RECOMMENDATION
It is recommended that the City Council:

Conduct the public hearing as noticed to determine if the public necessity, health, safety or welfare
require the removal of poles, overhead wires and associated overhead structures along Red Hill Avenue
between Copperfield Drive and 160'+ north of E1 Camino Real.

At the conclusion of the public hearing, if the City Council determines that this area should be
designated an underground utility district, introduce Ordinance No. 1202 establishing the Red Hill
Avenue Underground Utility District No. 14 between Copperfield Drive and 160' + north of E1 Camino
Real.
FISCAL IMPACT
Engineering. and construction cost of $5'25,000 will be paid by the Edison Company utilizing Rule 20A Funds.
This funding will also replace eight existing Edison owned street lights with eight new Edison owned street lights
on marbelite poles at a different spacing.
BACKGROUND
On April 6, 1998, the City Council adopted Resolution No. 98-27 which set the time and place for a public hearing
to consider the designation and adoption of an underground utility district requiring the removal of poles, overhead
wires and associated structures within the area of the City of Tustin located on Red Hill Avenue between
Copperfield Drive and 160'+ north of E1 Camino Real. This Resolution No. 98-27 set the time and date for a
public hearing on this matter at 7:00 p.m. on June 1, 1998, at the Tustin City Council Chambers. The time and
place of the public hearing has been duly noticed.
DISCUSSION
After consideration of testimony at the public hearing, the City Council should determine whether or not to
designate and adopt an underground utility district along Red Hill Avenue from Copperfield Drive to 160'+ north
of E1Camino Real.

Council introduction of the attached ordinance 'will initiate the formation of the Red Hill Avenue Underground
Utility District No. 14. If introduced, this ordinance would have a second reading and adoption on June 15, 1998,
with an effective date occurring 30 days thereafter.
Attached for the City Council's information is a copy of the City Engineer's Report for the subject district. Notices
of the public hearing time and date for the Red Hill Avenue Underground Utility District No. 14 have been mailed
to all affected utility companies (3) and property owners (11). Four electrical contractors were consulted regarding
the property owner's expense for the Edison conversion. The estimated cost is between $220 and $1,000 for the
commercial properties and $170 to $735 for the residential properties.
Underground Utility District No. 14 was proposed along Red Hill Avenue between Copperfield Drive and Nisson
Road in early 1994. An Engineer's Report was prepared and a public hearing was held by the City Council on
February 22, 1994 to consider undergrounding the existing overhead utilities. Based upon the adjacent property
owner's concerns involving their costs, the Council at the conclusion of the public hearing unanimously voted to
delay any action on Underground District No. 14 until such time as it could be reviewed with furore Capital
Improvement Programs. This review occurred with the adoption of the FY97-98 Capital Improvement Program
that included the widening of Red Hill Avenue at I-5 through the use of Measure M Funds.
Red Hill Avenue between Nisson Road and E1 Camino Real is tentatively scheduled to be widened to major
arterial highway standards in fiscal year 1999-00. The currently proposed Underground Utility District No. 14 has
been extended northerly from what was proposed in 1994 to incorporate this widening area. Establishment of the
Red Hill Avenue Underground Utility District No. 14 at this time will clear the overhead utilities prior to the future
. street-wideningproject. In the event that this underground utility district is not initiated at this time the City may
incur approximately $30,000 to $45,000 additional cost associated with the relocation of four utility poles at the
time of the future street-wideningproject.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN
CALIFORNA, ESTABLISHING THE RED HILL AVENUE UNDERGRO~
UTILITY DISTRICT NO. 14 BETWEEN COPPERFIELD DRIVE' AND 160'2
NORTH OF EL CAMINO REAL
WHEREAS, by Resolution No. 98-27 a public hearing was called for June 1, 1998, at
the hour of 7:00 p.m. in the Council Chambers of the City of Tustin, California, to ascertain
.whether the public necessity, health, safety, or welfare requires the removal of poles, overhead
wires, and associated structures and the underground installation of wires and facilities for
supplying electrical, communication, or similar or associated service, within that certain area of the
City of Tustin more particularly described in the legal description and shown on a map marked
Exhibit "A" attached hereto.
WHEREAS, notice of such hearing has been given to all affected property .owners, if
any, as such are shown on the last equalized assessment roll and to all utilities concerned in the
manner and time required by law; and
WHEREAS, such hearing has been duly and regularly held and all persons interested
have been given an oppommity to be heard.
NOW, THEREFORE, the Council of the City of Tustin does hereby ordain:
I. The Council hereby finds and determines that the public necessity, health, safety
and welfare require the removal of poles, overhead wires and associated structures, 1) to eliminate
concentrations of overhead distribution facilities, 2) to clear streets used extensively by the general
public, which carry a heavy volume of vehicular traffic, and to clear streets which pass through a
civic area, and 3). to facilitate the underground installation of wires and facilities for supplying
electric, communication or similar or associated service in the underground district described in
Exhibit"A" attached hereto and made a part hereof by this reference, and pursuant to the provisions
of Ordinance No. 411 of the City- of Tustin, such area is hereby established as Red Hill Avenue
Underground Utility District No. 14 between Copperfield Drive and 160'+ north of E1 Camin0
Real.
II. The City Council hereby declares its intention to order the conversion.
Ill. The Council does hereby fix August 15, 1999 as the date on which affected
property owners, if any, must be ready to receive underground service and does hereby order the
removal, of all poles, overhead wires and associated overhead structures, and the underground
installation of wires and facilitates for supplying electric, communication or similar or associated
service within Red Hill Avenue.Underground Utility District. No. 14 between Copperfield Drive
and 160'+ north of E1Camino Real on or before November 15, 1999.

