CALIFORNIA ENVIRONMENTAL QUALITY ACT RESOLUTION NO. 98-35 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TU,~TIN, CALIFORNIA, APPROVING PLANS AND SPECIFICATIONS FOR DRILLING OF MAIN STREET WELL NO. 4 AS A REPLACEMENT FOR EXISTING MAIN STREET'WELL NO. 2 (CITY PROJECT NO. 600103) AND AUTHORIZING ADVERTISEMENT FOR BIDS 10. REQUEST FOR LEAVE OF ABSENCE- ROBERT LEE Recommendation: Authorize a leave of absence for Robert Lee exceeding 30 days as recommended by the City Manager. REGULAR BUSINESS (ITEMS 11 THROUGH 16) 11'. FISCAL YEAR 1998-99 BUDGET WORKSHOP The draft operating and capital improvements budget will be submitted to the City Council the week of June 16, 1998. Recommendation: Hold the first budget workshop prior to the July 6, 1998 City Council meeting as recommended by the City Manager. 12. APPLICANTS FOR PARKS AND RECREATION COMMISSION AND PLANNING COMMISSION Staff is requesting the City Council set the date and time to conduct interviews to fill vacancies on the Planning Commission and Parks and Recreation Commission. POTENTIAL EXPANSION OF CULTURAL RESOURCE b,oTRICT The Cultural Resource Advisory Committee supports expanding the Cultural Resource District to include the residentially' zoned properties on Mountain View Drive, "A" Street, "B" Street and "C" Street between First Street and Irvine Boulevard. Recommendation: Provide direction to the Cultural Resource Advisory Committee and staff regarding the expansion of the Cultural Resource District as recommended by the Community Development Department. SOLID WASTE PROGRAM ANALYSIS Great Western Reclamation is the City's franchise solid waste hauler and is required to submit an annual report to the City; and Great Western Reclamation has submitted 'a request to the City to place a measure on the November ballot to extend the current Solid Waste Franchise Agreement. Recommendation by the Public Works Department: 1. Receive and file the 1997 Great Western Reclamation Annual Status Report. 2. Receive and file the Solid Waste Program Review Report. . Consider a request from Great Western Reclamation to place a measure on the November 1998 ballot to implement an enhanced recycling program through the extension of the current Solid Waste Franchise Agreement. ORDINANCE NO. 1201 (CODE AMENDMENT 98-002) TRANSPORTATION SYSTEM IMPROVEMENT PROGRAM FEES Ordinance No. 1201 (Code Amendment 98-002) would amend Tustin City Code Section 8101 increasing the minimum building valuation for applicability of the Transportation Systems Improvement Areas development fee from $20,000 to $30,000. Recommendation: Have first reading by title only and introduction of the following Ordinance No. 1201 as recommended by the Community Development Department: ORDINANCE NO. 1201 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING AN AMENDMENT TO TUSTIN CITY CODE SECTION 8101 TO ESTABLISH AND INCREASE THE MINIMUM VALUATION OF DEVELOPMENT PROJECTS THAT ACTIVATE THE TRANSPORTATION' SYSTEM IMPROVEMENT PROGRAM FEES FROM $20,000 TO $30,000 Agenda - City Council June 1, 1998 - Page 5 16. AMENDMENT NO. 1 TO THE JOINT POWERS AGRF~'MENT, TRANSPORTATION SYSTEMS IMPRO tENT AUTHORITY The Amendment to the Joint Exercise of Powers Agreement will revise section (f)l of the agreement to increase the minimum building valuation-for applicability of the Transportation Systems Improvement Areas development fees from $20,000 to $30,000. Recommendation: Approve Amendment No. I to the Joint Exercise of Powers Agreement between the City of Tustin and the City of Santa Ana as recommended by the Community Development Department.
