APPEAL OF CONDITIONAL USE PERMIT 98-012
SUMMARY: Conditional Use Permff (CUP) 98-012 is a request to install twelve (12) twenty
five foot high light poles around the perimeter of the roller hockey and basketball courts at
Heritage Way Park (2350 Kinsman Circle) currently under construction. On May 11, 1998, the
Planning Commission approved CUP 98-012. On May 18, 1998, an appeal was filed by
residents of the surrounding community requesting reconsideration of the Planning
Commission's action.

RECOMMENDATION
That the City Council adopt Resolution No. 98-51 upholding the Planning Commission's
action approving Conditional Use Permit 98-012.
FISCAL IMPACT
This is a City initiated project. Fees were collected for the appeal of the Planning
Commission action to cover the cost of the appeal hearing.
BACKGROUND
The five (5) acre park site is located at the southeast comer of Heritage Way and Tustin
Ranch Road. The site faces Tustin Ranch Road along the west and is separated from the
residential site to the north and south by Kinsman Circle and Heritage Way (see Location
Map).
On October 23, 1996, the City of Tustin entered into an agreement with RJM Design Group,
Inc., to furnish master planning services for the Heritage Way Park. The purpose of a
master plan was to develop a process that would include participation of the citizens and city'
officials. A site awareness tour/workshop was conducted on October 26, '1996 to meet with
community members and residents of the area. Comments from the participants were
collected at the workshop that were later incorporated in the park's preliminary design.

The finalized design, was subsequently presented to the Community by the Parks and
Recreation Commission. On September 15, 1997, the City Council approved the park's
final plan-and specifications. The plan included a lighted roller hockey and lighted
basketball courts with pedestrian level lighting. The park is currently under construction.
The park was designed to provide a variety of active recreation oppommities for Tustin
residents. In addition to an unlighted open play/multi-use field, the addition of court lights
to the roller hockey rink and the full and two (2) half-basketball courts are proposed.
Pursuant to Section 3.9.2A of the East Tustin Specific Plan (ESTP), sports field lighting
requires approval of a Conditional Use Permit .by the Planning Commission. On May 11,
1998, the Planning Commission conducted a public heating and adopted Resolution No.
3590 approving the project (Attachment C).
Following the Planning Commission's action, on May 18, 1998, an appeal was filed by
Nancy Lawrence and Jean L. Van Camp. A petition signed by thirty (30) residents of the
surrounding community accompanied the appeal. The residents specifically opposed the
Planning Commission's action claiming that the lights woUld have a negative affect on the
quality of lives and property values of the surrounding residents.
DISCUSSION

During the preliminary design process, noise and park lighting impacts to the community
were considered. The design consultant determined that the lighting design should meet
Illuminating Engineering Society minimum standards for safety and.security and
recommended mitigation measures to minimize the lighting and noise impact to neighboring
residences. There was an emphasis on using focused lighting to control spill over and
minimize impacts on adjacent 'properties. The active play areas were depressed and
sheltered by landscaping berms to mitigate the noise impact.
Since a minimum amount of lighting is required for public security and safety, chances for
evening use of the park increased. Therefore, providing play level lighting is necessary to
reduce the liability during evening hours and maximize use of the park by the community.
The proposed court lighting has been desi .gned consistent with the mitigation measures to
reduce noise and lighting impacts. The lighting meets the minimum lighting requirement as
recommended by the Illuminating Society standards for active play courts. Each light
contains one 1000 watts lamp with an asymmetrical forward throw mounted on 25' high
poles. The forward throw directs the light toward the courts with a rapid decrease to the
back of the lights. The closest light pole to the adjacent properties is measured Sixty (60)
feet fi.om the property line.
The recommended lighting by the Illuminating Society standard for general security of
street and parking lot is two foot candles, which would be provided approximately twenty

(20) feet from the courts. The lights would be connected to a Centralized system controlled
by the Parks and Recreation Services and are turned off at 10:00 p.m. consistent with other
parks throughout the City.