IV. The City Clerk is hereby instructed to notify all affected utilities and all persons
owning real property, if any, within Red Hill Avenue Underground Utility District No. 14 between
Copperfield Drive and 160'+north of E1 Camino Real, of the adoption of this ordinance within ten
(10) days after the date of such adoption. Said City Clerk shall finther notify said property owners,
if any, of the necessity that, if they or any person occupying such Property desire to continue to
receive electric, communication, or other similar or associated service, they or such occupant shall,
by the date fixed in this ordinance provide all necessary facility changes on their premises so as to
receive such service from the line of the supplying utility or utilities at a new location, subject to
applicable rules, regulations and tariffs of the respective utility or utilities or file with the Public
Utilities commission of the State of California. Such notification shall be made by mailing a copy
of this ordinance together with a copy of said Ordinance No. 411, together with a statement that the
City Engineer's Report containing details of the district is available for inspection by the public in
the office of the City Clerk, to all affected property owners as such are shown on the last equalized
assessment roll and to all utilities affected by this ordinance.
V. The City Council hereby requests that all utilities which provide service within
the Red Hill Avenue Underground Utility District No. 14 underground each property owner's
service lateral, at the utility's expense in accordance with the provisions of that utility's applicable
rule on file with the Public Utilities commission.

UNDERGROUND UTILITY DISTRICT NO. 14
April, 1998
At their meeting of April 6, 1998, the City Council of the City of Tustin, Califomia passed and
adopted Resolution No. 98-27 calling for a public hearing at 7:00 p.m. on June 1, 1998, to
consider the merits of establishing an underground utility district along Red Hill Avenue between
Copperfield Drive and 160' +/- north of E1 Camino Real and more particularly described and
shown on Exhibit "A" attached hereto.
Field and telephone meetings have been held with both the Southern California Edison Company
and Pacific Bell Telephone Company to determine costs involved. Media One Cable has some
overhead facilities within the district, but per the terms of the City's Franchise Agreement, they
will be required to underground their facilities at no cost to the district. Funding will be provided
by the Edison Company with Rule 20A Funds for their facilities and Pacific Bell will provide
funding for all of their cOmpany-owned facilities. Eight (8) exiiting Edison owned street lights
will be removed and eight (8) new Edison owned street lights on marbelite poles will be installed
at no cost to the City. The estimated cost of the proposed underground work is as follows:

