Binsack, Zoning Administrator PUBLIC CONCERNS: (Limited to 3 minutes per person for items not on the agenda) CONSENT CALENDAR: No Items on Consent Calendar PUBLIC HEARING: 1. CONDITIONAL USE PERMIT 2013-05: A request to establish medical uses within an existing office building and to reduce the number of required off-street parking to accommodate medical uses at Treehaven Plaza. APPLICANT: DAN MAC LELLAN 22961 TRITON WAY, SUITE E LAGUNA HILLS, CA 92653 PROPERTY th OWNER: 17601 17 STREET, LLC ATTN: THE PRES COMPANIES 19782 MACARTHUR BLVD., # 100 IRVINE, CA 92612 TH LOCATION: 17601 17 STREET, TUSTIN ENVIRONMENTAL STATUS: THIS PROJECT IS CATEGORICALLY EXEMPT (CLASS 1) PURSUANT TO SECTION 15301 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action No. 13- 006 approving Conditional Use Permit 2013-05, a request for a reduction of required off-street parking through joint use of parking area to accommodate additional medical uses within the existing building. Zoning Administrator Action Agenda August 14, 2013 Page 2 The Zoning Administrator called the meeting to order. The Zoning Administrator stated she had reviewed the report and opened the public hearing to ask whether the applicant had read and understood the Conditions of Approval. The applicant and representative of the property owner, Dan Mac Lellan and Whitney Allen, both confirmed that they read and understood the Conditions of Approval and had no further questions. The Zoning Administrator approved Zoning Administrator Action No. 2013- 006, thereby approving Conditional Use Permit 213-05. REGULAR BUSINESS: 2. DESIGN REVIEW 2013-005 AND MINOR ADJUSTMENT 2013-04: A request to reconstruct a nonconforming fire-damaged residence and single car garage. APPLICANT/ PROPERTY OWNER: PETER KROKO 12541 CATALINA DRIVE SANTA ANA, CA 92705 PROJECT LOCATION: 230 S. PROSPECT AVENUE TUSTIN, CA 92780 ENVIRONMENTAL STATUS: THIS PROJECT IS CATEGORICALLY EXEMPT (CLASS 1 AND 3) PURSUANT TO SECTION 15301 AND 15303 OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT. RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action 13-008, approving Design Review (DR) 2013-005 and Minor Adjustment (MA) 2013- 04 to partially demolish fire damaged areas and reconstruct an existing residential structure (rated 5D1) and demolish and reconstruct a detached single-car garage at 230 S. Prospect Avenue. The Zoning Administrator stated she had reviewed the report and understood the applicant’s request. The Zoning Administrator opened the public hearing and asked the applicant’s representative if he understood the Conditions of Approval. Brian Opp, the applicant’s representative, stated he had not reviewed the Conditions of Approval. Zoning Administrator Action Agenda August 14, 2013 Page 3 The Zoning Administrator called for the hearing to recess at 10:15 a.m. to allow Mr. Opp time to review the Conditions of Approval. The hearing reconvened at 10:20 a.m. Mr Opp asked for clarification on Conditions 1.5, 3.1, 3.2, and 5.2. The Zoning Administrator responded to Mr. Opp’s questions. Mr. Opp stated he understood the Conditions of Approval. The Zoning Administrator approved Zoning Administrator Action No. 2013- 008, thereby approving Design Review 2013-005 and Minor Adjustment 2013- 004. ADJOURNMENT: 10:25 a.m. The date of the next meeting of the Zoning Administrator will be scheduled when items are set for hearing.