Since the courts would be depressed in relation to the rest of the park and ample trees would
be provided to shield the courts fi.om residential properties, the focused lighting of the courts
would have minimum impact to the residential properties. Park patrons would be able to
enjoy the amenities of the park for longer hours. Condition 3.3 of the attached resolution
specifically requires a field review by the Community Development and Parks and
Recreation Departments to ensure that' the lighting is installed accurately with minimal
impact to the residential properties.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN
UPHOLDING THE PLANNING COMMISSIONS ACTION TO
APPROVE CONDITIONAL USE 'PERMIT 98-012 AUTHORIZING
SPORTS FEILD LIGHTING AT THE ' HERITAGE WAY
NEIGHBORHOOD PARK LOCATED AT 2350 KINSMAN CIRCLE.
The City Council does hereby resolve as follows:
I. The City Council finds and determines as follows:

authorization of sports field lighting on the roller hockey and basketball

welfare of the City of Tustin, as evidenced by the following findings:

The proposed use, as conditioned, will not be detrimental to
surrounding properties in that the lighting is deSigned to provide
direct and focused light on the courts and minimize spillover on the
adjacent residential properties.

The proposed use, as conditioned, will not have a negative effect on
surrounding properties, in that the proposed improvements are for the
general use and enjoyment of the surrounding properties and the
general welfare of the City.

The proposed use is consistent with the City's General. Plan,
especially the goals and policies of the Conservation/Open
space/Recreation Element.

The City Council finds that the proposed fighting will nOt impair the orderly
and harmonious d?veloprnent of the 'area, the present or future development
therein, or the occupancy as a whole.
That the project has been reviewed for consistency with the Air Quality Sub-
element of the City of Tustin General Plan and has been determined to be
consistent with the Air Quality Sub-element.
II.
The City Council hereby approves Conditional Use Permit~98-012 to authorize the
use of sports lighting on the roller hockey and basketball courts at Heritage Way
Park located at 2350 Kinsman Circle, subject to the conditions contained in Exhibit
A attached hereto.
PASSED AND ADOPTED at a regular meeting of the City Council, held on the 1st day of
June, 1998.

CONDITIONS OF APPROVAL

GENERAL
The proposed project shall substantially conform with the submitted plans
for the project date stamped June 1, 1998, on file with the Community
Development Department, except as herein modified, or as modified by the
Director of Community Development in accordance with this Exhibit. The
Director of Community Development may also approve minor modifications
to plans during Plan check if such modifications are to be consistent with the
provisions of the Tustin City Code.

Unless otherwise specified, the conditions contained in this Exhibit shall be
complied with as specified or prior to the issuance of any building permits
for the project, subject to review and approval by the Community
Development Department.
PLAN SUBMITTAL
(4) 2.1
Three (3) sets of construction plans shall be prepared in accordance with
applicable Building Code and submitted for review and approval by the
Community Development Department. Compliance with approved plans
shall be inspected by the Community 'Development Department during
construction and prior to fmal inspection.

Plans and calculations for the structural details of the foundation for the light
pOles and electrical loading shall be submitted for Building and Electrical
Permits.
Lighting

All lights shall be installed at the locations indicated on the submitted plans.
Any modifications to the location or light fixture type shall be subject to
'approval by the Community Development Department Director.

off no later than 10:00 p.m. consistent with the park hours.

in such' a manner to ensure that no negative impact to adjacent properties.
Prior to final completion of the park, .the field lighting for the roller hockey
and basketball courts shall be reviewed by the Community Development
Department and Parks and Recreation Services Department to determine
final fixture adjustments to ensure that direct light rays are oriented away

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITM OF
TUSTIN, APPROVING CONDITIONAL USE PERMIT 98-012 AUTHORIZING
SPORTS FEILD LIGHTING AT THE HE~TAGE WAY NEIGHBORHOOD
.PARK LOCATED AT 2350 KINSMAN CIRCLE.
The Planning Commission does hereby resolve as follows:
I. The Planning Commission finds and determines as follows:

That a proper application for Conditional Use Permit 98-012 was filed by The City
of Tustin Parks and Recreation Services Department to request authorization to
install sports field lighting on the roller hockey and basketball courts at Heritage
Way Park located at 2350 Kinsman Circle.

That the proposed field lighting is subject to'Planning Commission .approval of a
conditional use permit pursuant to Section 3.9.2.A.8 of the East Tustin Specific
Plan.

That a public hearing was duly called, noticed and held on said application On May
11, 1998 by the Planning Commission.

That Environmental Impact Report (EIR 85-02), as modified by supplements and
addenda, for the East Tustin Specific Plan has been previously certified in
conformance with the requirements of the California Quality Act for this project.