and Cable (Rule 20A) ................................................................................ $525,000.00
Eleven properties will require conversion to accept underground services. Pacific Bell and
Media One Cable will provide the necessary conversion at no cost to the affected property
owners. SOuthern California Edison Company will stub their conduit and conductors to within
6'" to 8" below the existipg ground level at the building. It will then be the property owner's
responsibility to have an electrician extend the conduit and conductors from this location to the
service meter panel and make the conversion to the underground system. All landscaping and
hardscape which is removed and/or damaged as a result of this construction will be replaced
and/or repaired by .the Edison Company contractor at no cost to the property owner. Attached is'
an exhibit of a typical underground conversion which depicts the basic' Southern California
Edison and property owner responsibilities.
Four electrical contractors were consulted regarding the'property owners' expense 'for the Edison
conversion. The following list of property owners' estimated expense reflects the range from the
low estimate to the high estimate for each required conversion.

Initial indications by the utility companies are that their work can be completed in 12 to 16
months.
This district will provide for the removal of all wood utility poles and street lights with overhead
wires along both sides of Red Hill Avenue from Copperfield Drive to 160' +/- north of E1

RECOMMENDATION
That the Tustin City Council at their meeting of September 5, 1995 reaffirm the existing priority
list for undergrounding overhead utility lines and direct staff to submit Red Hill Avenue
Underground Utility District No. 14 for Council consideration when adequate Rule 20A funds
become available.

BACKGROUND
In February of 1992, the City Council established a priority list consisting of nine projects for the
undergrounding of overhead utilities. Since that time one project has been added to the'list (Yorba
Street) and three projects have been completed (Prospect Avenue, Yorba Street, First Street). The
following list represents the current prioritization for future undergrounding districts:

7. Yorba Street between Irvine Boulevard and Seventeenth Street.
An engineer's report was prepared and a public hearing was held by the City Council on February
22, 1994 to consider Undergrounding the existing overhead utilities on Red Hill Avenue between
Copperfield Drive'and the I-5 Freeway. The engineer's report estimated'the total construction cost
to be approximately $259,600 and was detailed as follows:

The above mentioned costs were estimated by an electrical contractor and include both' the
electrical and telephone service conversion costs. There were no other property owner conversion
expenses anticipated.
Utility undergrounding is usually funded by the Public Utilities Commission Rule 20A Regulation.
Rule 20A provides for the total cost of undergroUnding to be borne by the utility company with
the exceptions of'street lights and the' cost of private properTe service conversion. The 'utility
company will provide the service/lateral conduit for each servi conversion from the mainline up
to a maximum length of 100 lineal feet. The cost to install any remaining service' lines would be
borne by the property.owner.
Based upon the adjacent property owner's concerns involving their costs, the Council, at the
conclUsion of the public hearing in February 1994 unanimouslY voted to delay any .action on
Undergrounding District No. 14 until such time as 'it could be' reviewed with future Capital
Improvement Programs.
The Red Hill Avenue Undergrounding District No. 14 as considered by the Council at the public
hearing on 'February 22, 1994, was proposed to be financed primary with Rule 20A funds. At that
time Southern California Edison was willing to advance the City of Tustin's future year's Rule 20A
allocation to cover the cost of immediately proceeding with the Undergrounding construction.
However, with the California Public Utilities Commission's proposed restructuring of the state's
electric utility industry, Southern California Edison is no longer willing to advance Rule 20A
funds. The Edison Company will currently schedule an undergrounding project when a City's
allocation balance is sufficient to cover the anticipated construction costs and an undergroUnd
district has been established by Council Ordinance. Representatives of Southern California Edison
have indicated that the company currently has a backlog of undergrounding projects and it may
take 18 to 24 months to start construction after ordinance adoption.
Due to the prior construction of the three prioritized undergrounding projects, Tusfin's anticipated
allocation balance on December 31, 1995 is expected to be a negative $134,045. Edison
representatives are reasonably sure that the Rule 20A program will continue to be funded for
calendars 1996 and 1997. If Tustin continues to be allocated an amount equivalent to the 1995
allocation of $178,974, on January 1, 1997 the allocation balance would be approximately
$223,903. If the allocation increases annually by 5% due to an increase in number of meters
during the 1996 and 1997 years, the City may have enough funds to reconsider .the formation of
the underground district. However, this funding could still not be used to 'cover the cost of private
service connections. Using the current backlog schedule, construction would begin in 1998/99.