That the sports field lighting operation will not, under the circumstances of this case,
be detrimental to the health, safety, morals,, comfort, or general welfare of the
persons residing or working in the neighborhood of such proposed use, nor be
injurious or detrimental to the property and improvements in the neighborhood of
the subject property, or to the general, welfare of the City of Tustin, as evidenced by
the following findings:
1)
The proposed use, as conditioned, will not be detrimental to surrounding
properties in that the lighting is designed to provide direct and focused light
on the coUrts and minimize spillover on the adjacent residential properties.
2)
The proposed use, as conditioned, will not have a negative effect on
surrounding .properties, in that the proposed improvements are for the
general use and enjoyment of the surrounding properties, and the general
welfare of the City.

The Commission finds that 'the proposed lighting will not impair the orderly and
harmonious development of the area, the present or future development therein, or
the occupancy as a whole.

That the project has been reviewed for consistency with the Air Quality Sub-
element of the City of Tustin General Plan and has been determined to be consistent
with the Air Quality Sub-element.
The Planning Commission hereby approves Conditional Use Permit 98-012 to authorize the
use of sports field lighting on the roller hockey and basketball courts at Heritage Way Park
located at 2350 Kinsman Circle, subject to the conditions contained in Exhibit A attached
hereto.
PASSED AND ADOPTED by the Planning Commission of the City of Tustin, at a regular meeting

The proposed project shall substantially conform with the submitted plans for the
project date stamped May 11, 1998, on file with the Community Development
Department, except as herein modified, or as modified by the Director of
Community Development in accordance with this Exhibit. The Director of
Community. Development may also approve minor modifications to plans during
plan check if such modifications are to be consistent with the provisions of the
Tustin City Code.
Unless otherwise specified, the conditions contained in this Exhibit shall be
complied with as specified or prior to the issuance of any building permits for the
project, subject to review and approval by the Community Development
Department.
Conditional Use Permit apprOval shall become null and void unless permits for the
proposed project are issued within twelve (12) months of the date of this Exhibit and'
substantial construction is' underway. Time extensions may be granted by the
Planning Commission if a written request is received by the Community
Development Department within thirty (30) days prior to expiration.
Approval of Conditional Use Permit 98-012 is contingent upon the
applicant/property owner signing and returning an "Agreement to Conditions
Imposed" form as established by the Director of Community Development.
The applicant shall hold harmless and defend the City of Tustin fi.om all claims and
liabilities arising out of a challenge of the City's approval for this project.

Three (3) sets of construction plans Shall be prepared in accordance with applicable
Building Code and submitted for review and approVal by the Community
Development Department. Compliance with approVed plans shall be inspected by
the Community Development Department during construction and prior to final
inspection.

and electrical loading shall be submitted for Building and Electrical Permits.

All lights shall be installed at the locations indicated on the submitted plans: Any
modifications to the location or light fixture type shall be subject to approval by the
Community Development Department Director.
The field lighting for the roller hockey and basketball courts shall be turned off no
later than 10:00 p.m. consistent with the park hours.
The lighting fixtures shall be installed so that fixtures are directed downward in such
a manner to ensure that no negative impact to adjacent properties. Prior to final
completion of the park, the field lighting for the roller hockey and basketball courts
shall be reviewed by the Community Development Department and Parks and
Recreation Services Department to determine final fixture adjustments to ensure that
direct light rays are oriented away fi.om the adjacent residential properties.

Planning Commission Members:
We are opposed to the installation of sports lighting at the new Heritage Way
Park. While the addition of a park is desirable to the neighborhood, we do not
feel that the installation of sports lighting will be beneficial. It is our
understanding that the lights will be turned on until 10 p.m. each night which will
encourage children, teenagers and young .adults to use the facilities until 10 p.m.
This is a small neighborhood park and the noise factor created by night use of
the basketball court and roller hockey courts will be detrimental to all adjaCent
neighbors. In addition, encouraging school age children to be out at night until
10 p.m. could result in undesirable consequences for our community.
The Sports Park, which is located off Jamboree Road very nearby, has more
than adequate facilities for night use. There is no need to provide further sports
lighting in a small park that is located so close to the Sports Park.
We would appreciate your consideration in this matter to help preserve the
quality of life in our community.
